IV.FACTS8.Buckleyowns and controls the land and structuresonthepropertiesocated at 1803and1809 RockIsland Street(the "BuckleyProperties"). Rosebudowns thepropertylocatedat 1811RockIsland StreetwhereBuckleyoperates ts businessthe"Rosebud Property")(collectivelythe"Properties").9.The City's fire marshal has determinedthat variousexisting structures, facilities,andconditionson the Propertiesconstitute distinct hazardstolifeandproperty.Specifically,thefollowingviolationsofthe Dallas FireCode exist and/or haveexisted at the Buckley Propertyincluding butnot limitedto:1.Failuretoprovideand maintainapproved requiredtransferandprocesstransferoperations n violationof Section3406.5.t through 3406.5.4.4.2. Failure toseparate ank vehiclesandtank car transfer facilitiesby a distanceof 25feet forClass Iliquidsand 15 feet for ClassII and III liquidsfrombuildings,above-groundstoragetanks,combustible materials, propertylines,publicstreets,publicalleysorpublicways in violationof Section3406.5.1.1.
