Motionby:CitizensforSaintPatrick's,anassociation,throughitsco-chairsandco-presidentsEileenAndersonandChristineBulmer,EileenAndersonindividually,ChristineBulmerindividually,LorraineAlund,AntoinetteDelduce,PatrickFalaro,MarionFotache,andDonnaWellworth,allindividuallyandasmembersofCitizensforSt.Patrick'sDate,Place,Time:January4,2013at10:00a.m.inthemorning,orassoonthereafterascounselcanbeheardattheAlbanyCountySupremeCourt,Albany,NewYorkReliefSought:AnordergrantingthemotionofIntervenerstointerveneaspartiesininterestinthisproceeding,andtorearguetheapplicationofpetitionerforleavetosell,transfer,andconveytherealpropertyaboveidentified,andforahearingtodeterminewhetherPetitionershouldbegrantedleavetosell,transfer,andconveycertainrealpropertyintheCityofWatervliet.Inspecific,Intervenersseekthefollowingrelief:A.IntervenersseekanorderofthisCourtgrantingthemleavetointerveneasofrightasrealpartiesininterestpursuanttoCPLR§1012(a)(2)sincetherepresentationoftheinterestofIntervenersbythepetitionermaynotbeadequateandIntervenerswillbeboundbythejudgmentofthiscourt.B.Alternatively,IntervenersseekinterventionbypermissionoftheCourtpursuanttoCPLR§1013sincetheinterests,claimanddefenseoftheIntervenersandthemainbodyofthispetitionhaveacommonquestionoflaworfact,i.e.,whetheritisinthebestinterestsofpetitioneranditsmemberstosell,transferandconveytheidentifiedrealproperty.
