The undersigned affiant. being duly sworn, deposes and says:

That, the affiants, Detective Cody Floyd of the Stonington Police Department and Supervisory Inspector James
Rovella of the Office of the Chief State's Attorney/ Cold Case Unit are sworn law enforcement officers in the State
of Connecticut. The affiants have law enforcement experience in excess of forty-six (46) years and their duties
include the investigation of murder and other crimes of violence, such as that set forth below. The following facts
and circumstances are related from the affiants personal knowledge and/or observations including information
related to the affiants by police officers or other persons with knowledge of the facts.

1. That, on May 2, 2002, at approximately 8:30 p.m. leslie Buck. age 57 of 77 Masons Island Road, Mystic, CT
returned home from a sorority meeting. She parked her vehicle in the garage, and upon exiting the vehicle heard
someone call her name. She was struck in the neck and immediately saw Russell Kirby, age 64, of Ledyard, CT in
the garage holding a black stun gun. They struggled on the garage floor, and Kirby Was able to control her by tying
her hands and legs with rope. Kirby placed leslie Buck back into her vehicle and drove her to his house in
ledyard. They remained at his house for a short period of time whereupon Kirby placed Leslie Buck in her vehicle
and drove around the back roads of Ledyard, Groton and Stonington for over an hour. Kirby stopped the vehicle on
Route 95 in Groton and exited the vehicle. leslie Buck was able to free her self from the rope restraints. Using a
spare key in her possession she was able to escape from Russell Kirby. Upon returning home the police were
contacted. leslie Buck received treatment at Lawrence and MemorlaJ Hospital for her injuries she received during
the assault. Leslie Buck received an abrasion to the back of her head from the stun gun, contusions and swelling to
her wrists and hands, and abrasions to her legs. Russell Kirby was located several hours later at his residence. He
was arrested and charged with Kidnapping 1st among other charges.. He has been incarcerated since his arrest.
His case is still pending. Both Charles Buck and leslie Buck were familiar with Russell Kirby. More so Charles
Buck who has known Kirby since 1969 and more recently, March 2002, employed Kirby as a handy man for odd
jobs at property the Bucks own. In May of 2002, Kirby was renting a garage across the street from 77 Mason Island

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

2. That, on May 4, 2002, at 5:38 p.m. the Stonington Police Department received a 911 call from
Charles Buck, age 55, of 77 Masons Island Road, Mystic, CT. Buck reported that he had just come
home and it appeared to him his wife, Leslie Buck, age 57, had fallen down a flight of stairs and
needed an ambulance. As medical and police personnel were responding, Buck informed the
dispatcher the following information: "Her arms are so black and blue and her lips are so black and
blue"; "there's a big red mark on her neck where she must have hit something"; "there's a big cut on
her forehead and blood is dried on her. She's been there for a while ... "; "there's no pulse, there's no
carotid pulse at all"; "... her hair is all dried and there's blood in the nose. Oh sweetheart. Oh she's
cold, her face is ice cold"; "... her wrists are ice cold"; and, "... were keeping all the doors locked cause
of the other night. Oh Christ, I just came home ... "

3. That, on May 4, 2002, at approximately 5:42 p.m., 8g1. Johnson of the Stonington Police
Department arrived at 77 Masons Island Road. Sg1. Johnson was met by Charles Buck who showed
8g1. Johnson to the first floor stairway landing where his wife was located. 8gt. Johnson observed
Leslie Buck laying partially on her back with her feet on the bottom step of the staircase. Sgt. Johnson
made the following observations: there was a bloodlike substance on Leslie Buck's head and face as
well as blood like stains on her shirt; some of the bloodlike substance appeared to be partially dried and
matted in her hair; there was post mortem lividity present; Leslie Buck's skin was ashen; and, there
was some type of wound on the head.

4. That, on May 4, 2002, at approximately 5:54 p.m., Jeffrey Gray, a paramedic from Lawrence and
Memorial Hospital, arrived at 77 Masons Island Road. Gray was escorted into the Buck residence by
$g1. Johnson. Gray looked at Leslie Buck and from the position she was in, he could see lividity in her
extremities. According to Gray, post mortem lividity was evident on the lower most portion of her arm
and hands. Gray also noted that while checking for a radial pulse on Leslie Buck, she was cold to the
touch and her arm was stiffening, indicating rigor mortis. Gray noticed that she had head injuries, but
could not observe where the injury was because it was covered by dried blood. Gray noted, based on
his experience, that there was not as much blood present at the scene as he expected for a head
injury. He believed she had been there for a period of time because of all of his observations. Gray
looked up the stairs and did not see any blood on the stairs or anything sharp in the area that Leslie
Buck could have hit her head on. Gray presumed Leslie Buck dead at .l?:05 p.m.

AFFIDAVIT

The undersigned affiant. being duly sworn, deposes and says:

5. That, on May 4,2002, at 6:50 p.m., Affiant Floyd and other members ofthe Stonington Police
Department and New london County States Attorney's Office entered the residenc~. of 77 Masons
Island Road. Affiant Floyd did observe upon checking the house that there was no sign of a
disturbance anywhere in the residence and no windows or doors had any evidence of being tampered
with or forced open. A search and seizure warrant for 77 Masons Island Road was obtained and
members of the Connecticut State Police Major Crime Squad processed the scene for evidence. There
were no blood trails located anywhere in the house. The blood stains were confined to the area of
Leslie Buck's clothing and where she lay_Technicians from the Office of the Chief Medical Examiner
(OCME) removed the body of Leslie Buck from the scene and transported her to the aCME in
Farmington, CT. Several items of evidence were seized, including an AT&T phone and digital
answering machine. The AT&T phone and digital answering machine were examined, revealing
thirteen (13) recorded messages. Ofthe thirteen (13) recorded messages, twelve (12) were new
messages and one (1) was an old message, that had been previously listened to. Among the
messages that had not been previously retrieved was a message left on May 4, 2002 at 2:07 PM by
Bob Staplin and a message left on May 4, 2002 at 3:27 PM by Charles Buck.

6. That, on May 4, 2002 at 5:49 p.m., Ofe. Tim Thornton of the Stonington Police Department took a
sworn written statement from Charles Buck while at his residence of 77 Masons Island Road. Charles
Buck stated that on May 4,2002 he and Leslie, his wife, returned to their residence at approximately
1:30- 1:40 p.m. after visiting leslie's mother. Charles Buck stated that he backed the vehicle into the
garage and closed the bay door to make her feel better. Charles Buck stated that he and Leslie went
inside and Leslie began to review the mail, then she attempted to call her friend Maureen Tierney, who
had left a prior message on the answering machine. Charles Buck stated that he and leslie sat on the
couch in the living room and discussed where they would go for dinner while leslie reviewed the mail.
Charles Buck stated that he went into the kitchen to finish reading the newspaper and Leslie stayed in
the living room and read a magazine. Charles Buck stated that he then told Leslie that he was going
to his office to do some paperwork for his business. Charles Buck owns and operates Buck Electric
Inc., located at 126 Elm Str€€t, Stonington, CT. Charles Buck stated that leslie said that she was
going to put some shorts on and go to the back yard and get some sun. Charles Buck stated that he
left the house at approximately 2:05 PM and went to 126 Elm St. and completed some paperwork for
his business. Charles Buck stated that he remained at the business until about 3:40 p.m. Charles
Buck stated that he called leslie around 3:30 p.m. to check on her and see if she needed anything.
Charles Buck stated that he was unable to make contact with her so he left a message.

The undersigned affiant, being duly sworn, deposes and says:

Charles Buck stated that he left Elm St. and went over to Cash Home Center to pick up pepper spray for Leslie.
Charles Buck stated that he left Cash Home Center and returned to Elm S1.at approximately 4:05 p.m. to finish
paperwork. Charles Buck stated that while he was en route to Cash Home Center, he stopped at the
Quiambaug Fire Department. Charles Buck stated that he saw Glen Hathaway's motorcycle out in front of the
firehouse and stopped there to speak with Glen for about five minutes. Charles Buck stated that he left at
approximately 5:20 p.m. to return home. Charles Buck stated that when he arrived home he backed his car into
the garage and then put his truck away. Charles Buck stated that when he entered the house he called for
Leslie, but did not get a response. Charles Buck stated that he went into the living room and saw Leslie lying at
the bottom of the stairs and the cordless phone in pieces. Charles Buck stated that he went and checked to see
if Leslie had a pulse and called 911. Charles Buck stated that Leslie was cold. Charles Buck stated that the
Stonington Police arrived minutes after he called.

7. That, on May 6, 2002 affiant Floyd attended the autopsy of Leslie Buck. The autopsy was conducted by Dr.
Shah at the Office of the Chief Medical Examiner in Farmington, CT. Dr. Shah stated that the laceration to the
forehead of Leslie Buck occurred on the day of her death along with the injury to the back of her head which
was a basal skull fracture causing a subdural hematoma that resulted in her death. Dr. Shah stated that the
forehead laceration occurred first followed closely in time to the injury to the back of her head. Dr. Shah stated
that the laceration to the front of Leslie Buck's head was made by a blunt object with a definitive edge similar to
a 90 degree angle. The forehead revealed a horizontally oriented laceration measuring 1" horizontally with a
gaping of 1/8" and full-thickness laceration of the scalp. Dr. Shah noted that there was obvious tissue bridging
on the left part of the laceration. Dr. Shah determined that the final cause of death was head injuries and the
final manner of death was undetermined. During subsequent interviews with Dr. Shah, she stated that nothing in
the stairway where Leslie Buck was found would have caused the injury to the front of her head. Dr. Shah
stated that the laceration to Leslie Buck's forehead was caused by a force from above in a downward motion
causing the obvious undermining to the wound. Dr. Shah stated that Leslie Buck was standing on the stairs
when she received the blunt trauma injury to her forehead. The two injuries to Leslie Buck occurred
contemporaneous to each other with the forehead injury inflicted first and the fractured skull and brain injury
second. The fractured skull and brain injury is entirely consistent with a fall from an undetermined number of
stairs. Dr. Shah stated that the laceration would have begun to bleed immediately and that due to the lack of
blood at the scene indicates that death occurred quickly. Dr. Shah explained that through the autopsy she
found that Leslie Buck had scar tissue from a heart lesion that was an indicator of Myocarditis. Dr. Shah
explained that this condition may have weakened the heart, but would not have caused her death without the
prior injuries to her head. Dr. Shah stated that Leslie's death was most likely an assault but noted that since
there was only one blunt trauma injury to the head she couldn't be reasonably and medically certain of an
assault. Dr. Shah estimated the time of death as being earlier in !he day rather than later or approximately 2-3
hours prior to the time Leslie's body was found by Charles Buck. Dr. Shah eliminated internal force. such as the
projection of aspirated blood as the source of blood to her clothes.

8. That, later, on July 15, 2004, with the assistance of the FBI, Sergeant Knowles and Detective
Coco were referred to Dr. Michael Baden, Director Medicolegal Investigations Unit for the New York
State Police. Dr. Baden reviewed the autopsy report and photographs of Leslie Buck" crime scene
photographs and video of 77 Masons Island Road. Without issuing a written report, Dr BaQ.~nstated, in

9. That, Attorney Shelley Graves, representing the estate of Leslie Buck in a wrongful death civil
proceeding retained the services of Dr. Barbara C. Wotfe, Forensic Pathologist, employed as a
Medical Examiner for the Office of the District 21 Medical Examiner in the State of Florida. Dr. Wolfe
supplied an affidavit dated August 22. 2006, which stated after reviewing and inspecting materials
relevant to the May 4,2002, death of Leslie Buck, it was her professional opinion stated in terms of a
reasonable degree of medical certainty that the injuries sustained by Leslie Buck on May 4, 2002 were

10. That, as a result of the police investigation, the Stonington Police Department determined that
Charles Buck had a interest in a female other than his wrre, Leslie Buck. On May 6, 2002 at
approximately 4:43 pm Sgt Knowles of the Stonington Police Department interviewed Buck's other
interest, Carol Perez. age 33, of New London, CT. Perez stated she had known Charles Buck for
approximately three months prior to Leslie Buck's death. Perez stated she was employed as a
bartender at the Drawbridge Inn (for purposes of this affidavit referred to as the OBI) located in Mystic.
Perez stated that she met Charles Buck at the OBI when he did some electrical work. After meeting
her, Buck came into the OBI every day that she worked. Perez estimated that about one month prior to
Leslie Buck's death, Charles Buck began to tell her that he loved her. Charles Buck began to give
Perez gifts: $3,000 for a down payment on a car; $468 for auto insurance; $1500 laptop; digital
camera; two pairs of shoes; $100 briefcase and a $450 bed. Perez stated the gifts continued and on
April 24, 2002 Charles Buck accompanied her to the Crystal mall and commented to her concerning a
pair of panties which had "sexy bride" embroidered on them and added that they would look nice on
their honeymoon. On April 25. 2002 Charles Buck again told her that he loved her and added

The undersigned affiant, being duly sworn, deposes and says

that he would get a divorce. On May 4, 2002, Perez stated, even though she was unsure of the exact
time. she is sure that Charles Buck came into the OBI twice, once in the early afternoon and then just
prior to the conclus·ion of her shift at 5:00 p.m. On May 6, 2002 at approx. 8:30 a.m., shortly before the
autopsy was scheduled to be performed on Leslie Buck at the Office of the Chief Medical Examiner,
Perez received a telephone call from Charles Buck. Perez noted that Buck was unemotional and
explained that he found his wife at the bottom of the stairs. Buck stated that Leslie Buck might have
been weak and someone else might have been responsible. Buck added that he will get over it and
asked Perez what she wanted to do that day.

11. That, on May 6, 2002 at approximately 10:00 p.m. Perez made a consensually recorded
telephone conversation with Charles Buck in the presence of Affiant Floyd and Inspector D'Amico.
Buck was recorded with respect to Perez, as saying "how did they find out about you, I wonder?"
Perez informed Buck that she told the police about the gifts from him and Buck indicating to Perez
"Don't tell 'em anything". During the conversation, Buck discovers that Perez told the police about the
money he had given her: "... you told them I loaned you money for a car" Buck specifically requests

determined that Charles Buck continued to provide Carol Perez with gifts in excess of $300,000.

12. That. on May 7, 2002 at approximately 9:00 a.m., affiant Floyd and Inspector D'Amico,
interviewed Charles Buck. Buck outlined his movements and actions on Saturday, May 4,2002. Buck
was consistent with his previous accounts until he recalled that around 3:00 p.m. he was driving
through Mystic near Franks B&P gas station when he was waved down by a busboy from the OBI.
The busboy told him that the bookcase lights weren't working. Buck did not know the busboy's name.
Buck drove over to the OBI and decided not to work on the bookcase lights and left. Buck returned at
4: 10-4: 15 p.m. to the OBI to check on the bookcase lights and oven and had a diet coke. After
stopping at the OBI, he went home. He entered through the garage into the breezeway and noticed the
door between the house and garage was unlocked. He locked it. Buck then located Leslie Buck lying
on the floor at the bottom of the stairs. Buck then called 91-1, and Eric Johnson arrived a few minutes
later. In response to affiant Floyd's question concerning his marriage with Leslie Buck, 8.u.c.k...siated--tft

that his wife was abusive toward him, she would hold hands in pUblic and be nice but in private they
did not get along. In response to affiant Floyd's question concerning his dishonesty regarding his
relationship with Carol Perez, Buck stated at first he and Carol were just acquaintances,

relations with Perez.. Affiant Floyd inquire<Jfurther from Buck regarding other gifts he purchased for
Perez. Buck admitted to buying Perez a digital camera for $200, a Sony Playstation, two pairs of
shoes, perfume and then admitted to giving her $6800 in cash. Buck also said that he had shown
Perez the business property on Elm St. Buck denied any involvement in leslie Buck's death. Buck
stated that he didn't want to talk anymore and wanted to leave. Buck was escorted out of the building
at 3:44 p.m. In response to affiant Floyd's question concerning weapons in the house, Buck
acknowledged he owed several firearms and a piece of wire, Buck further stated that he kept this wire
in his bedroom and he could use it as a club.

13. That, on May 9, 2002, affiant Floyd re-interviewed Carol Perez. Perez stated that earlier in the
day she received a telephone call from Charles Buck. Perez stated that Buck was very eager to meet
with her and give her some personal things. Buck.told her that he loved her more than anything in the
world. During the call, Buck stated he was on his way to see his attorney. Buck added that they (Perez

interviews with Baker, he reported that Charles Buck previously commented that he used the wire as a

former employee at Buck Electric, stated Charles Buck would comment that if he didn't like someone,
he would show him a piece of 500 MCM, circular mills wire and added that Charles Buck would
comment "if you wanted to hurt someone, you hit them in the head with this", meaning the wire. 500
MCM circular mills wire is identical to the piece of wire provided by Baker. On June 6, 2002, Dr. Shah
compared the diameter of the 500 MCM circular mills wire retrieved from Neil Baker to the forehead
injury of Leslie Buck and rendered the following opinion; the diameter of the wire was consistent in
measurement as well as other objects with 90 degree angles to the injury to Leslie Buck's forehead.

16. That, on July 3, 2002, affiant Floyd interviewed Joanne Marksbury, age 49 of Mystic, CT.
Marksbury stated that she first became friends with Leslie Buck about six years ago. A few years ago
she and Leslie would run into each other and Leslie would sometimes ask her about going through a
divorce and Marksbury's experience with domestic violence. Marksbury said that Leslie knew that she
had gone through a divorce with incidents of domestic violence, and that she had obtained a
restraining order. Marksbury said since Leslie first started asking her about divorce and domestic
violence she has continually increased the frequency that she would talk about it as time went on.
Marksbury said that in March, 2002, she noticed Leslie was walking alone and thought it was unusual
because she and Charles Buck would normally walk together. Marksbury said that towards the end of
April, 2002, she had seen Leslie walking in downtown Mystic near the OBion several occasions. As a
result of the investigation the affiants have knowledge that Leslie Buck normally walked a two mile
route from her home to the CVS on Route 1 in Mystic and back. Marksbury said that s~ver.9.1...9~~Or

August 11, 2001. Pray stated that he is familiar with Carol Perez as one of bartenders at the OBI.
Pray stated that "in the past few months" a customer who he came to know as Charles Buck, because
of his frequency of visits to the OBI every time Perez worked; this is the person he knows as giving

18. That, on May 5, 2002, members of the Stonington Police Department interviewed ~alph Hi!I, age
42 of Groton, CT. Hill stated he has been working at the OBI for about five years·.-Hill was familiar with
Carol Perez from working with her at the OBI. Hill stated that about three months before Leslie Buck
died, he started to realize that Perez and Charles Buck had a relationship. Hill stated that Charles
Buck gave Perez numerous gifts. During subsequent interviews, Hill said that he recalled a
conversation he had with Buck. Hill is unsure of the day the conversation took place and fluctuates
between a month prior to several days prior to the kidnapping or the day after Leslie Buck was
kidnapped. Hill stated that he came into work early in the morning and saw Charles Buck sitting in his
reO Buck Electric Company van in the parking lot behind the OBI. Hill stated that Charles Buck was

19. That, on May 8, 2002, members of the Stonington Police Department interviewed Michael
Sposato, age 48 of Westerly, RI. Sposato stated that on May 4, 2002, at about 4: 15 p.m. he arrived for
his shift as a waiter at the OBI. When he arrived for work Charles Buck was sitting at the bar. Sposato
noticed that Buck was unusually nervous or preoccupied. Buck was rubbing his forehead and his
hands together. The dining room lights weren't working so he asked Charles Buck to take a look at
them and Charles Buck corrected the problem. A few minutes later, Carol Perez and Charles Buck
were sitting side by side on the bar stools. It was relatively quiet and Sposato heard Perez say to
Charles Buck, "explain this to me about the police, what can they do?" At that time they realized that
he could hear them talking and they stopped. At 5:10 p.m. another employee, Caroline Thompson
asked Charles Buck to help set up a new stereo for the restaurant. Charles Buck stated, "I can't help
you" and left the restaurant a short time thereafter.

20. That, the following timeline was developed from information gathered from sworn written and oral
statements by Charles Buck, interviews of witnesses and information obtained by law enforcement
officers during the course of the investigation:

20a. Approx. 1:45 p.m.- Charles Buck stated he arrived at 77 Masons Island Road with Leslie Buck.
Charles Buck was operating his MG convertible.

20b. Roxanne Sheffield, checked her watch and the time was 1:45 p.m. when she left her home.
She estimates it takes approx. five minutes or so to drive to the intersection of Masons Island Rd. and
Route 1. At approx. 1:50 p.m., she saw Charles Buck and his wife Leslie Buck in their cream colored
MG at the red light for West bound traffic. Sheffield saw Charles Buck driving and Leslie was in the
passenger's seat. As she drove by Charles and Leslie Buck, Sheffield waved at them as she usually
does and there was no response. As she drove by the MG, Charles Buck appeared angry.

20c. 2:05 p.m.- Charles Buck stated he left the house to go to his office on Elm St in Stonington.
When he got to the office, he got the mail off the front porch, entered checks in the ledger book, made
out a deposit slip and paid bills, made out a 941 coupon for federaf withholding and a check for it to
take to the bank on Monday, entered all debits into the ledger book, began writing down all of the
employees time and material that he used last week on customer's work sheets and pricing them up.
The Buck Electric business office is located at 126 Elm St. in Stonington and east from the intersection
of Route 1 and Masons Island Rd.

20d. Stonington Police execute a Search and Seizure Warrant for the residence of Charles Buck at
77 Masons. Island Rd. Mystic, CT on April 26, 2006 and seize several items related to the business
records for Buck Electric. Among the items seized were a Ledger Book, Deposit Slip, Buck Electric
statement for May 2002, and check #6573 from Buck Electric checking account. The evidence seized
showed no entries in the ledger book for May 4, 2002, (the date of Leslie Buck's death) and the
deposit slip was dated May 6, 2002. Check #6573 made out to the Savings Institute for Federal
Withholding was also dated May 6, 2002.

20e. On April 26, 2006 the Stonington Police Department executed a Search and Seizure Warrant
upon the Savings Institute Bank & Trust. Representatives from the Savings Institute Bank & Trust
advised the officers that their research determined that there were no items or transactions issued by
Buck Electric dated May 4, 2002 on the account.

2Of. During the execution of the Search and Seizure Warrant on April 26, 2006, at the Buck
residence Ofc. Timothy Marley was assigned to stay o~ide the residence with Cha~les Buck while
investigators executed the warrant. During that time Charles Buck spoke freely wrth' Otc. Marley and
explained details of what happened on the day of Leslie Buck's death. Charles Buck told Ofc. Marley
that on the day of Leslie Buck's death, he was going to the business to write bills and to check the
mail. On the way there, he stopped at the Quiambaug Fire Department and spoke to Glen Hathaway
who was standing in the parking lot. Buck said that the conversation only lasted a few minutes and he
left and continued on to the business. Once he arrived at the business, he placed a call to his
residence to see how Leslie was doing. When he called home. he just received the answering
machine. Charles Buck became concerned because he didn't get in contact with his wife and decided
to go home to check on her, This account provided by Charles Buck is vastly different concerning his
sequence of movements after leaving 77 Masons Island Road than what he originally provided in his
previous written and oral statements.

20g. As it relates to the answering machine at the Buck residence: 2:07 p.m., a telephone message
is received from Robert Stapl., about the Quiambaug Fire District Banquet that goes unanswered. At
3:00 p.m., a telephone message is received from Melissa Novak about the Quiambaug Fire District
Banquet that goes unanswered.

20h. Charles and Leslie Buck can be accounted for until approx. 1:50 p.m., driving on Masons
Island Road headed towards their home. Although the times vary, both Carol Perez and Ralph Hill
stated that Charles Buck was at the OBion the first of two visits early in the afternoon of ~ 2002.

20i. During an interview on May 7,2002 with Charles Buck, he said that around 3:00 p.m. on May
4, 2002, he was waved down by a busboy from the OBI in the area of Frank's B&P Gas Station in
Mystic. Buck said that the busboy told him that the bookcase lights weren't working. This is contrary
to what Charles Buck initially said about leaving the resideoce and going straight to the business.
These affiants were unable to confirm the existence of this bus boy through interviews with owners or
other employees.

20j. Between 3:15 and 3:30 p.m., Glen Hathaway was at the Quiambaug Fire Department standing
in tile bay door area of the firehouse doing inventory when Charles Buck drove into the fire department
parking lot. Charles Buck drove into the parking lot from a westerly direction which is the direction
from Charles Buck's house on Masons Island Road. Charles Buck parked in front of the firehouse and
got out of his vehicle to speak with him for about fifteen minutes before leaving. Charles Buck didn't
go into the fire department. Hathaway saw Charles Buck approximately a half hour to forty-five
minutes before the fire department was toned out at 4:06 p.m. for a report of a missing person in the
area of Masons Island. Charles Buck didn't go on that call and it was very unusual for him not to,

p.m., Charles Buck stated he called his residence from the Elm Street business and left a message for
Leslie that goes unanswered. Charles Buck says, "Hi sweetheart bout three thirty I'm over here still
working on my bookwork and getting my report for my meeting on Monday night and so forth. I was
wondering how you are doing? Maybe your sitting out in the yard don't have the phone with you which
is unusual. Um just wanted to check on you. I just wanted to make sure your okay. Alright, I'll be
home a little later on. I still got more bookwork to do and I want to go get that mace for you wanted or
the pepper spray or whatever and I'll be home okay and you know wherever you want to go to eat
tonight is fine. You know we can go wherever you want, One South or whatever else okay? I'll talk to
you in a little bit. Bye, bye."

201. 3:35 PM, a message is received on the Buck's answering machine from Judy Barber that goes
unanswered.

20m. Charles Buck stated that at approximately 3:50 p.m., he took a break to clear his head and left
the business and drove to Cash Home Center in Mystic and bought 2 pepper sprays for Leslie then

20n. At about 3:45 p.m.-Cindy Berg, manager of the Stonington Community Center Thrift Shop saw
Charles Buck drive past the Thrift Shop in his white MG heading towards Mystic. The Thrift Shop is
located at 28 Cutler St. Stonington, CT., which is a short distance from the Buck Elecjric business
office, located at 126 Elm St. Stonington. CT. .'

200. 3:47 p.m.-Michael Rodgers, an employee of Buck Electric, was at the Chelsea Groton Savings
Bank ATM on Route 1 in Mystic, CT. Rodgers was leaving the ATM when he saw Charles Buck alone
in his MG, wearing his green Quiambaug Fire Department jacket and driving westbound on RT 1
towards Mystic from Stonington. This direction is consistent with Buck leaving the business, Buck
Electric and traveling towards Cash Home Center. Rodgers kept his ATM receipt from Chelsea Groton
Savings Bank, which documented the checking account withdrawal date and time of May 4,2002 at
3:47 PM.

20p. Approximately 3:55 p.m.- Richard Greene sees Charles Buck traveling West on Route 1 near
Hatch St in the MG. Hatch St. is approximately one tenth of a mile West of the intersection of Route 1
and Masons Island Rd. Charles Buck had passed the road entrance to his home at 77 Masons Island
Road.

20q. At about 3:55 p.m.-Martha Slater was leaving the parking lot of Cash Home Center, when she
observed Charles Buck drive into the parking lot in his white MG. Charles Buck was alone and as he
drove past her his face had an intense, pre-occupied look. Slater knows him well and was surprised
that when she waved to him that he did not acknowledge her.

20r. 4:00 p.m.- Receipt from Cash True Value-Mystic, shows 2 Pepper Gas Spray purchased at
4:00 PM by Charles Buck.

20s. At approximately 4:00 p.m.~Patricia Moody saw Charles Buck at Cash Home Center in Mystic,
CT. Moody and Charles Buck stood in the parking lot and talked for about five minutes. During her
conversation with Charles Buck, his fire department pager activated for a signal 76. Charles Buck was
not interested in the call and reset his pager. Moody noticed as they both left the parking lot Charles
Buck was driving the white convertible as he entered 1-95South. This direction is not consistent with a
route returning to the business rather a route consistent with travel to the OBI. A signal 76 is

20t. Robert Staplin-member and Captain of the Quiambaug Fire Department, reviewed the fire
department company alarm report for May 4, 2002 for the search and rescue of an individual at the
Mystic River Marina on Masons Island Road, which shows what members of the Quiambaug Fire
Department responded to the call. The report showed that the time of the call was 4:06 PM and that
Charles Buck did not respond. Staplin said that it was very unusual for Charles Buck not to respond.

20u. Charles Buck previously stated that after buying the 2 pepper sprays for Leslie he returned to
the business. Buck said that he finished his pricing and began to type some thank you notes to people
who had donated raffie items for the Quiambaug Fire Department banquet. Buck stated he arrived at
the Elm Street business at approximately 4:05 p.m. to finish his paperwork. Charles Buck stated that
while he was en route to Cash Home Center he stopped at the Quiambaug Fire Department. Ibis-.

20v. In a statement taken from Carol Perez on May 6, 2002, Perez stated that Charles Buck returned

to the 081 around 4:00 p.m. She continued to state that Charles Buck stayed at the OBI until the
conclusion of her shift at 5:00 p.m. Charles Buck then walked her to her car.

20w. At about 4: 15 PM-Michael Sposato arrived for his shift as a waiter at the OBI. When he arrived
for work Charles Buck was sitting at the bar. Sposato noticed that Buck was unusually nervous or
preoccupied, rubbing his forehead and his hands together. The dining room lights weren't working so
he asked Charles Buck to take a look at them and Charles Buck corrected the problem. A few minutes
later Carol Perez and Charles Buck were sitting side by side on the bar stools. Sposato heard Perez
say to Charles Buck, "explain this to me about the police, what can they do". At that time they realized
that he could hear them talking and they stopped.

The undersigned affiant, being duly sworn. deposes and says:

20x. Around 4:30 p.m.- Carolyn Thompson was at the restaurant and Perez was helping her carry
decorations into the restaurant from the parking lot. She asked Perez to get Charles Buck to hook up
the stereo system for the business. Thompson said that Charles Buck told her that h.~couldn't do rt.
Soon after Charles Buck and Perez left the restaurant together, seemed to be in a hurry, and did not
come back.

20y. 5:30 p.m.- According to Charles Buck in his inrtial written and oral statements, he returned home
to Masons Island Road from the business. VVitnessesfrom the OBI place Buck at the OBI from 4: 15
p.m. until 5:00 p.m. when Perez completed her shift.

20z. 5:38 p.m.-a 911 call was received by Sgt. Louis Diamanti from Charles Buck reporting that his
wife, Leslie Buck, fell down the stairs at their residence and he needed an ambulance.

21. That, on August 2, 2002, a search and seizure warrant was executed at the residence of
Charles Buck, 77 Masons Island Road. Dr. Shah of the aCME, Dr, Henry Lee of the State of
Connecticut Forensic Science Laboratory, State's Attorney Kevin Kane and additional representatives
of those offices were present along with personnel from the State Police Major Crime Squad and the
Stonington Police Dept Measurements and photographs were taken of the stairway where Leslie
Buck's body was found. A chemical test was applied to the stairway area to detect the presence of
blood which proved negative. Dr. Henry Lee concluded, based on his examination of the stairway, that

22. That, on March 31, 2003 the State of Connecticut Forensic Science Laboratory submitted their
report of the August 2, 2002 reconstruction at 77 Mason's Island Rd. Mystic, CT. The report contains
the following conclusions: Leslie Buck's death occurred May 4, 2002 on the first floor staircase
landing.There were no signs offorced entry. Examination of her blouse, shirt. shorts. and the
sneakers that she was wearing revealed no tears, abrasions, or soil stains. The short sleeve

AFFIDAVIT

The undersigned affiant, being duly sworn deposes and says:

polo shirt had several beige colored stains. Analysis of these stains revealed the presence of
components found in sunscreen products. The majority of bloodstains were located on the front of her
clothing and indicate that Leslie Buck was upright, at one point in time, after she received the injury to
her forehead. Two blood drops on the bottom of her right sneaker indicate the victim was in a sitting
position after receiving the wound to her forehead, subsequent movement caused other blood drops
on her sneakers to smear. Some of the bloodstains on her face are consistent with a natural gravity
blood flow pattern from her wound. Other bloodstains on her face are consistent with contact transfer
type patterns. A bloodstain on the floor near her head indicates that her head was moved from left to
right after she received the injury to her forehead Overall, however there was no significant
movement of the victim at the landing. The amount of bleeding at the scene was very minimal and no
castoff pattern was detected.

23. That, based on the above information, the affiants request an arrest warrant be issued for
Charles Buck, DaB: 10-18-1946, of 77 Masons Island Road, Mystic, CT for the charge of Murder in
violation of Connecticut General Statutes, 53a-54a.
