That,theaffiants,DetectiveCodyFloydoftheStoningtonPoliceDepartmentandSupervisoryInspectorJamesRovellaoftheOfficeoftheChiefState'sAttorney/ColdCaseUnitareswornlawenforcementofficersintheStateofConnecticut.Theaffiantshavelawenforcementexperienceinexcessofforty-six(46)yearsandtheirdutiesincludetheinvestigationofmurderandothercrimesofviolence,suchasthatsetforthbelow.Thefollowingfactsandcircumstancesarerelatedfromtheaffiantspersonalknowledgeand/orobservationsincludinginformationrelatedtotheaffiantsbypoliceofficersorotherpersonswithknowledgeofthefacts.1.That,onMay2,2002,atapproximately

p.m.leslieBuck.age57of77MasonsIslandRoad,Mystic,CTreturnedhomefromasororitymeeting.Sheparkedhervehicleinthegarage,anduponexitingthevehicleheardsomeonecallhername.ShewasstruckintheneckandimmediatelysawRussellKirby,age64,ofLedyard,CTinthegarageholdingablackstungun.Theystruggledonthegaragefloor,andKirby

abletocontrolherbytyingherhandsandlegswithrope.KirbyplacedleslieBuckbackintohervehicleanddrovehertohishouseinledyard.TheyremainedathishouseforashortperiodoftimewhereuponKirbyplacedLeslieBuckinhervehicleanddrovearoundthebackroadsofLedyard,GrotonandStoningtonforoveranhour.KirbystoppedthevehicleonRoute95inGrotonandexitedthevehicle.leslieBuckwasabletofreeherselffromtheroperestraints.UsingasparekeyinherpossessionshewasabletoescapefromRussellKirby.Uponreturninghomethepolicewerecontacted.leslieBuckreceivedtreatmentatLawrenceandMemorlaJHospitalforherinjuriesshereceivedduringtheassault.LeslieBuckreceivedanabrasiontothebackofherheadfromthestungun,contusionsandswellingtoherwristsandhands,andabrasionstoherlegs.RussellKirbywaslocatedseveralhourslaterathisresidence.HewasarrestedandchargedwithKidnapping1stamongothercharges..Hehasbeenincarceratedsincehisarrest.Hiscaseisstillpending.BothCharlesBuckandleslieBuckwerefamiliarwithRussellKirby.MoresoCharlesBuckwhohasknownKirbysince1969andmorerecently,March2002,employedKirbyasahandymanforoddjobsatpropertytheBucksown.InMayof2002,Kirbywasrentingagarageacrossthestreetfrom77MasonIslandRoad.A~i!~,~~~e~~sBuckvisitingwithKirby,athisreside~ceinledya~?,~~_daY~'priortQJhe.kidnappir:tg.

2.That,onMay4,2002,at5:38p.m.theStoningtonPoliceDepartmentreceiveda911callfromCharlesBuck,age55,of77MasonsIslandRoad,Mystic,CT.Buckreportedthathehadjustcomehomeanditappearedtohimhiswife,LeslieBuck,age57,hadfallendownaflightofstairsandneededanambulance.Asmedicalandpolicepersonnelwereresponding,Buckinformedthedispatcherthefollowinginformation:"Herarmsaresoblackandblueandherlipsaresoblackandblue";"there'sabigredmarkonherneckwhereshemusthavehitsomething";"there'sabigcutonherforeheadandbloodisdriedonher.She'sbeenthereforawhile...";"there'snopulse,there'snocarotidpulseatall";"...herhairisalldriedandthere'sbloodinthenose.Ohsweetheart.Ohshe'scold,herfaceisicecold";"...herwristsareicecold";and,"...werekeepingallthedoorslockedcauseoftheothernight.OhChrist,Ijustcamehome..."3.That,onMay4,2002,atapproximately5:42p.m.,8g1.JohnsonoftheStoningtonPoliceDepartmentarrivedat77MasonsIslandRoad.Sg1.JohnsonwasmetbyCharlesBuckwhoshowed8g1.Johnsontothefirstfloorstairwaylandingwherehiswifewaslocated.8gt.JohnsonobservedLeslieBucklayingpartiallyonherbackwithherfeetonthebottomstepofthestaircase.Sgt.Johnsonmadethefollowingobservations:therewasabloodlikesubstanceonLeslieBuck'sheadandfaceaswellasbloodlikestainsonhershirt;someofthebloodlikesubstanceappearedtobepartiallydriedandmattedinherhair;therewaspostmortemlividitypresent;LeslieBuck'sskinwasashen;and,therewassometypeofwoundonthehead.4.That,onMay4,2002,atapproximately5:54p.m.,JeffreyGray,aparamedicfromLawrenceandMemorialHospital,arrivedat77MasonsIslandRoad.GraywasescortedintotheBuckresidenceby$g1.Johnson.GraylookedatLeslieBuckandfromthepositionshewasin,hecouldseelividityinherextremities.AccordingtoGray,postmortemlividitywasevidentonthelowermostportionofherarmandhands.GrayalsonotedthatwhilecheckingforaradialpulseonLeslieBuck,shewascoldtothetouchandherarmwasstiffening,indicatingrigormortis.Graynoticedthatshehadheadinjuries,butcouldnotobservewheretheinjurywasbecauseitwascoveredbydriedblood.Graynoted,basedonhisexperience,thattherewasnotasmuchbloodpresentatthesceneasheexpectedforaheadinjury.Hebelievedshehadbeenthereforaperiodoftimebecauseofallofhisobservations.GraylookedupthestairsanddidnotseeanybloodonthestairsoranythingsharpintheareathatLeslieBuckcouldhavehitherheadon.GraypresumedLeslieBuckdeadat

p.m.,AffiantFloydandothermembersoftheStoningtonPoliceDepartmentandNewlondonCountyStatesAttorney'sOfficeenteredtheresidenc~.of77MasonsIslandRoad.AffiantFloyddidobserveuponcheckingthehousethattherewasnosignofadisturbanceanywhereintheresidenceandnowindowsordoorshadanyevidenceofbeingtamperedwithorforcedopen.Asearchandseizurewarrantfor77MasonsIslandRoadwasobtainedandmembersoftheConnecticutStatePoliceMajorCrimeSquadprocessedthesceneforevidence.Therewerenobloodtrailslocatedanywhereinthehouse.ThebloodstainswereconfinedtotheareaofLeslieBuck'sclothingandwhereshelay_TechniciansfromtheOfficeoftheChiefMedicalExaminer(OCME)removedthebodyofLeslieBuckfromthesceneandtransportedhertothe

inFarmington,CT.Severalitemsofevidencewereseized,includinganAT&Tphoneanddigitalansweringmachine.TheAT&Tphoneanddigitalansweringmachinewereexamined,revealingthirteen(13)recordedmessages.Ofthethirteen(13)recordedmessages,twelve(12)werenewmessagesandone(1)wasanoldmessage,thathadbeenpreviouslylistenedto.AmongthemessagesthathadnotbeenpreviouslyretrievedwasamessageleftonMay4,2002at2:07PM

BobStaplinandamessageleftonMay4,2002at3:27PMbyCharlesBuck.6.That,onMay4,2002at5:49p.m.,Ofe.TimThorntonoftheStoningtonPoliceDepartmenttookaswornwrittenstatementfromCharlesBuckwhileathisresidenceof77MasonsIslandRoad.CharlesBuckstatedthatonMay4,2002heandLeslie,hiswife,returnedtotheirresidenceatapproximately1:30-1:40p.m.aftervisitingleslie'smother.CharlesBuckstatedthathebackedthevehicleintothegarageandclosedthebaydoortomakeherfeelbetter.CharlesBuckstatedthatheandLesliewentinsideandLesliebegantoreviewthe

thensheattemptedtocallherfriendMaureenTierney,whohadleftapriormessageontheansweringmachine.CharlesBuckstatedthatheandlesliesatonthecouchinthelivingroomanddiscussedwheretheywouldgofordinnerwhilelesliereviewedthemail.CharlesBuckstatedthathewentintothekitchentofinishreadingthenewspaperandLesliestayedinthelivingroomandreadamagazine.CharlesBuckstatedthathethentoldLesliethathewasgoingtohisofficetodosomepaperworkforhisbusiness.CharlesBuckownsandoperatesBuckElectricInc.,locatedat126ElmStrt,Stonington,CT.CharlesBuckstatedthatlesliesaidthatshewasgoingtoputsomeshortsonandgotothebackyardandgetsomesun.CharlesBuckstatedthatheleftthehouseatapproximately2:05PMandwentto126ElmSt.andcompletedsomepaperworkforhisbusiness.CharlesBuckstatedthatheremainedatthebusinessuntilabout3:40p.m.CharlesBuckstatedthathecalledlesliearound3:30p.m.tocheckonherandseeifsheneededanything.CharlesBuckstatedthathewasunabletomakecontactwithhersoheleftamessage.
