Youmay also have to pay late fees or collectioncosts, which increase this amount.The creditor can collect this debt from youwithout first trying to collect from the bor-rower. §444.4Late charges.
(a) In connection with collecting adebt arising out of an extension of credit to a consumer in or affectingcommerce, as commerce is defined inthe Federal Trade Commission Act, itis an unfair act or practice within themeaning of section 5 of that Act for acreditor, directly or indirectly, to levyor collect any deliquency charge on apayment, which payment is otherwisea full payment for the applicable pe-riod and is paid on its due date or with-in an applicable grace period, when theonly delinquency is attributable to latefee(s) or delinquency charge(s) assessedon earlier installment(s).(b) For purposes of this section,
col-lecting a debt 
means any activity otherthan the use of judicial process that isintended to bring about or does bringabout repayment of all or part of a con-sumer debt.
§444.5State exemptions.
(a) If, upon application to the FederalTrade Commission by an appropriateState agency, the Federal Trade Com-mission determines that:(1) There is a State requirement orprohibition in effect that applies toany transaction to which a provision of this rule applies; and(2) The State requirement or prohibi-tion affords a level of protection toconsumers that is substantially equiva-lent to, or greater than, the protectionafforded by this rule;Then that provision of the rule will notbe in effect in that State to the extentspecified by the Federal Trade Com-mission in its determination, for aslong as the State administers and en-forces the State requirement or prohi-bition effectively.(b) [Reserved]

§453.1Definitions.
(a)
 Alternative container.
An ‘‘alter-native container’’ is an unfinishedwood box or other non-metal receptacleor enclosure, without ornamentationor a fixed interior lining, which is de-signed for the encasement of human re-mains and which is made of fiberboard,pressed-wood, composition materials(with or without an outside covering)or like materials.(b)
Cash advance item.
A ‘‘cash ad-vance item’’ is any item of service ormerchandise described to a purchaseras a ‘‘cash advance,’’ ‘‘accommoda-tion,’’ ‘‘cash disbursement,’’ or similarterm. A cash advance item is also anyitem obtained from a third party andpaid for by the funeral provider on thepurchaser’s behalf. Cash advance itemsmay include, but are not limited to:cemetery or crematory services; pall-bearers; public transportation; clergyhonoraria; flowers; musicians or sing-ers; nurses; obituary notices; gratuitiesand death certificates.

Casket.
A ‘‘casket’’ is a rigid con-tainer which is designed for the encase-ment of human remains and which isusually constructed of wood, metal, fi-berglass, plastic, or like material, andornamented and lined with fabric.(d)
Commission.
‘‘Commission’’ refersto the Federal Trade Commission.(e)
Cremation.
‘‘Cremation’’ is a heat-ing process which incinerates humanremains.(f)
Crematory.
A ‘‘crematory’’ is anyperson, partnership or corporation thatperforms cremation and sells funeralgoods.(g)
 Direct cremation.
A ‘‘direct crema-tion’’ is a disposition of human re-mains by cremation, without formalviewing, visitation, or ceremony withthe body present.(h)
Funeral goods.
‘‘Funeral goods’’are the goods which are sold or offeredfor sale directly to the public for use inconnection with funeral services.(i)
Funeral provider.
A ‘‘funeral pro-vider’’ is any person, partnership orcorporation that sells or offers to sellfuneral goods and funeral services tothe public.(j)
Funeral services.
‘‘Funeral serv-ices’’ are any services which may beused to:(1) Care for and prepare deceasedhuman bodies for burial, cremation orother final disposition; and(2) arrange, supervise or conduct thefuneral ceremony or the final disposi-tion of deceased human bodies.(k)
 Immediate burial.
An ‘‘immediateburial’’ is a disposition of human re-mains by burial, without formal view-ing, visitation, or ceremony with thebody present, except for a gravesideservice.(l)
 Memorial service.
A ‘‘memorialservice’’ is a ceremony commemorat-ing the deceased without the bodypresent.(m)
Funeral ceremony.
A ‘‘funeralceremony’’ is a service commemorat-ing the deceased with the body present.(n)
Outer burial container.
An ‘‘outerburial container’’ is any containerwhich is designed for placement in thegrave around the casket including, butnot limited to, containers commonlyknown as burial vaults, grave boxes,and grave liners.(o)
Person.
A ‘‘person’’ is any individ-ual, partnership, corporation, associa-tion, government or governmental sub-division or agency, or other entity.(p)
Services of funeral director and staff.
The ‘‘services of funeral directorand staff’’ are the basic services, not tobe included in prices of other cat-egories in §453.2(b)(4), that are fur-nished by a funeral provider in arrang-ing any funeral, such as conducting thearrangements conference, planning thefuneral, obtaining necessary permits,and placing obituary notices.
§453.2Price disclosures.
(a)
Unfair or deceptive acts or practices.
In selling or offering to sell funeralgoods or funeral services to the public,it is an unfair or deceptive act or prac-tice for a funeral provider to fail to fur-nish accurate price information dis-closing the cost to the purchaser foreach of the specific funeral goods andfuneral services used in connectionwith the disposition of deceased humanbodies, including at least the price of embalming, transportation of remains,use of facilities, caskets, outer burialcontainers, immediate burials, or di-rect cremations, to persons inquiringabout the purchase of funerals. Any fu-neral provider who complies with thepreventive requirements in paragraph(b) of this section is not engaged in theunfair or deceptive acts or practicesdefined here.(b)
Preventive requirements.
To preventthese unfair or deceptive acts or prac-tices, as well as the unfair or deceptiveacts or practices defined in §453.4(b)(1),funeral providers must:(1)
Telephone price disclosure.
Tell per-sons who ask by telephone about thefuneral provider’s offerings or pricesany accurate information from theprice lists described in paragraphs(b)(2) through (4) of this section andany other readily available informa-tion that reasonably answers the ques-tion.(2)
Casket price list.
(i) Give a printedor typewritten price list to people whoinquire in person about the offerings orprices of caskets or alternative con-tainers. The funeral provider mustoffer the list upon beginning discussionof, but in any event before showing cas-kets. The list must contain at least the

retail prices of all caskets and alter-native containers offered which do notrequire special ordering, enough infor-mation to identify each, and the effec-tive date for the price list. In lieu of awritten list, other formats, such asnotebooks, brochures, or charts may beused if they contain the same informa-tion as would the printed or type-written list, and display it in a clearand conspicuous manner. Provided,however, that funeral providers do nothave to make a casket price list avail-able if the funeral providers place onthe general price list, specified in para-graph (b)(4) of this section, the infor-mation required by this paragraph.(ii) Place on the list, however pro-duced, the name of the funeral provid-er’s place of business and a caption de-scribing the list as a ‘‘casket pricelist.’’(3)
Outer burial container price list.
(i)Give a printed or typewritten price listto persons who inquire in person aboutouter burial container offerings orprices. The funeral provider must offerthe list upon beginning discussion of,but in any event before showing thecontainers. The list must contain atleast the retail prices of all outer bur-ial containers offered which do not re-quire special ordering, enough informa-tion to identify each container, and theeffective date for the prices listed. Inlieu of a written list, the funeral pro-vider may use other formats, such asnotebooks, brochures, or charts, if theycontain the same information as theprinted or typewritten list, and displayit in a clear and conspicuous manner.Provided, however, that funeral provid-ers do not have to make an outer bur-ial container price list available if thefuneral providers place on the generalprice list, specified in paragraph (b)(4)of this section, the information re-quired by this paragraph.(ii) Place on the list, however pro-duced, the name of the funeral provid-er’s place of business and a caption de-scribing the list as an ‘‘outer burialcontainer price list.’’(4)
General price list.
(i)(A) Give aprinted or typewritten price list for re-tention to persons who inquire in per-son about the funeral goods, funeralservices or prices of funeral goods orservices offered by the funeral pro-vider. The funeral provider must givethe list upon beginning discussion of any of the following:(
1
) The prices of funeral goods or fu-neral services;(
2
) The overall type of funeral serviceor disposition; or(
3
) Specific funeral goods or funeralservices offered by the funeral pro-vider.(B) The requirement in paragraph(b)(4)(i)(A) of this section applieswhether the discussion takes place inthe funeral home or elsewhere. Pro-vided, however, that when the deceasedis removed for transportation to the fu-neral home, an in-person request atthat time for authorization to embalm,required by §453.5(a)(2), does not, byitself, trigger the requirement to offerthe general price list if the provider inseeking prior embalming approval dis-closes that embalming is not requiredby law except in certain special cases,if any. Any other discussion duringthat time about prices or the selectionof funeral goods or services triggers therequirement under paragraph(b)(4)(i)(A) of this section to give con-sumers a general price list.(C) The list required in paragraph(b)(4)(i)(A) of this section must containat least the following information:(
1
) The name, address, and telephonenumber of the funeral provider’s placeof business;(
2
) A caption describing the list as a‘‘general price list’’; and(
3
) The effective date for the pricelist;(ii) Include on the price list, in anyorder, the retail prices (expressed ei-ther as the flat fee, or as the price perhour, mile or other unit of computa-tion) and the other information speci-fied below for at least each of the fol-lowing items, if offered for sale:(A) Forwarding of remains to anotherfuneral home, together with a list of the services provided for any quotedprice;(B) Receiving remains from anotherfuneral home, together with a list of the services provided for any quotedprice;(C) The price range for the direct cre-mations offered by the funeral pro-vider, together with:
