In this matter, the suspect is the Los Angeles City Commissioner for Public Works. On November 16, 2012, the suspectattended an event at City Hall. She brought her 11 year old daughter with her. The suspect left the event approximately 3hours later in the company of 2 adults. She left her 11 year old daughter at City Hall. Her daughter followed her out andapproached her on the street approximately 1 block from City Hall. The suspect told the child to go back to City Hall andwait for her. Suspect told her she would be right back. She told the child she was walking 2 individuals to their car andwould be back in 10 minutes.The child immediately walked back to City Hall. Security video shows her inside City Hall in the presence of securityofficers during part of this time. Approximately 45 minutes after her return, she is questioned by City Hall security officers.She is asked who she is and what she is doing there at that time of night. The child told officers she was the daughter ofMs. Alarcon and was looking for her.Security called LAPD for assistance. LAPD transported the victim to LAPD Central Division and contacted DCFS.Suspect Alarcon was subsequently located at the Double Tree Hotel after 1:00am. Subsequently came to CentralDivision in the company of other individuals. Suspect appeared intoxicated, according to officers who saw her at LAPDCentral.The suspect left the victim alone for approximately 3 hours. However, she was unattended for only 45 minutes of thistime period. After that time, Security Officers interceded and took temporary custody of the victim. Also, Security videoindicated that the victim was inside City Hall for part of this time. In sum, it does not appear that she was left by thesuspect under circumstances or conditions "likely to produce great bodily harm or death" (Penal Code Section 273a(a)),which is the only relevant felony statute given the facts of this case. This matter is more appropriately filed as Penal CodeSection 273a(b), which does not require that the circumstances be likely to produce great bodily injury or death. PenalCode Section 273a(b) is a misdemeanor. This case is hereby referred to the City Attorney for filing consideration.
