TroySkaggs.AtthismeetingIinformedyouthatIwaspreparedtoissuedisciplineinthiscaseandthatI waspreparedtoterminateyouformultipleruleviolations.Ireadtoyoualetterofterminationthat outlinedthespecificviolationsandofferedyoutheopportunitytoprovideevidenceinyourdefense. DuringthismeetingitbecameevidentthatyouhadnothadanopportunitytoreviewtheGPSandother relatedelectronicdataindetailandIgrantedyourrequesttohavesuchanopportunityinthenearfuture, priortotheserviceofdiscipline.Thatoriginalterminationletter,datedJuly29,2011,willbecontainedin thisinvestigativefileandwillbeattachedtothisletter,settingthestageforthefindings
in
this
subsequentletterofdiscipline.PleasenotethattheJuly29letterisunsignedasitwasnotservedduetothemitigating factorsthatyouraised. DuringourmeetingonAugust12,youofferedresponsestoseveralallegationsthatinmyopinion, mitigatedyourculpabilityinsomecases.YousubsequentlyreviewedtheGPSandotherelectronicdata andatafollowupmeetingwithmeonAugust25

at1:30p.m.,youpointedoutwhatyouthoughtwere discrepanciesinourfindings.Thefollowingrepresentsmyactualfindingsasaresultofthenewevidence youpresented.ThechargesbelowarereprintedfromtheJuly29terminationletterandIwillspeaktoeach chargeindividually,
VideoAllegations
TheJuly29terminationletterdidnotsubstantiateruleviolationsrelativetotheuseofvideocameras. However,duringourmeetings,youchallengedsomeofthedetailsastowhatvideoyouwereresponsible forandwhetherornotyouhadreceivedinstructionsbysupervisorsnottocapturevideoofOfficer Nicholson'sdeskarea..Iwillnotdetailyourresponseshereastheyareamootpointasitrelatesto disciplineinthiscasesinceIfoundnowrongdoingonyourpartinthisregard.Iofferyoutheopportunity tosubmitawrittenresponsetothereferencestotheuseofvideocontainedintheterminationletterand yourwrittenresponsewillalsobemaintainedinthisinvestigativefile.

OfficerJeffreyWilsonLetterofDiscipline-PS#11-02 September8,2011Page2circumstantialevidencethatyouwerereasonablytheonlyindividualwhohadtheaccess,ability,and availabilitytohaveplacedtheunitonhercar.YouhavesincedemonstratedthattheSentinelunit frequently"skips"partsofitstrackandfrequentlydoesnotrecorditsownlocationormovement.You demonstratedthattheNicholsontrackshadoccasionswherethesystemstartedupatatimeandplace thatmighthaveindicatedtheoperatorofthecarwasmanipulatingit,thesamewayitdidwhileitwas onyourvehicle.Thisrealizationrefutedagoodportionoftheevidencemakingitimpossibletoruleout otherofficersaspotentialsuspects.Youalsoconvincedmethatthelaptopinquestionwasfully accessibleandutilizedbyothermembersoftheunit,againdiminishingtheamountofevidencethat youweretheonewhoplacedtheSentinelonNicholson'scarandmanipulatedthedataonthelaptop. YoualsodemonstratedtomethattheoperationoftheSentinelisnotasdifficultaswebelieved, makingitmuchmorelikelythatsomeoneelseinS.LD.mayhaveacquiredthenecessaryskill.In summary,IamcertainthattheSentinelunitwastrackingyourmovementsonyourcarandIamcertain thatitwastrackingOfficerNicholson'smovementsonhercar.Icannolongersaywithanydegreeof certaintywhowasresponsible.SinceIcannotprovewhoisresponsible,Icannotsaythatyouwere untruthfulinyourdenialthatyouwereresponsible.
