CHAPTERXVI AppealsandRevisionApplicationsofCourtsotherthantheHighCourt ============================================ 1.

Joint appeals or applications Several persons complaining of an order or

judgmentinacriminalcaseaffectingthemallmayjoininoneappealorapplicationfor revision,andonecopyofthe judgment orordercomplainedofshallbesufficient.The Appellate Court may, however, require separate petitions to be made by petitioners whosecaseare,initsopinion,conflicting.Whereajointpetitionisallowed,oneCourt feeandoneVakalatnamashallbesufficient.

Computationoftheperiodoflimitation.Attentionisinvitedtosubsection(2)

ofSection12oftheLimitationAct,1963,whichprovidesthatincomputingtheperiodof limitationforanappealoranapplicationforleavetoappealorforrevisionorforreview ofajudgment,thedayonwhichthe judgment complainedofwaspronouncedandthe timerequisite,forobtainingacopyofthesentenceororderappealedfromorsoughttobe revisedorreviewedshallbeexcluded. AttentionisalsoinvitedtoParagraph1ofChapterXXIoftheCriminalMannual, 1980,whichpermitsapartytoapplyforcertifiedcopiesbypost. Whereapartyappliesforcertifiedcopybypostotherthanregisteredpost,the dateofitsreceiptbytheofficeoftheCourtwouldbethedateofthepresentationofthe application.Whereversuchapplicationismadebyregisteredpost,thesameshallbepre paid foracknowledgment and the dateof posting of the letter would bethedate of presentationoftheapplicationtothecourt.

SalientprovisionsasregardsappealsandRevisionApplications 3. (i)UnderSection374(20and(3)oftheCodeof Criminal Procedure,1973an

appealagainst conviction andsentenceofimprisonmentfornotmorethansevenyears liewtotheCourtofSessions. (ii)UnderSection384(c)oftheCodeofCriminalProcedure,1973anappealof the convictinjailpresentedtoandforwardedbythejailauthoritiestotheAppellate CourtunderSection383shallnotbedismissedsummarilyuntiltheperiodallowedfor preferringsuchappealhasexpired. (iii)Undersubsection(2)ofSection397,thepowersofrevisionconferredunder Section397(1)shallnotbeexercisedforthepurposeofpassinganyorderinregardtothe interlocutoryorderpassedinanyappeal,inquiry,trialorotherproceedings.' (iv)IfanapplicationforrevisionhasbeenmadebyanypersoneithertotheHigh CourtortotheCourtofSessions,nootherapplicationforrevisionmadebythesame personshallbeentertainedbytheotherCourttowhichnosuchapplicationforrevision wasmadeearlier.Inordertoensurethatnosuchapplicationforrevisionwasmadetoany Courtearlier,everyapplicantshallbeaskedtomakeastatementinhisapplicationfor revisionthathehadnotfiledasimilarrevisionapplicationinanyCourtpreviouslyinthe matter. (v)UnderSection399(2)readwith401(4)oftheCodeofCriminalProcedure, 1973,theRevisionApplicationsshallnotbeentertainedattheinstanceofthepartywho didnotbringinanappealthoughhecouldhavepreferredoneundertheCodeofCriminal Procedure, 1973, except in the circumstancesmentioned in Section 401(5) when the SessionsCourtmaytreattherevisionapplicationasanappealanddealwiththesame accordingly. (vi) Under Section 377(1) read with Section 386(c) of the Code of Criminal

Procedure,1973anappealforenhancementofsentenceliesonlytotheHighCourtonthe groundofitsinadequacy.However,underSection399(1)readwithSection,401(1)ofthe CodeofCriminalProcedure,1973,theSessionsJudgeinasuomotuexaminationofthe recordmayexercisethepowersofenhancementofthesentenceunderSection386(c).

GroundsofappealandlistofarticlestobeincludedinthePaperBook UnlessotherwiseorderedbytheCourt,thegourdsofappealandacopyofthelist

ofarticlesproducedintheCourtshallbeincludedinthePaperBookpreparedinan appealbeforetheSessionsCourt.

Acceptance of appeal without copy of judgment When owing to the

proceedingsofaMagistratehavingbeensenttotheHighCourtortosessionsJudge,itis impossibleforanappellanttoobtainacopyofthe Judgment,theCourttowhichan appealhasbeenmadeshouldacceptthepetitionofappeal,thoughnotaccompaniedbya copyoftheJudgmentasrequiredbylaw.TheCourtshouldthenimmediatelywritetothe HighCourtortotheSessionsJudge,asthecasemaybe,statingthatanappealhasbeen madeandaskforthereturnoftherecordandproceedings.

Bail beforeNazir WhenevertheCourtof Sessiondirectsanypersontobe

releasedonbail,theSessionsCourtshallordersuchbailbegivenbeforetheNazirofthe DistrictCourtorbeforesuchMagistrateastheCourtmaythinkmostconvenient.

ContentsofJudgmentTheJudgmentoftheAppellateCourtshouldcontainthe

pointsfordetermination,the decision thereonandthereasonforthedecision(Section 387readwithSection354oftheCodeofCriminalProcedure,1973)

8.

TransmissionofappellatejudgmenttotheTrialCourtTheCourtdeciding

anappealorrevisionshalltransmit acopyofitsjudgmenttotheMagistrateagainst whosedecisiontheappealorrevisionwaspreferred,ortohissuccessorinoffice. Inimportantcases,whentheMagistrate,whosedecisionwasappealedfromor againstwhosedecisiontherevisionwaspreferredhasbeentransferredtoanotherstation he shouldalsopersonallybefurnishedwithacopyofthejudgmentintheappealor revision.

PaperBookAssoonastherecordofacaseunderappealorrevisionisreceived

byaSessionsCourtfromtheTrialCourt,theRecordKeeperwillarrangetogetthe necessarynumberofpaperbookspreparedbytheSectionWritersorClerksworking underhim.

The paper book shall contain Clearly readable xerox or typed copies of the

following: (i)ThedairyofProceedings. (ii)Listofproperty (iii)Thecomplaint(ifany)oritsEnglishtranslationandthecharge. (iv)DepositionsinEnglish (v)Statementsoftheaccusedincludingwrittenstatements,ifany (vi)Thejudgmentororderappealedfromorsoughttotherevised. (vii)Groundsofappealorrevision. Viii)SuchotherdocumentsastheSessionsJudgebyspecialorgeneralordermay directtobeincluded.

Toeachcopyofthepaperbookshouldbeprefixedanindexinthefollowingform: INDEX SerialNo. 1 Particulars 2 ExhibitNo. 3 Page. 4

Careshouldbetakentoseethatthecopiesareaccuratelymadeandthatthereis

nounnecessaryincreaseinthebulkoftherecordbyincludingpageswhicharepratically blankorotherwise.

12.

Thecopiesofthetranslationsshouldbeinitialedascorrectbythetypistandthe

persontranslatingthedocument(ifany)andtheRecordKeeper.

13.

Thetypedcopiesshouldbeartheirownindependentpagingandnothepagingof

theoriginalrecordandthelinesoneverypageshouldbenumberedbythemultiplesof fiveas5,10,15andsoon.

14.

Ordinarily,3copiesofpaperbooksshouldbepreparedinallcases,oneforthe

useoftheCourtonefortheuseofthePublicProsecutorandonefortheuseofthe accusedortheopponent,asthecasemaybe.TheSessionsJudgemayordermoreinany particularcase.

15.

TheCopiesshallbesuppliedtothePublicProsecutorfreeofcost.Thecopies

supplied to the accused and other parties shall be charged at the rates mentioned in paragraph16below:

Providedthat,ifthedefenseoftheaccusedinanycaseisarrangedattheexpense oftheGovernment,acopyofthepaperbooksshallbesuppliedfreeofcosttothelawyer ortoeachofthelawyersappointedatGovernmentcostinsuchacaseandthatifafterthe appointmentofsuchlegalpractitionertheaccusedappointsanotherlawyer,thecopies alreadypreparedandgiventothelawyerappointedbytheCourtatGovernmentcostmay not be madeavailabletothelawyerprivatelyappointedbythe accusedexceptupon paymentofthechargesprescribedinparagraph16below:

ProvidedfurtherthattheCourtmay,ifinitsopinion,thepartyistoopoortopay thecostofthepaperbook,orderthatacopyofthepaperbookshouldbesuppliedtosuch partyfreeofcost.

Thecopiesofthepaperbooktobesuppliedtotheaccusedoranypartytothe

proceedingsorhislawyersonpaymentshallbechargedattherateof6p.per100words orpartthereofinadditiontothecostofthepaperwhichshallbe2p.foreachsheetof foolscapsize.

Ifanyoftheaccusedorpartiestoaproceedingdesirethatmorethanthnumberof

copies prescribed in paragraph 15 above be prepared and supplied to him or them separately,heortheyshallgiveintimationinthatbehalftotheRecordKeeperbeforethe expiryofoneweekfromthereceiptoftheRecordandProceedingsofthecasefromthe LowerCourtintheSessionsCourtorsuchotherfurthertimeasmaybeallowedbythe SessionsCourtandshallalsodepositanamountoramountssufficienttomeetthecosts ofsuchextracopyorcopiesasmaybedeterminedbytheRecordKeeper.TheRecord Keepershallthereafterarrangetosupplysuchextracopyorcopieseachofwhichshallbe chargedasprovidedforintheforegoingparagraph.Iftheactualcostexceedstheamount

ofdeposit,thepartyorpartiesconcernedshallmakegoodthedeficitandifanybalanceis leftoverfromthedepositaftermeetingthechargesofcopiessupplied,thesameshallbe refundedtothepartyorthepartiesconcerned.

18.

Wherethereareseveralaccusedoropponentsconcernedandarrangementshave

notbeenmadewiththeofficeasprovidedinparagraph17aboveforextracopies,the accusedoropponentfirstapplyingshallbeentitledtogetthecopyreservedforhimas mentionedinparagraph15onpaymentofthechargesprescribedinparagraph16.The restoftheaccusedoropponentsshallmaketheirownarrangementsforgettingcopies preparedforthemselves

The orders in regard to the procedure relating to appeals against acquittals,

containedinpara18(1)to(8)ofChapterXVIIofCriminalManual,shouldapplymutatis mutandistoapplicationsforenhancementofsentencesunderSection399oftheCodeof CriminalProcedure,1973.
