Computationoftheperiodoflimitation.Attentionisinvitedtosubsection(2)
ofSection12oftheLimitationAct,1963,whichprovidesthatincomputingtheperiodof limitationforanappealoranapplicationforleavetoappealorforrevisionorforreview ofajudgment,thedayonwhichthe judgment complainedofwaspronouncedandthe timerequisite,forobtainingacopyofthesentenceororderappealedfromorsoughttobe revisedorreviewedshallbeexcluded. AttentionisalsoinvitedtoParagraph1ofChapterXXIoftheCriminalMannual, 1980,whichpermitsapartytoapplyforcertifiedcopiesbypost. Whereapartyappliesforcertifiedcopybypostotherthanregisteredpost,the dateofitsreceiptbytheofficeoftheCourtwouldbethedateofthepresentationofthe application.Whereversuchapplicationismadebyregisteredpost,thesameshallbepre paid foracknowledgment and the dateof posting of the letter would bethedate of presentationoftheapplicationtothecourt.

(iv)IfanapplicationforrevisionhasbeenmadebyanypersoneithertotheHigh CourtortotheCourtofSessions,nootherapplicationforrevisionmadebythesame personshallbeentertainedbytheotherCourttowhichnosuchapplicationforrevision wasmadeearlier.Inordertoensurethatnosuchapplicationforrevisionwasmadetoany Courtearlier,everyapplicantshallbeaskedtomakeastatementinhisapplicationfor revisionthathehadnotfiledasimilarrevisionapplicationinanyCourtpreviouslyinthe matter. (v)UnderSection399(2)readwith401(4)oftheCodeofCriminalProcedure, 1973,theRevisionApplicationsshallnotbeentertainedattheinstanceofthepartywho didnotbringinanappealthoughhecouldhavepreferredoneundertheCodeofCriminal Procedure, 1973, except in the circumstancesmentioned in Section 401(5) when the SessionsCourtmaytreattherevisionapplicationasanappealanddealwiththesame accordingly. persontranslatingthedocument(ifany)andtheRecordKeeper.

Thetypedcopiesshouldbeartheirownindependentpagingandnothepagingof
theoriginalrecordandthelinesoneverypageshouldbenumberedbythemultiplesof fiveas5,10,15andsoon.
