Application form for Designated Point of Entry status for certain imports under Regulation (EC) No 669/2009 implementing Article 15.5 of Regulation (EC) No 882/2004
I [name and position] on behalf of [name of port / airport operator] wish to apply for [name of port / airport] to be a Designated Point of Entry under Article 17(1) of Regulation (EC) No 882/2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules and Regulation (EC) No 669/2009 (as amended) implementing Article 15(5) of Regulation (EC) No 882/2004 of the European Parliament and of the Council as regards the increased level of official controls on imports of certain feed and food of non-animal origin and amending Decision 2006/504/EC. Minimum requirements for a Designated Point of Entry 1. I confirm that the point of entry meets the minimum requirements for a Designated Point of Entry as set down in Article 4 of Regulation 669/2009 and listed in Annex A to this form. 2. I have set down in Annex B to this form an explanation of how this point of entry will meet each of the minimum requirements as a Designated Point of Entry and the resources (e.g. equipment, facilities such as cold storage etc.) in place at the point of entry. Please say if there is any agreement with relevant businesses to make use of the facilities. 3. I understand that, as provided for in the Official Feed and Food Controls (England) Regulations 2009, if the point of entry is not found to comply with the requirements in Article 4 or if the continued operation of the point of entry presents a serious risk to public or animal health, the designated status may be suspended by the Food Standards Agency (the competent authority as regards this function) either in its entirety or may be suspended for some of the premises or for some of the products listed in Annex I of the above Regulation.

This application has been discussed with the local / port health authority [give name of authority or authorities] because some of the obligations in Article 4 of Regulation 669/2009 are to be fulfilled by them. I request that the designation cover the following feed and food of nonanimal origin subject to an increased level of official controls at the designated point of entry and listed in Annex I of the above Regulation (as amended) *(a) all feed and food products listed in Annex I of the above Regulation; or (b) the feed and food products listed in Annex C of this form [please list the items from Annex I of the Regulation that the port / airport should be designated for]. Please note 6. The list of products in Annex I of the Regulation will be amended by the Commission from time to time. 7. The port / airport operator, or the local / port health authority, can request amendments to the products which its designation covers. However: (1) where the designation applies to all products listed in Annex I, the designation will be for any products listed in Annex I as that list changes from time to time unless otherwise requested. (2) where only the frequency of physical and identity checks changes for a listed product in Annex I of the Regulation, the designation will remain for that product unless otherwise requested. (3) where the designation covers only certain listed products and new products are added to the list in Annex I of the Regulation, a request may be made to extend the designation to some / all of those products. 8. Article 15 of the Regulation requires reports to be made to the Commission giving details and controls on each consignment of products listed in Annex I. Annex A Article 4 of the Regulation MINIMUM REQUIREMENTS FOR DESIGNATED POINTS OF ENTRY Without prejudice to Article 19, the designated points of entry shall have at least the following available: (a) a sufficient number of suitably qualified and experienced staff to perform the prescribed checks on consignments; (b) appropriate facilities for the competent authority to undertake the necessary checks; (c) detailed instructions regarding sampling for analysis and the sending of such samples for analysis to a laboratory designated pursuant to Article 12(1) of Regulation (EC) No 882/2004 ("the designated laboratory); (d) facilities to store consignments (and containerised consignment) in appropriate conditions during the period of detention, where appropriate, awaiting the results of the analysis referred to in point (c), and a sufficient number of storage rooms, including cold stores, in cases where a controlled temperature is required due to the nature of the consignment; (e) unloading equipment and appropriate equipment for carrying out sampling for analysis; (f) the possibility to perform the unloading and the sampling for analysis in a sheltered place, where appropriate; (g) a designated laboratory which can perform the analysis referred to in point (c), situated at a place to which the samples can be transported within a short period of time. NOTE: 1) Items (a), (c) and (g) above are issues for the enforcement authorities to address, hence proper liaison with the relevant parties is essential. 2) The designation of the point of entry may be suspended, either in full or part, by the Agency through service of a Notice on the port or airport operator. This will occur when the Agency is satisfied that the continued operation of the Designated Point of Entry presents a serious risk to animal or public health or, there has been a serious breach of the minimum requirements.

Annex B HOW THE DESIGNATED POINT OF ENTRY WILL MEET THE MINIMUM REQUIREMENTS IN ARTICLE 4 OF THE REGULATION Please give an explanation of: how this point of entry will meet each of the minimum requirements for a Designated Point of Entry at (a), (b), (c), (d),(e), (f), (g) at Annex A, for feed and food as appropriate. the resources (e.g. equipment, facilities such as cold stores, etc.) in place at the point of entry.

Please say if there is any agreement with relevant businesses / importers to make use of the facilities. In the explanation please also provide the following information for the relevant points: (a) include the number of enforcement officers and say whether they are appropriately authorised and trained in sampling of imported feed and/or food *.

(b) include details of the facilities where the official controls will take place, including where appropriate if there are facilities for storage at ambient, chilled and / or frozen temperature. Please say if it may include use of a Border Inspection Post, and how cross contamination will be prevented (for example between feed and food). (c) advise if detailed instructions or work procedures on sampling of products for analysis and the sending of such samples for analysis are available *. (d) include whether facilities include storage at ambient, chilled and / or frozen temperature, or use of a Border Inspection Post, during detention. Please say which organisation / company owns the facilities and whether there is any agreement with relevant businesses to make use of the facilities. (e) include if appropriate equipment for unloading, such as fork lift trucks (if appropriate), and taking samples are available. (f) include if unloading and sampling will take place undercover, where appropriate. (g) give the name and address of the designated laboratory (laboratories) *.

* There should be liaison with the local / port health authority on points (a), (c) and (g).
