GUIDELINES FOR APPLYING FOR AUSTRALIAN CAPITALTERRITORY (ACT) NOMINATION -SKILLED – NOMINATED (SUBCLASS 190) VISA
The Australian Capital Territory (ACT) Government encourages skilled migration and can provideadvice on ACT nomination criteria, but not on wider immigration issues.Before lodging an application for nomination, it is recommended that you obtain specificmigration advice relevant to your circumstances from the Department of Immigration andCitizenship (DIAC) or a Registered Migration Agent.The ACT Migration Program is managed by Migration and Information Services, EconomicDevelopment, a Directorate of the ACT Government.
ABOUT THESE GUIDELINES
These guidelines explain how to lodge an application for ACT nomination of a Skilled - Nominated(subclass 190) visa.
SKILLED – NOMINATED (SUBCLASS 190) VISA
This is a points-based visa for skilled workers who are nominated by a state or territory.You may apply for ACT nomination if you are living overseas or if you are already living inAustralia.
APPLICANTS ALREADY LIVING IN AUSTRALIA
If you are already living in Australia, you must be living in Canberra before you can apply fornomination. You must be:
 
employed full time by an ACT employer in your nominated occupation for at least threemonths; or
 
if a graduate from a Canberra institution, employed by an ACT employer in a skilledoccupation.

ACT OCCUPATION LIST
The ACT Occupation List identifies the skills that are currently in demand in Canberra. Thedemand for each occupation is used to determine availability of ACT nomination for thatoccupation. Availability for nomination is listed using three categories.
Category Explanation
Closed Nomination places are not available for this occupation.LimitedNomination places are limited. Occupations must be verifiedbefore the application for nomination is lodged.Open Nomination places are available for this occupation.Regular updates to the ACT Occupation List reflect the current demand in Canberra for eachoccupation.The list of occupations in demand is not linked to specific job vacancies and it is not a guaranteeof a job in an open occupation. You will compete for employment vacancies with all people in thelabour market as part of a normal selection process. Your success will depend on employerrequirements, your relevant skills, your experience and your level of English language ability.
OPEN OCCUPATIONS
You may apply for ACT nomination if your occupation is listed as open on the currentACT Occupation List and you meet the nomination criteria.
LIMITED OCCUPATIONS
If your occupation is listed as limited, it indicates that the current ACT demand for this occupationis almost met or numbers are restricted.To seek nomination of a limited occupation you must have the occupation verified before youlodge your application for nomination.

CLOSED OCCUPATIONS
If your occupation is listed as closed, you may still be able to apply for ACT nomination if youmeet certain criteria. The ACT is able to nominate a limited number of closed occupations eachyear as an off-list nomination.

Preference will be given to:
 
Canberra residents working in the nominated occupation.
 
Overseas residents with a close family member who is resident in Canberra.
Canberra residents working in the nominated occupation
If you are working in Canberra, you can seek nomination of a closed occupation if you are:
 
Employed full time in your nominated occupation in Canberra.
 
Have a current skill assessment in the nominated occupation.
 
The occupation is verified before you lodge the application for nomination.
 
Interstate graduates (who started work in Canberra after 1 July 2012) are not eligible toapply for an off-list occupation.See the section: How to seek verification of a limited or closed occupation.
Overseas residents
If you are living overseas, you can seek nomination of a closed occupation if:
 
You have a current skill assessment in a nominated occupation.
 
You have:
o
 
a close family member who is resident in Canberra; or
o
 
a genuine offer of employment from an ACT employer; or
o
 
are highly employable in the nominated occupation in Canberra.
 
The occupation is verified before you lodge your application.See the Section - How to seek verification of your limited or closed occupation.
HOW TO SEEK VERIFICATION OF YOUR LIMITED OR CLOSED OCCUPATION
To verify a limited or closed occupation email migrationservices@act.gov.au and provide the following documents:
 
Curriculum Vitae (CV) or resume showing 3 years of recent and relevant experience inyour nominated occupation.
o
 
The experience must be in an industry relevant to the ACT.
o
 
Experience in heavy industry, manufacturing, production, international airlines,mining; shipping, oil, head office banking and railways are not generallyconsidered relevant industries.
 
Current skill assessment in the nominated occupation. All VETASSESS skill assessmentsmust be dated after January 2010.
