Brief argues that marriage is a foundational institution universally known and accepted, without regard to the accidents of time and place, as a male-female coupling. It has been given formal or legal recognition in nearly every culture throughout history because it encourages and supports
responsible procreation and childrearing. Because marriage as it has always been understood redounds to the health and well-being of societies in general, it should be preserved without alteration, and from a
federal perspective DOMA does just that.
