NOTICE OF DISMISSAL WITHOUT PREJUDICE

A settlement having been reached between all parties hereto, Plaintiff Fuente

Marketing Ltd. hereby voluntarily dismisses without prejudice its Complaint, and

all of their claims in the above-captioned action pursuant to Fed. R. Civ. P.

41(a)(1). As part of their settlement, as evidenced by the executed Settlement

Agreement attached hereto as Exhibit A, the parties have agreed that the Court

shall retain jurisdiction over any disputes arising out of or related to the parties’

agreement in resolution of this matter.
