Dear Minister McRae,Thank you for the reply sent to me on your behalf (in response to my December 5 email to you). I haveattached a copy of your reply for the convenience of the others included in this distribution list.When Trustees in SD79 (Cowichan) were forced to choose between their duty under the School Act toensure the improvement of student achievement and their duty under the School Act to provide theMinistry of Education with a balanced budget, they chose the former rather than the latter in response tothat complex dilemma (see related copy of legal opinion attached). According to the attached letter, sentto me on your behalf, SD79’s choice to submit a deficit budget was judged by Cabinet to be “a clearviolation of the Act” and so “Cabinet acted to remove the board and appoint an official trustee”. Thatstatement indicates that it was the Cabinet that acted to remove the SD79 board and that you did not actalone as Minister of Education. Your attached letter also indicates that Cabinet judged that SD79’sresponse to that dilemma was “a clear violation of the Act” and did not require “courts to make thatdetermination”; Cabinet made that complex judgement themselves, without aid of the courts. TheCabinet acted swiftly “to remove the board and appoint an official trustee” rather than leave it “up to thecourts to make that determination”.And yet when BC school districts aided (and continue to aid?) an openly Christian evangelicalorganization to advertise, promote and distribute free bibles to students in public schools, despite Section76 of the School Act:
76 (1) All schools and Provincial schools must be conducted on strictly secular and nonsectarian principles.
you (and Cabinet?) judged that it is NOT “a clear violation of the Act” and it is “up to the courts to makethat determination”?Do you really expect BC citizens to believe that you and Cabinet, without the aid of the courts, AREcapable of judging the complex legal dilemma faced by SD79 (and other BC school districts) describedabove, and yet you and Cabinet are also somehow NOT capable of judging contraventions of a singleand clearly written line of the School Act above (Section 76)? Do you really expect BC citizens to believethat you and Cabinet should intervene severely (ie the firing of an elected school board and appointment

of an official Trustee) in response to contravention of Section 111 of the School Act (balanced budget)and yet, somehow, you and Cabinet should NOT intervene, as necessary, in response to contravention ofSection 76 of the same Act?In my opinion, that is simply beyond credibility. In my opinion these decisions by you and Cabinet willlikely be widely interpreted as politically motivated, hypocritical, disrespectful of the law, and damaging toour education system and our society. It also sets a horrible example for our students, our educationsystem and our society by failing to meet this issue head on and by failing to deal with it appropriately.Regardless of your political affiliations, would you please do your job as BC Minister of Education and actto ensure that school districts abide by the School Act? Would you please not turn a blind eye tocontraventions of the School Act?Sincerely,Richard Ajabu
