En la Gaceta Oficial N 40.108 de fecha 08 de febrero de 2013, fue publicado el Decreto N 9.

381, por medio del cual se crea el rgano Superior para la Optimizacin del Sistema Cambiario, con autonoma presupuestaria, administrativa y financiera, destinado al bienestar de la poblacin, a la orientacin adecuada del crecimiento de la economa del pas, y a la creacin del rgimen de las polticas cambiarias, as como la tendencia hacia la baja inflacionaria. El objeto del mencionado rgano ser el diseo, planificacin y ejecucin de las estrategias del Estado en materia cambiaria, para alcanzar la mxima transparencia y eficacia en la asignacin de divisas al sector econmico del pas. Son atribuciones del rgano Superior para la Optimizacin del Sistema Cambiario, las siguientes: 1. Fijar prioridades en la asignacin de divisas del ao fiscal, a los fines del mayor bienestar social, estimular el crecimiento econmico y bajar los niveles de inflacin. Direccionar la calidad y cantidad de las importaciones que sean necesarias para alcanzar las metas presupuestarias. Equilibrar los flujos de disponibilidad de divisas a las necesidades presupuestarias y a la orientacin del Plan Nacional de Desarrollo Econmico y Social. Crear un sistema integrado y automatizado entre el Ministerio del Poder Popular de Planificacin y Finanzas y el Banco Central de Venezuela y el Servicio Nacional Integrado de Administracin Tributaria y Aduanas. Orientar la aplicacin de los certificados de no produccin e insuficiencia de acuerdo a los objetivos del Plan Nacional de Desarrollo Econmico y Social y a la disponibilidad de divisas. Presentar al Presidente de la Repblica Bolivariana de Venezuela, polticas y proyectos para aumentar el flujo de divisas al pas, adicionalmente a las provenientes de la industria nacional de hidrocarburos.

Decree No.9,381 was published in Official Gazette No.40,108 of February 8, 2013. Such Decree provides for the creation of a Superior Office for Optimization of the Exchange-Rate System, with budgetary, administrative and financial powers, aimed at social wellbeing, orientation of local economy growth, creation of an exchange policy system, and reduction of inflation levels. The object of such Decree will be defining, planning and executing State strategies on exchange-rate matters, so to reach maximum transparency and efficiency in foreign currency allocation to the local economic sectors. Powers vested on the Superior Office for Optimization of the Exchange-Rate System include: 1. Set priorities for foreign currency allocation at each fiscal year, in order to maximize social wellbeing, spur economic growth and reduce inflation. Drive the volume and quality of imports required to meet the budgetary goals. Align foreign currency availability with budgetary needs and orient the National Plan for Socioeconomic Development. Create an automated integrated system for the Peoples Ministry for Planning and Finance, the Central Bank of Venezuela, and the National Integrated Service of Customs and Tax Administration. Align the application of Non-Production/ Insufficient Production certificates with the objectives of the National Plan for Socioeconomic Development and foreign currency availability. Present to the President of the Bolivarian Republic of Venezuela, policies and projects aimed at enhancing foreign currency flows to the country, in addition to those generated from the domestic hydrocarbons industry.

Presentar anualmente al Presidente de la Repblica Bolivariana de Venezuela, las polticas de importacin y exportacin no tradicionales que puedan desarrollarse en el ejercicio fiscal, siempre en concordancia con el Plan de Desarrollo Econmico y Social. Velar por la eficacia, eficiencia y buen funcionamiento del organismo operativo del Sistema de Administracin de Divisas. Coordinar el flujo de divisas entrantes al pas provenientes de los hidrocarburos y de otras fuentes, con el objeto de lograr mayor impacto de dichos recursos para el desarrollo social y econmico del pas.

Annually present to the President of the Bolivarian Republic of Venezuela non-traditional import and export policies to be developed in the fiscal year, consistently with the National Plan for Socioeconomic Development. Ensure the effectiveness, efficiency and proper functioning of the entity with competence in foreign currency administration. Coordinate foreign currency flows to the country generated from hydrocarbon-related activities and other sources, to achieve greater impact from such resources for the countrys socioeconomic development.

El rgano Superior para la Optimizacin del Sistema Cambiario estar adscrito al Ministerio del Poder Popular de Planificacin y Finanzas. El Ministerio del Poder Popular de Planificacin y Finanzas, y el Banco Central de Venezuela, mediante resolucin conjunta dictarn las normas que consideren necesarias para adecuacin de la estructura organizativa y funcional del rgano Superior para la Optimizacin del Sistema Cambiario. El mencionado Decreto entr en vigencia a partir de la fecha de su publicacin en Gaceta Oficial.

The Superior Office for Optimization of the ExchangeRate System shall be ascribed to the Peoples Ministry for Planning and Finance. Through joint Resolutions, the Peoples Ministry for Planning and Finance and the Central Bank of Venezuela, shall issue the norms deemed necessary to define the organizational and functional structure of the Superior Office for Optimization of the ExchangeRate System.
