to ensure the City can provideconsistent, uninterrupted municipal services in the event of economic disruption, and declaring an emergency.
WHEREAS
, pursuant to R.C. 5705.13(A), a municipal legislative authority is permitted to establish a special revenuefund for the purpose of accumulating resources to stabilize subdivision budgets against cyclical changes in revenues andexpenditures, and
WHEREAS
, as identified in the City

s Financial Recovery Plan, the City is desirous of establishing such a special revenuewith the primary source of revenues thereto being a percentage of annual general fund revenues, and
WHEREAS
, the Finance Director has established a policy to calculate a target balance for the budget stabilization fund owhich the annual transfer shall not exceed five percent of the revenue credited to the General Fund in the proceeding fiscal year, and
WHEREAS
, the transfer recommendation well be made in the City of Mansfield Annual Budget by the Director of Finance.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THECITY OF MANSFIELD, STATE OF OHIO:
 SECTION 1. That new Special revenue Fund #235, entitled

be, and the same is hereby, established,which fund shall be funded with transfers as percentage of annual General Fund revenues.SECTION 2. That the Budget Stabilization Fund Policy for the City of Mansfield is set forth in the document attached hereto asExhibit A and made a part hereof.SECTION 3. That by reason of the immediate necessity for implementing the Budget Stabilization Fund Policy without delay soas to enhance the fiscal integrity of the City, this measure is determined to be an emergency ordinance for the immediatepreservation of the public peace, health, safety and welfare of the City of Mansfield and its inhabitants and providing it receives theaffirmative vote of two-thirds of all members elected to Council, it shall take effect be in force immediately upon its adoption,otherwise from and after the earliest time allowed by law, after its passage and approval by the Mayor.Caucus 15 January, 20131

BE IT ORDAINED BY THE COUNCIL OF THE
 
CITY OF MANSFIELD, STATE OF OHIO:
 SECTION 1. That the Safety-Service Director be, and she is hereby, authorized to advertise for bids in themanner provided by law, and to enter into a contract or contracts with the lowest and best bidder or bidders for therepair of streets and park roads to be improved by resurfacing the present paved area with asphalt concrete withlimestone aggregate base, milling and recycling pavement, repair of curbs and bases, where necessary, all inaccordance with plans, estimates and specifications now on file with the City Engineer, and pursuant to the list asestablished in Section 2 hereof. Said contract shall include a stipulation that all materials and construction methodsused in said improvement shall be certified by the City's Quality Assurance Representative as meeting the minimumstandards of the 2010 edition of the "State of Ohio, Department of Transportation Construction and MaterialSpecifications Manual" before payment is made on each contract.SECTION 2. That the itemized list of streets to be improved pursuant to Section 1 hereof is shown on theattached schedule consisting of two (2) pages, entitled “Proposed 2013 Resurfacing Program,” which is made a parthereof and marked as Exhibit “A.”SECTION 3. That the entire cost of the improvements, including construction, testing laboratory, engineeringand administrative service authorized in Section 1 hereof shall be paid from Street Resurfacing (#404), StreetDepartment (#53), Contractual Services Classification.SECTION 4.
