Plaintiffs shall submit a revised Motion for Leave to Amend/Proposed Amended Complaint on or before October 9, 2012 and Defendants shall file a Response thereto on or before October 26, 2012;1 Defendants Cross-Motion for Relief Pursuant to 28 U.S.C. 1927 (Doc. No. 36) is DENIED WITHOUT PREJUDICE.2,3

Plaintiffs are cautioned that further failure to abide by Fed.R.Civ.P. 8 and the Third Circuits April 28, 2011 ruling in this matter, will not be tolerated. Defendants are cautioned that utilization of pervasive sarcasm and inappropriate references within briefing (that in and of itself, is excessive for its purported purpose), will not be tolerated. Counsel for both sides are cautioned that unprofessional gamesmanship, rudeness, and otherwise malevolent conduct will not be tolerated. From this point forward, all filings shall be streamlined to address only the legal issue(s) at hand and counsel shall demonstrate the utmost level of civility and respect towards each other and this Court.
