210.44).TheCommissionhasdeterminednottoreviewtheremainingissuesdecidedintheRemandID.Inconnectionwithitsreview,thepartiesarerequestedtobrieftheirpositionsontheissueofwhetherclaim1ofthe'862patentisobviousinviewofHarris'464incombinationwiththeknowledgeofoneofordinaryskillintheartorincombinationwithHoeksma'298.TheCommissionisparticularlyinterestedinresponsestothefollowingquestion:Doestheevidenceintherecordsupportafindingthatclaim1ofthe'862patentisobviousinviewofHarris'464incombinationwiththeknowledgeofoneofordinaryskillintheartorincombinationwithHoeksma'298wheretheevidencedemonstratesthattheexistenceofportablecommunicationdevicesusing"touchsensitiveinputdevices,"includingtouchscreens,wereknownintheartpriortothefilingoftheapplicationleadingtothe'862patentandisdisclosedinHoeksma'298?Indiscussingthisissue,pleaserefertotheteachingsofthereferences,theknowledgeofoneofordinaryskillintheartatthetimeoffilingofthe'862patentapplication,andtheevidenceintherecordregardingthemotivationtocombineHarris'464withtheknowledgeofoneofordinaryskillintheartorwithHoeksma'298.Also,pleaseaddresswhetherthereareanysecondaryconsiderationsthatwouldpreventafindingofobviousness.Thepartieshavebeeninvitedtobriefonlythediscreteissuesdescribedabove,withreferencetotheapplicablelawandevidentiaryrecord.Thepartiesarenottobriefotherissuesonreview,whichareadequatelypresentedintheparties'existingfilings.Inconnectionwiththefinaldispositionofthisinvestigation,theCommissionmay(1)issueanorderthatcouldresultintheexclusionofthesubjectarticlesfromentryintotheUnitedStates,and/or(2)issueaceaseanddesistorderthatcouldresultintherespondentbeingrequired toceaseanddesistfromengaginginunfairactsintheimportationandsaleofsucharticles.IftheCommissioncontemplatessomeformofremedy,itmustconsidertheeffectsofthatremedyuponthepublicinterest.ThefactorstheCommissionwillconsiderincludetheeffectthatanexclusionorderand/oraceaseanddesistorderwouldhaveon(1)thepublichealthandwelfare,(2)competitiveconditionsintheU.S.economy,(3)U.S.productionofarticlesthatarelikeordirectlycompetitivewiththosethataresubjecttoinvestigation,and(4)U.S.consumers.3
