Okay, uh, the time is about, uh, 1010. And for the sake of the transcript, uh, today is April the 20th, 2011. Uh, Im Sergeant Brad Licking, 1123. Im with Craig Lewis. Craig, can you state your name and give me your serial number. Craig Lewis, serial number 0804. Okay, great. Um, uh, before I started the recording, I went ahead and left, uh, some paperwork in here. Uh, again this is IA, uh, 08-0080. Uh, the first one was the Garrity Warning. I, I noticed that you, uh, signed this. Uh, you wrote that you dont have any questions about it and you understand the content of that memo. Is that correct? Yes. Okay. And the second one is, uh, the Notice of Investigation, uh, for this particular investigation. Obviously, we just like to remind people not to talk to anybody about this particular investigation, except for the people that are listed here. Uh, is that your signature at the bottom? Yes, it is. Okay. Um, did you have any questions about either of these forms? No. Okay. Um, prior to us comin in and startin this interview, um, I had a chance to chat with you a little bit. Um, this particular case, obviously, its an 08 so its

Um, um, so, um, basically the, the crux of this investigation kinda goes back to, um, uh, an investigation that was started, um, kinda near of the when MCSO had the, um, basically, they were in charge of the whole contract with the city of El Mirage, um, and Im sure you remember that that time period. LEWIS: LICKING: I do. Okay, um, realistically the only thing that I really wanted to kinda ask you about, um, I had a chance to interview Sergeant Sea- or Lieutenant Seagraves, uh, yesterday. Um, obviously, back during that time, uh, time frame from basically June of 06 till about February of 08 she was in charge of the SVU Unit. Uh, her Lieutenant, um, at least about that last, um, year of that time frame was Lieutenant Brandimarte, uh, over in GID. And at the end of the contract, um, Kim, uh, led me to believe that she had a conversation with, uh, Lieutenant Brandimarte. Um, what she did to kinda set the time frame for this particular conversation was, um, you know obviously in fact all three of us have worked, uh, Phoenix International Raceway before and she said that the weekend of November, uh, the 6th through the 13th, um, of 2007, um, she had asked for time off, um, to work that particular event, um, and what not. The weekend of that event, apparently, she had gotten a call from Lieutenant Brandimarte, um, and it was supposed to have been in regards to, um, certain cases, uh, that were associated with El Mirage and what was to be done with those cases. Um, after the conversation she said that, uh, uh, you were present there out at PIR and that you guys had had a conversation about that. And again, I dont expect you to recall everything about that conversation, um, but anything that you can recall about that conversation, um, Sure. if you could just let me know what that was. Do you happen to recall that conversation?

I, I, I do recall. Um, um, I cant be real, real specific cause it was four, five years ago. Sure. But, uh, you know I, I, I dont think it was on the weekend. I think it was on a Friday. I, I, it seems to me it was probably during work day. Um, I dont think theyre gonna call her over the weekend as far as somethin like that but, but I cant remember for sure. But we were out there for, uh, four or five days at that time so, uh, you know it wasnt just Saturday and Sunday. But I, I remember I would go by periodically. Kim and I are friends and, and I would go by and just kinda visit with her over where she was assigned in, in the (unintel 4:21) area underneath the, uh, Bobby Allison stands. And I recall on one occasion well, one day cause it was multiple occasions that she, I mean during the course of that day, um, she was telling me about the fact that, uh, Hank had called her and told her that they wanted that she needed to get a bunch of these cases from El Mirage cleared out. And she kinda was pretty wound up about it. She didnt think that, uh, it was appropriate what they were asking her to do, which was to just get these case the older cases cleared out or inactive, exception or whatever, whatever could be done they needed to get cleared. Um, she vented a couple different times to me about it that you know she, she tried to talk to him about it. She didnt agree with necessarily just blanketly doin somethin like that. And if I recall, at one point I pretty much told her you know if youre havin an issue like that you probably need to address that with the Captain and find out, get some direction from him that you let him know you have concerns with whats being asked of you. And, uh, I might have told her to take

But I do recall telling her specifically that she should probably talk to Captain Whitney about it and let him know that youre uncomfortable with whats being asked of you to do. And, uh, that was pretty much the gist of it. You know I, I, I do know she was pretty wound up about it and didnt agree with it. LICKING: Um, and, and I dont wanna put any words in your mouth so correct me if Im wrong. But did you get a feel that she wanted to continue to work those cases and that she felt that those cases that were specifically for El Mirage were workable cases? Well, we didnt get into whether they were workable Okay. or what the status is cause we didnt talk about any specific cases. But she just didnt feel that it was appropriate to just step in and just start clearing based on how old the cases were. She believed that the cases needed to be worked until they were exhausted before they could be cleared out. And if that meant we still retain those cases when they come back from El Mirage and work them out of GID then that might be what needed to be done. And thats what I told her well, you need to discuss that with, with the Captain because you know I agree with her assessment. You cant just go in there and go well, its you know a year old case and these are the cases that involved specific victims, specific allegations and its, its not like you have no leads and no information. Maybe you have some where that the victim's not identified fully but you cant just make them inactive because theyre old and you wanna get rid of them. And, uh, that was the impression I got that she was being directed to do. Okay. Did, uh, after that conversation did, did you ever find out later from her,

Do you ever recall anything like that? LEWIS: Well, obviously, became aware as everyone else in the Sheriffs Office that SVU was being investigated, uh, for the way they were handling cases. It started with look at what was taking place with the El Mirage cases. I dont know all the details of that. And because it was an investigation, Kim and I never had any additional conversations about it other than I did tell her that I recalled our conversation at PIR and to be feel free to make sure that that comes up in your interviews with IA and Id be more than happy to, uh, to,... Alright. to come in and be a witness for her. Alright, okay. Um, and Im not sure if we really kinda covered this, uh, but did, did you get any idea that this was coming at least from your conversation with Kim that it was coming from anybody above Hank or if it was just this direction was comin specifically from Hank Brandimarte? All I know is that she was told that by Hank and that was why I suggested if you disagree with what Hanks telling you, you feel that strongly and I agree with you that thats not the appropriate thing to be doing either, you need to address those concerns with, with Captain Whitney. Okay, perfect. Um, and I know this is really the only real questions that I had for you, but is there anything else in regards to this that I didnt ask you that you think that I should know about? Not that I can think of.
