A RESOLUTION affirming the sovereignty of thePeople of the State of _________.A resolution affirming the sovereignty of thepeople of the State of Minnesota andmemorializing Congress to act to nullify laws inviolation of that sovereignty.WHEREAS, in the American system, sovereignty isdefined as final authority, and the People, notgovernment, are sovereign; andWHEREAS, in the American system, sovereignty isdefined as final authority, and the people, notgovernment, are sovereign; andWHEREAS, the people of the State of __________are not united with the People of the other forty-nine states that comprise the United States oAmerica on a principle of unlimited submission totheir federal government; andWHEREAS, the people of the State of Minnesotaare not united with the people of the other49 states that comprise the United States of America on a principle of unlimited submission totheir federal government; andWHEREAS, all power not delegated by the peopleto government is retained; andWHEREAS, all power not delegated by the peopleto government is retained; andWHEREAS, the People of the several Statescomprising the United States of America createdthe federal government to be their agent forcertain enumerated purposes only; andWHEREAS, the people of the several statescomprising the United States of America

“The powers not delegated to the United States by
the Constitution, nor prohibited by it to the States,are reserved to the States respectively, or to the
people;” and
 WHEREAS, the Tenth Amendment to theConstitution of the United States of Americareads as follows: "The powers not delegated to theUnited States by the Constitution, norprohibited by it to the States, are reserved to theStates respectively, or to the people"; andWHEREAS, the Tenth Amendment defines the totalscope of federal power as being that which hasbeen delegated by the people to the federalgovernment in the Constitution of the UnitedStates, and also that which is necessary and properto carry into execution those enumerated powers;with the rest being left to state governments orthe people themselves; andWHEREAS, powers, too numerous to list for thepurposes of this resolution, have been exercised,past and present, by federal administrations,under the leadership of both Democrats andRepublicans, which infringe on the sovereignty of the people of this state, and may further violatethe Constitution of the United States; andWHEREAS, powers too numerous to list for thepurposes of this resolution have beenexercised, past and present, by federaladministrations, under the leadership of bothDemocrats and Republicans, which infringe on thesovereignty of the people of this state and mayfurther violate the Constitution of the UnitedStates; andWHEREAS, when powers are assumed by thefederal government which have not beendelegated to it by the People, a nullification of theact is the rightful remedy; that without thisremedy, the People of this State would be underthe dominion, absolute and unlimited, of whoevermight exercise this right of judgment for them.WHEREAS, when powers are assumed by thefederal government, which have not been

NOW THEREFORE, BE IT RESOLVED BY THE _____OF THE _______ GENERAL ASSEMBLY OF THESTATE OF ______, WITH THE SENATECONCURRING, that we hereby affirm thesovereignty of the People of the State of _______under the Tenth Amendment to the Constitutionof the United States over all powers not otherwisedelegated to the federal government by theConstitution of the United States; and, be itfurtherRESOLVED, that this Resolution shall serve as aNotice and Demand to the federal government tocease and desist any and all activities outside thescope of their constitutionally-delegated powers;and, it be furtherRESOLVED, that a committee of conference beappointed by this legislature, which shall have asits charge to recommend and propose legislationwhich would have the effect of nullifying specificfederal laws and regulations which are outside thescope of the powers delegated by the People tothe federal government in the Constitution; and,be it furtherRESOLVED, that a committee of correspondencebe appointed, which shall have as its charge tocommunicate the preceding resolutions to theLegislatures of the several States; to assure themthat this State continues in the same esteem of their friendship as currently exists; that itconsiders union, for specified national purposes,and particularly those enumerated in theConstitution of the United States, to be friendly tothe peace, happiness and prosperity of all theStates; and, be it furtherRESOLVED, that a certified copy of this resolutionbe transmitted to the President of the UnitedStates, the President of the United States Senate,the Speaker and the Clerk of the United StatesHouse of Representatives, and to each member of 
this State’s Congressional delegation with the
request that this resolution be officially entered inthe Congressional Record as a memorial to theBE IT RESOLVED by the Legislature of the State of Minnesotathat it affirms the sovereignty of the people of theState of Minnesota under the Tenth Amendmentto the Constitution of the United States over allpowers not otherwise delegated to the federalgovernment by the Constitution of the UnitedStates.BE IT FURTHERRESOLVED that this resolution shall serve as anotice and demand to the federal government tocease and desist any and all activities outside thescope of its constitutionally delegated powers.BEIT FURTHERRESOLVED that the Legislature urges that a taskforce be appointed by Congress, which shall becharged with the task of nullifying specific federallaws and regulations which are outside the scopeof the powers delegated by the people to thefederal government in the Constitution.BE ITFURTHERRESOLVED that the Secretary of State of the Stateof Minnesota is directed to prepare copies of thismemorial and transmit them to the President of the United States, the President and the Secretaryof the United States Senate, the Speaker and theClerk of the United States House of Representatives , and Minnesota's Senators andRepresentatives in Congress.
