Section 3 of the Defense of Marriage Act (DOMA)defines the term “marriage” for all purposes underfederal law, including the provision of federal benefits,as “only a legal union between one man and one wom-an as husband and wife.” 1 U.S.C. 7. It similarlydefines the term “spouse” as “a person of the oppositesex who is a husband or a wife.”

The questionpresented is: Whether Section 3 of DOMA violates the Fifth Amendment’s guarantee of equal protection of thelaws as applied to persons of the same sex who arelegally married under the laws of their state.

Petitioner, who was a defendant in the districtcourt and an appellant in the court of appeals, is theUnited States of America.The private individual respondent, who was plain-tiff in the district court and an appellee in the court of appeals, is Edith Schlain Windsor.Respondent Bipartisan Legal Advisory Group of the United States House of Representatives inter- vened in this case in defense of Section 3 of DOMA.
