:
Notice ishereby given that the FHWA has issueda Tier 1 Final Environmental ImpactStatement (FEIS) and Record of Decision(ROD) in connection with a proposedhighway project in the State of Oregon.The Newberg Dundee TransportationImprovement Project (Tier 1), Oregon99W, proposes an approximately 11mile long, four-lane expresswayextending from the eastern terminus,east of Newberg in the Rex Hill area toits western terminus where Oregon 99W intersects with Oregon 18 (McDougalCorner) west of Dundee near Dayton.The proposed expressway will beprimarily on new alignment. Decisionsin the Tier 1 ROD include, but are notlimited to, the following:1. Purpose and need for the project(see Chapter 1 of the FEIS).2. Reasonable alternatives that will becarried forward for further evaluation inthe Tier 2 proceedings (see FEIS Chapter2).3. Selection of the highway buildalternative and highway corridor for theproject. The selected alternative iscalled Modified 3J, which is acombination of Alternative 3J and other build alternatives.4. Alternatives that have beeneliminated from further considerationand study, including but not limited to,those identified in the Tier 1 FEIS as the

Detailed informationabout the alternatives considered in Tier1, and about the Federal decisions thateliminated alternatives other thanAlternative Modified 3J, is available inthe Tier 1 ROD and Tier 1 FEIS.Interested parties may consult theROD and FEIS for further informationon each of the decisions describedabove.The Tier 1 actions by the Federalagencies, and the laws under whichsuch actions were taken, are describedin the Tier 1 Final EnvironmentalImpact Statement (FEIS) approved on June 2, 2005, in the FHWA Record of Decision (ROD) issued on August 26,2005, and in other documents in theFHWA project records. The scope andpurpose of the Tier 1 FEIS are describedin sections Chapter 1 of the FEIS. SUMMARY

FRA is issuing this notice toadvise the public that it will jointlyprepare an environmental impactstatement (EIS) with the New York StateUrban Development Corporation d/b/aEmpire State Development Corporation(ESDC) to assess the proposed ExpandedMoynihan/Penn Station RedevelopmentProject (the project) in New York City.The project is a comprehensive public/private development initiative toadaptively reuse the historic James A.Farley Building and the Western Annex(collectively referred to as the FarleyComplex) as a new train station(Moynihan West) and relocatedMadison Square Garden, to reconstructcritical station and circulation elementsat the existing Pennsylvania Station(Penn Station) referred to herein asMoynihan East, and to implementtransit-oriented private development.FRA is issuing this notice to solicitpublic and agency input into thedevelopment of the scope of the EIS andto advise the public that outreachactivities conducted by ESDC and itsrepresentatives will be considered in thepreparation of the EIS. The EIS will beprepared in accordance the NationalEnvironmental Policy Act of 1969(NEPA, 42 U.S.C. 4321
et seq.
) and theapplicable regulations implementingNEPA as set forth in 40 CFR 1500

s Procedures for ConsideringEnvironmental Impacts found at 64 FR28545 (May 26, 1999), and the NewYork State Environmental QualityReview Act (SEQRA) and itsimplementing regulations found at 6New York Code of Rules andRegulations Part 617. The EIS will alsoaddress as necessary Section 106 of theNational Historic Preservation Act,Section 4(f) of the U.S. Department of Transportation Act of 1966 (49 U.S.C.303) (DOT Act) and other applicablefederal and state laws and regulations.The EIS will evaluate a

 and various build alternatives thatmodify elements of the PreferredAlternative. There are two optionsunder consideration for the PreferredAlternative. Under either of theseoptions, the development of the Projectwould occur at the Farley Complex(Block 755) owned by ESDC and bounded by Ninth Avenue to the west,Eighth Avenue to the east, West 31stStreet to the south and West 33rd Streetto the north; the Penn Station Block(Block 781) bounded by Eighth Avenueto the west, Seventh Avenue to the east,West 31st Street to the south and West33rd Street to the north; the RailroadService Building (Block 780, Lot 60)located mid-block on West 31st Streetacross the street from Penn Station; theeastern and western portions of the OnePenn Plaza Block (Block 783) bounded by Eighth and Seventh Avenues andWest 33rd to West 34th Streets; and theUnited States Postal Service (USPS)Morgan Facility and Annex located ontwo full blocks (Blocks 726 and 727) bounded by Tenth Avenue to the west,Ninth Avenue to the east and betweenWest 28th and West 30th Streets ESDCmay also acquire properties on one ormore blocks immediately adjacent to thePenn Station Block to facilitate theconstruction of a loading dock and othersupport facilities for Moynihan Station,and to otherwise further the goals of theproject.In addition, under one of the twooptions being considered, the City of New York would establish a new zoningsubdistrict (the Subdistrict Option).This Subdistrict Option would allowdevelopment rights from the PennStation Block to be transferred undercertain specified conditions to receivingsites located within the subdistrict andat prescribed maximum floor areas. It isanticipated that the boundaries of theproposed subdistrict would includeapproximately 20 city blockssurrounding the Penn Station Block,extending as far south as West 28thStreet, as far north as West 36th Street,as far east as within 200 feet west of Fifth Avenue, and as far west as 200 feetwest of Ninth Avenue.In a related zoning action to beexamined in the EIS, the City, inconnection with the Subdistrict Optiononly, has proposed to change theunderlying zoning classifications for anumber of lots or blocks within theproposed subdistrict frommanufacturing and commercial uses(M1

4. This zoning change, if adopted by the City, would allowresidential uses in certain areas wheresuch uses are not currently permitted byzoning.

I.
Description of Project 
. The proposedExpanded Moynihan Project/PennStation Redevelopment Project is acomprehensive initiative, conceived toaddress and fulfill the following specificneeds and purposes: to create a modern,iconic, and efficient majortransportation hub that improvescirculation and passenger andpedestrian capacity of the Penn Stationcomplex and expands railroad capacityand throughput; to create a financiallyviable and dynamic mixed-use rail- andtransit-oriented development; to restoreand preserve an important historicresource; and to provide a uniqueopportunity to build a modern andefficient Madison Square Garden arenaat a major transit hub.The development program at full build-out would include:redevelopment of the Farley Complexwith a new Moynihan West train stationand a new, relocated Madison SquareGarden arena; the construction of arebuilt rail station (the Moynihan Easttrain station) with improved circulationand train halls to replace the existingthe Penn Station; the construction of upto 5.4 million square feet in mixed-usedevelopment allowed by the zoning of the Penn Station Block (accommodatedthrough on-site development at thePenn Station block or, alternatively, inthe subdistrict option, through acombination of 1.1 million square feet atthe Penn Station Block and 4.3 millionsquare feet of development in theproposed subdistrict); the constructionof an up to approximately 2 millionsquare foot commercial building on theeastern portion of the One Penn PlazaBlock at the Penn East site; theconstruction of a 125,000 square footretail building on the western portion of the One Penn Plaza Block at the PennWest Site (and under the SubdistrictOption, a larger commercial and retail building at the Penn West Site using875,000 square feet of developmentrights from the Penn Station Block);renovation of the Railroad Service

 building for railroad service,administration or other uses; possibleexpansion of the Morgan Annex toaccommodate the transfer of USPSoperations from the Farley Complex (itis assumed that USPS retail services,however, would be located elsewhere inthe project area if they do not remain inthe Farley Complex); in one potentialconfiguration, the construction of aloading dock and other station-relatedsupport facilities on one or more blocksimmediately adjacent to the PennStation Block; and other newcommercial and residentialdevelopment within the proposedsubdistrict as a result of a related zoningaction by the City of New York and thetransfer of development rights from theFarley Complex.II.
Previous Environmental Reviews
.The development of plans for improvedNew York City passenger facilities has been underway since as early as 1991when the National Railroad PassengerCorporation (Amtrak) began planningfor a new intermodal transportationfacility. The potential availability of theFarley Complex led to additional effortsto devise plans that incorporatedpassenger rail facilities in the FarleyComplex. A series of environmentalreviews have accompanied the variousproposals for improvements to the PennStation facilities and site, includingmost recently draft and finalenvironmental impact statements thatwere issued by ESDC under SEQRA in January 31, 2005 and April 27, 2006respectively. While FRA and the USPSparticipated with ESDC in thepreparation of these SEQRA documents,they were not NEPA documents and didnot attempt to specifically satisfy NEPArequirements. The EIS that is the subjectof this notice of intent will completelyevaluate all of the environmentalimpacts of the currently proposedactions under NEPA and SEQRA andserve as an original EIS for the FRA butas a supplemental EIS for ESDC givenits prior efforts under the 2005/2006state SEQRA EIS process.III.
Problem Identification/Purposeand Need 
. The principal public purposeof the project is the improvement of transportation facilities above theexisting Penn Station tracks andplatforms. The Penn Station complex isAmerica
s busiest passengertransportation facility, handling over550,000 people daily, which is morethan Kennedy, LaGuardia and NewarkLiberty airports combined. Yet thepresent station
a three-level, largelysubterranean complex designed tohandle 200,000 passengers per day
isinadequate to meet the needs of today
spassengers. The station is alreadyoperating above its design capacity andis expected to experience a rapidlygrowing passenger load due to, amongother factors, the growth of the Midtown business district and the developmentexpected as a result of the HudsonYards Rezoning.By rebuilding Penn Station andexpanding it within the Farley Complex,the project aims to improve thefunctionality and capacity of stationfacilities, increase the reliability andsustainability of the station, and createan architecturally distinctive andwelcoming facility that is easilynavigable and understood both withinthe facility and at street level. Further,the project would resolve existingdeficiencies in Penn Station thatinclude pedestrian crowding,insufficient passenger waiting areas,confusing circulation, insufficient andoutmoded employee facilities, and poorstation identification and visibilitywithin the surrounding area. Bysignificantly increasing the amount of public space in the train station, thecombination of both the east and weststation elements creates an opportunityto establish wider concourses andimproved connections to a renovatedand expanded Penn Station, grandentrances from Eighth Avenue, and sky-lit train halls.Another primary goal of the proposedproject is the preservation of majorportions of the historic Farley Complex,including the exterior, notably theEighth Avenue entrance andmonumental stairs, and certain interiorspaces, such as the USPS retail lobbyand the New York Postmaster
s office.The adaptive reuse of the historic FarleyComplex would reflect the originalPennsylvania Station
s role as atransportation resource and civicgateway, while preserving and restoringa designated local landmark andNational Register property.The project includes major privatesector components as well. Based on anextensive ESDC Developer SelectionProcess, ESDC conditionally designateda joint venture of the Related Companiesand Vornado Realty Trust (the Venture)as project developers in July 2005. TheVenture has proposed a reviseddevelopment program that includesrelocating Madison Square Garden tothe Western Annex of the FarleyBuilding and rail- and transit-orienteddevelopment at Penn Station and nearbydevelopment sites. The relocation of Madison Square Garden to the FarleyComplex will enable Madison SquareGarden to retain its status as animportant civic facility that hostssporting events, political conventions,memorial services, and relatedactivities.The proposed project would includemixed-use high-rise developmentconstructed above and around the newMoynihan Station with up to 5.4 millionsquare feet of zoning floor area on thePenn Station block (or, in theSubdistrict Option, 1.1 million squarefeet of new retail development at thePenn Station block and 4.3 millionsquare feet of zoning floor of development in the surrounding area)and approximately 2.125 million squarefeet on an adjacent block (the Penn Eastand West development sites). Thisdevelopment takes advantage of itsunique location at a large transportationhub and is consistent with New YorkState and City public policy thatpromotes transit-oriented development.Additional transit-oriented developmentmay result from a rezoning that has beenproposed by the City of New York inconnection with the subdistrict optionand by the utilization of unuseddevelopment rights from the FarleyComplex at other sites within thesubdistrict.As a high-profile and large-scalepublic and private developmentinitiative, the proposed project isintended to be a leader in incorporatingsustainable development principles inits design and construction. While theplanning, design, and constructiontechniques are still being developed, itis anticipated that buildings located atthe Farley Complex, at Penn East andPenn West and on the Penn StationBlock will seek to achieve recognitionunder the Leadership in Energy andEnvironmental Design (LEED) standardsas established by the U.S. GreenBuilding Council and in conformancewith city, state, and federal agencyinitiatives to integrate sustainabledesign standards in public developmentprojects.The principal identified federalgovernment roles at this stage of projectdevelopment that trigger the applicationof NEPA (and related environmentaland historic preservation statutes andregulations) involve the availability of federal funds appropriated by Congressto the FRA and other Department of Transportation operatingadministrations for improvements toPenn Station incorporating the James A.Farley Building, and FRA
s statutoryoversight responsibilities with respect toAmtrak. FRA does not have a role in therelocation of Madison Square Garden tothe Western Annex or the developmentof the mixed-use high rise componentsof the project, both as proposed by theVenture. Other federal agencies,including but not limited to USPS, may
