THE CODE OF CRIMINAL PROCEDURE, 1973ACT NO. 2 OF 1974[25th January, 1974.]An Act to consolidate and amend the law relating to CriminalProcedure.BE it enacted by Parliament in the Twenty-fourth Year of theRepublic of India as follows:-CHAPPRELIMINARYCHAPTER IPRELIMINARY1.Short title extent and commencement.1. Short title extent and commencement. (1) This Act may becalled the Code of Criminal Procedure, 1973.(2) It extends to the whole of India except the State of Jammu andKashmir:Provided that the provisions of this Code, other than thoserelating to Chapters VIII, X and XI thereof, shall not apply-(a) to the State of Nagaland,(b) to the tribal areas,but the concerned State Government may, by notification, apply suchprovisions or any of them to the whole or part of the State ofNagaland or such tribal areas, as the case may be, with suchsupplemental, incidental or consequential modifications, as may bespecified in the notification.Explanation.-In this section, "tribal areas" means theterritories which immediately before the 21st day of January, 1972,were included in the tribal areas of Assam, as referred to inparagraph 20 of the Sixth Schedule to the Constitution, other thanthose within the local limits of the municipality of Shillong.(3) It shall come into force on the 1st day of April, 1974.2.Definitions.
 
 2. Definitions. In this Code, unless the context otherwiserequires,-(a) "bailable offence" means an offence which is shown asbailable in the First Schedule, or which is made bailable byany other law for the time being in force; and "non-bailableoffence" means any other offence;(b) "charge" includes any head of charge when the chargecontains more heads than one;(c) "cognizable offence" means an offence for which, and"cognizable case" means a case in which, a police officermay, in812accordance with the First Schedule or under any other law forthe time being in force, arrest without warrant;(d) "complaint" means any allegation made orally or inwriting to a Magistrate, with a view to his taking actionunder this Code, that some person, whether known or unknown,has committed an offence, but does not include a policereport.Explanation.-A report made by a police officer in a case whichdiscloses, after investigation, the commission of a non-cognizableoffence shall be deemed to be a complaint; and the police officer bywhom such report is made shall be deemed to be the complainant;(e) "High Court" means,-(i) in relation to any State, the High Court for thatState ;(ii)in relation to a Union territory to which the juris-diction of the High Court for a State has been extendedby law, that High Court;(iii)in relation to any other Union territory, thehighest Court of criminal appeal for that territoryother than the Supreme Court of India;(f) "India" means the territories to which this Code extends;(g) "inquiry" means every inquiry, other than a trial,conducted under this Code by a Magistrate or Court;(h) "investigation" includes all the proceedings under thisCode for the collection of evidence conducted by a policeofficer or by any person (other than a Magistrate) who isauthorised by a Magistrate in this behalf;(i) "judicial proceeding" includes any proceeding in thecourse of which evidence is or may be legally taken on oath ;(j) "local jurisdiction", in relation to a Court orMagistrate, means the local area within which the Court orMagistrate may exercise all or any of its or his powers under
 
this Code 1*[and such local area may comprise the whole of theState, or any part of the State, as the State Government may,by notification, specify];----------------------------------------------------------------------1* Ins. by Act 45 of 1978, s. 2 (w.e,f, 18-12-1978).----------------------------------------------------------------------813(k) "metropolitan area" means the area declared, or deemedto be declared, under section 8, to be a metropolitan area ;(l) "non-cognizable offence" means an offence for which,and "non- cognizable case" means a case in which, a policeofficer has no authority to arrest without warrant;(m) "notification" means a notification published in theOfficial Gazette ;(n) "offence" means any act or omission made punishable byany law for the time being in force and includes any act inrespect of which a complaint may be made under section 20 ofthe Cattle-trespass Act, 1871 ( 1 of 1871);(o) "officer in charge of a police station" includes, whenthe officer in charge of the police station is absent fromthe station house or unable from illness or other cause toperform his duties, the police officer present at thestation-house who is next in rank to such officer and isabove the rank of constable or, when the State Government sodirects, any other police officer so present ;(p) "place" includes a house, building, tent, vehicle andvessel;(q) "pleader", when used with reference to any proceedingin any Court, means a person authorised by or under any lawfor the time being in force, to practise in such Court, andincludes any other person appointed with the permission ofthe Court to act in such proceeding ;(r) "police report" means a report forwarded by a policeofficer to Magistrate under sub-section (2) of section 173;(s) "police station" means any post or place declaredgenerally or specially by the State Government, to be apolice station, and includes any local area specified by theState Government in this behalf ;(t) "prescribed" means prescribed by rules made under thisCode;(u) "Public Prosecutor" means any person appointed undersection 24, and includes any person acting under thedirections of a Public Prosecutor ;(v) "sub-division" means a sub-division of a district;
