Army Command Policy
This rapid action revision, dated 18 March 2008--

o Provides policy guidance for documenting administrative separation packets to positively identify separating Soldier as having been, or not having been, a victim of sexual assault (para 8-5o(26)).

o Provides policy guidance for Special or General Court-Martial Convening
Authority to review all administrative separation actions involving victims
of sexual assault (para 8-5o(27)).
o Introduces a new appendix for collecting and preserving evidence under
restricted reporting; specifically evidence collected using a sexual assault
forensic exam (app J).
o Establishes a new appendix for preparing the annual Sexual Assault Prevention
and Response Program Assessment (app K).

History. This publication is a rapid action

revision. The portions affected by this rapid action revision are listed in the summary of change.

Summary. This regulation prescribes the

policy and responsibility of command, which include the Well-being of the force, military and personal discipline and con- duct, the Army Equal Opportunity Pro- gram, prevention of sexual harassment, and the Army Sexual Assault Prevention and Response Program. It implements De- partment of Defense Directives 1300.17, 1325.6, 1342.17 1344.10, 1350.2, 1354.1, 1400.33, and 6495.01 and DOD Instruc- tions 1342.19 and 5120.4.

Applicability. This regulation applies to

the Active Army, the Army National Guard/Army National Guard of the United States, and the U.S. Army Reserve, unless otherwise stated. During mobilization, the

proponent may modify chapters and poli- cies contained in this regulation. Chapters 6 and 7 and Appendixes E and F apply to Army National Guard Soldiers when on active duty Title 10, for 30 days or more, and in all other cases, Army National Guard Soldiers are governed by NGR 600\u201321 and NGR 600\u201322. Portions of this regulation that proscribe specific conduct are punitive and violations of these provi- sions may subject offenders to nonjudicial or judicial action under the Uniform Code of Military Justice. The equal opportunity terms found in the glossary are applicable only to uniformed personnel. AR 690\u2013600 contains similar terms that are applicable to DA civilians.

Proponent and exception authority.

The proponent of this regulation is the Deputy Chief of Staff, G\u20131. The propo- nent has the authority to approve excep- tions to this regulation that are consistent with controlling law and regulations. The proponent may delegate this approval au- thority, in writing, to a division chief within the proponent agency or its direct reporting unit or field operating agency, in the grade of colonel or the civilian equiv- alent. Activities may request a waiver to this regulation by providing justification that includes a full analysis of the ex- pected benefits and must include formal review by the activity\u2019s senior legal offi- cer. All waiver requests will be endorsed by the commander or senior leader of the requesting activity and forwarded through their higher headquarters to the policy

proponent. Refer to AR 25-30 for specific
guidance.
Army management control process.
This regulation does not contain manage-
ment control provisions.
Supplementation. Supplementation of

this regulation and establishment of com- mand and local forms are prohibited with- out prior approval from the Deputy chief of Staff, G\u20131 (ATTN: DAPE\u2013HR\u2013L), 300 Army Pentagon, Washington, DC 20310\u20130300.

Suggested improvements. Users are
