A regular meeting of The Board of Chosen Freeholders of the County of Morris, State of New Jersey, was held on February 13, 2013, in the FreeholderPublic Meeting Room, Administration & Records Building, Morristown, New Jersey. The meeting began at 7:30 p.m.Clerk of the Board Diane M. Ketchumannounced that adequate notice othis regular meeting held the 13th day of February, 2013 has been providedthrough resolution adopted by this Board at its Regular Meeting held at theAdministration and Records Building on January 4, 2013, to the Star Ledger,the Daily Record, and the Record through posting on the County website and byfiling a copy of same with the Morris County Clerk and the Clerk of thisBoard.
ROLL CALL
PRESENT: Freeholders Douglas Cabana, John Cesaro, Ann Grossi, John Krickus, Hank Lyon, David Scapicchio, and Director Thomas Mastrangelo (7)ALSO PRESENT: Administrator John Bonanni, Assistant CountyAdministrator Mary Jo Buchanan, County Counsel DanOMullan, Assistant County Counsel Randy Bush, andClerk of the Board Diane M. Ketchum

County Counsel Dan OMullan opened the meeting with a prayer and asalute to the flag.

Amendment to the Morris County Solid Waste Management Plan dated January 2013For the Inclusion of a Contract for Operating Two Morris County Solid Waste Transfer StationsLocated in the Township of Parsippany-Troy Hills and Mount OliveIncluding Providing Transportations Via Transfer Trailers and Disposal of AllSolid Waste Received at the Transfer Stations

Freeholder Director Mastrangelo states: “The Board will conduct ahearing on the proposed Morris County Solid Waste management Plan Amendment(MCSWMPA) dated January 2013 for the inclusion of a contract for operatingtwo Morris County Solid Waste Transfer Stations located in the Townships of Parsippany-Troy Hills and Mount Olive including providing transportation viatransfer trailers and disposal of all solid waste received at the transferstations.All comments will be directed through the Chair and will be limited tofive (5) minutes to allow sufficient time for all parties to present theirtestimony, which time limit may be amended at the discretion of the chair. The Board later on at tonights meeting will open the meeting to the publicto listen to their general concerns. The hearing is limited to any commentson the amendment to the Morris County Solid Waste Management Plan. Thehearing is now open.Let all persons present their testimony and allow Daniel W. OMullan,Morris County Counsel, to present his documents.Director Mastrangelo asks: “Will the Clerk read the resolution?” The Clerk read the following Resolution A:WHEREAS, on February 13, 2013, the Board of Chosen Freeholders of County of Morris conducted a hearing concerning the adoption of an amendmentto the Morris County Solid Waste Management Plan dated January 2013 for theinclusion of a contract for operating two Morris County Solid Waste TransferStations located in the Townships of Parsippany-Troy Hills and Mount Oliveincluding providing transportation via transfer trailers and disposal of allsolid waste received at the transfer stations; andWHEREAS, oral presentations, objections, comments, and testimony wereheard, and written exhibits were received at the hearing; and

 WHEREAS, the oral testimony and the written comments have been dulyconsidered by this Board,NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Morris as follows:1. The amendment to the Morris County Solid Waste Management Plan dated January 2013 for the inclusion of a contract for operating two MorrisCounty Solid Waste Transfer Stations located in the Townships of Parsippany-Troy Hills and Mount Olive including providing transportationvia transfer trailers and disposal of all solid waste received at thetransfer stations shall be made a part of the Morris County Solid WasteManagement Plan, a copy of which plan is on file in the office of theClerk of the Board of Chosen Freeholders of the County of Morris, andmade a part hereof by reference, be and is hereby adopted.2. The Morris County Counsel is directed to submit a certified copy of thisresolution via certified mail to anyone who objected in writing to theplan amendment.3. The Morris County Counsel shall submit to the Commissioner of theDepartment of Environmental Protection the following:a) A certified copy of this resolution;b) A copy of the plan amendment dated January 2013; andc) A record of the dates and results of all consultations withgovernmental agencies.4. This resolution shall take effect immediately. There was no public comment and the public hearing was closed.Freeholder Krickus made a motion that Resolution A be adopted.Freeholder Lyon seconded the motion.Director Mastrangelo asks: “Will the Clerk take the roll?” YES: Freeholders Cabana, Cesaro, Grossi, Krickus, Lyon, Scapicchio,and Director Mastrangelo (7)--

All meeting minutes fromthe January 4 Stated Annual Meeting, January 9 and 23, 2013 Regular Meeting Minutes; January 9 and January23, 2013 Work Session Open portion.On motion by Freeholder Scapicchio and seconded by FreeholderCesaro, the regular Freeholder meeting minutes and the work sessionmeeting minutes were approved.--
COMMUNICATIONS
1. The West Morris MendhamHigh School is asking permission to hang abanner across County Route 510 in MendhamTownship fromApril 26 to May3 to advertise the schools Project Graduation Tricky Tray fundraiserbenefitting graduating seniors in a substance free night of fun.2. The Township of Mendhamis asking permission on behalf of the Mendham Township Recreation Commission to hang a banner across County Route 510fromJune 10 through June 24.3. The ChathamBorough Police Department is asking permission to closeportions of Fairmount Avenue, (CR-638) and portions of North PassaicAvenue (CR 607) during the Annual Firemens Parade on July 4, 2013.Request fromRoad Inspection Supervisor for the following roadopening permit:4. 13-02 Mark Built Properties, LLC to open James Street in Morris Township for new entrance to development.

On motion by Freeholder Grossi and seconded by Freeholder Cesaro, therequests were approved.--
ORDINANCESFIRST READING/INTRODUCTION
(1)Director Mastrangelo stated: “We will now consider the introduction bytitle an ordinance.Freeholder Grossi stated: “I would like to introduce by title anordinance entitled, GUARANTY ORDINANCE SECURING THE MORRIS COUNTYIMPROVEMENT AUTHORITYS COUNTY OF MORRIS GUARANTEED AUTHORITY POOLEDPROGRAMREFUNDING BONDS, SERIES 2013 IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $11,000,000.Freeholder Cabana stated: “I second the motion. The Clerk called and recorded the following vote: YES: Freeholders Cabana, Cesaro, Grossi, Krickus, Lyon, Scapicchio,and Director Mastrangelo (7)Freeholder Grossi moved that the Clerk be authorized to publish theOrdinance in summary formin the local newspaper together with the noticeof public hearing and consideration of final passage of this Ordinancewhich will take place at the Freeholder meeting to be held in theAdministration and Records Building, Fifth Floor, Court Street,Morristown, New Jersey, on February 27 at 7:30 p.m.Freeholder Cabana: “I second the motion,” which passed with seven YES votes.--
PUBLIC PORTION
Patrice Picard, Chief Executive Officer, Family Service of MorrisCounty, thanked the Board for the opportunity to sit in at the budget meetingthis evening. Ms. Picard said their organization provides the quality olife for all and that investment in these organizations is very important tothe residents of Morris County.Beth Jarett, resident of Rockway, asked for help concerning her unclewho is on Medicaid. They are getting bills fromthe hospital because he didnot apply in time. She asked the Freeholder Board if the processing of thesecases could be done more efficiently. Director Mastrangelo asked HumanServices Director Frank Pinto to assist Ms. Jarett with this matter.Blair Bravo, Councilwoman of the Borough of Mountain Lakes andExecutive Director of Morris Habitat for Humanities, said she works withorganizations to build a pipeline to help make Morris County affordable toeveryone. Ted Hussa, former Mayor of Denville, said he is an open space advocate.He feels the County should drop the open space tax to 1/10 or 1/20 of what itis currently.Bob Parker, resident of Morristown, said he is an advocate of openspace. He feels it is a very important part of our economy, and wants tokeep as much open space as we can.--Freeholder Cabana presented the following resolutions:(1)WHEREAS, the Board of Chosen Freeholders of the County of Morris, byresolution No. 38 adopted April 25, 2012, awarded a contract to SelectRehabilitation of Northfield, IL to provide Professional Physical,
