I absolutely HATE demand letters that threaten to sue over website posts which are NOT illegal. That's red flag #1. Red flag #2 is when the lawyer sending the demand letter includes a bunch of a/k/a names for your client which are NOT his legal name. This sends a message that the lawyer is an unprofessional idiot rather than a person who should be taken seriously. Red flag #3 is when the lawyer talks about copyright law without mentioning the DMCA. I could argue that red flag #4 involves the CDA, but people like this have never heard of the CDA, so that's kind of a useless exercise.
