PENDAHULUAN

Catatan Penjelasan Tambahan (SEN) dari Nomenklatur Tarif ASEAN yang Diharmonisasi(AHTN) adalah bagian dari Protokol yang mengatur penerapan AHTN (Protokol AHTN,Agustus 2003, Manila). SEN dikembangkan untuk membantu penggunanya dalammenentukan klasifikasi tarif dari barang dan komoditi pada AHTN dengan tepat, yaitusubpos ASEAN sebagaimana dijelaskan pada Protokol AHTN.2.
 
Mengingat AHTN dibuat berdasarkan pada HS dan merupakan suatu perluasan dari HS,klasifikasi barang dan komoditi pada AHTN harus berdasar pada Ketentuan Umum Untuk Menginterpretasi HS (KUMHS) dan Catatan Hukum HS serta ketentuan dari instumenhukum tersebut diatas. SEN harus pula dibaca berdampingan dengan Catatan Penjelasan(EN) dari HS. SEN berguna untuk memastikan keseragaman pemahaman dan interpretasidari ketentuan yang ada pada AHTN.3.
 
SEN 2002/1 telah diubah sejalan dengan amandemen HS 2002 (termasuk amandemen EN).SEN 2007/1 berisikan informasi spesifik produk perdagangan internasional yang pentingbagi ASEAN, sebagaimana disampaikan oleh negara anggotanya. SEN juga bertujuan untuk memfasilitasi pemahaman dan interpretasi ruang lingkup subpos ASEAN denganpertimbangan untuk menyeragamkan klasifikasi barang.4.
 
SEN 2007/1 harus digunakan berdampingan dengan HS dan EN. Apabila terdapat konflik berkaitan dengan teks pada HS, EN dan SEN, maka definisi yang terdapat pada HS dan ENyang akan berlaku.5.
 
Gambar, grafik dan diagram produk yang terdapat pada SEN disediakan semata-mata untuk tujuan ilustrasi.6.
 
Teks SEN 2007/1 dibuat dalam bahasa Inggris, sebagai Bahasa resmi ASEAN.

The Supplementary Explanatory Notes (SEN) of the ASEAN Harmonized Tariff Nomenclature (AHTN) form part of the Protocol governing the implementation of theAHTN (AHTN Protocol, August 2003, Manila). The SEN have been developed to assistusers in determining the proper tariff classification of goods and commodities in the AHTN,that is, the ASEAN subheadings as defined in the AHTN Protocol.2.
 
Since the AHTN is based on, and is an extension of, the HS, classification of goods andcommodities in the AHTN should follow the General Interpretative Rules (GIRs) and LegalNotes of the HS, as well as the provisions of the legal instruments mentioned above. TheSEN should also be read together with the Explanatory Notes (EN) to the HarmonizedCommodity Description and Coding System (HS). The SEN are useful in securing theuniform understanding and of interpretation of the provisions of the AHTN.3.
 
SEN 2002/1 has been amended in line with the amendments to the HS 2002 (including theamendments to the EN). SEN 2007/1 contains specific information on products of international trade of importance to ASEAN, as indicated by Member Countries. The SENalso serve to facilitate the understanding and interpretation of the scope of the ASEANsubheadings with the view to furthering the uniform classification of goods.4.
 
SEN 2007/1 should be used jointly with the HS and EN. In the case of any conflict betweenthe text of the HS and EN and the SEN, the definitions provided in the HS and EN shallprevail.5.
 
Pictures, graphs, and diagrams of products in the SEN have only been provided forillustrative purposes.6.
 
The text of SEN 2007/1 has been provided in English, the working language of ASEAN.
