STATEMENT OF PROBABLE CAUSE Your Complainant is a licensed peace officer in the State of Minnesota. Acting in that capacity, I have reviewed the police reports and state that the following facts are true and establish probable cause. On January 4, 2013, officers were dispatched to a business in the City of Hastings, Dakota County, Minnesota; on a report of a 911 disconnect call. On arrival, an officer spoke to the victim who said that someone cut the internet wires outside of his business. The victim stated that the wire was cut while he was on the phone to dispatch, and the phone line went dead. An officer looked in the area of the wires and observed a fresh set of footprints in the snow that went from the cut internet wires, to the Southwest corner of the building. The foot prints stopped at a telephone pole located at the Southwest corner of the building. At the telephone pole, the officer observed a cut black telephone wire. Officers had been called out to this same business on December 27, 2012, and January 3, 2013, for similar incidents. On December 27, 2012, the victim reported that the internet cable wire, a rain gutter heater wire, and two cables to the unused TV dish were cut. On January 3, 2013, the victim reported that the internet cable wire was cut, and the outside power switch to the furnace was shut off. Shortly after the police were called to the business on January 4, 2013, the cable company arrived at the business to fix the cut wire. While they were doing repair work, the repairmen observed a male in a nearby parking lot who was watching them. The officer approached the male and identified him as Raymond Norbert Bischoff, date of birth: 5/18/1947. The officer observed Bischoffs footprints in the snow, which matched the footprints found near the damaged wires. Bischoff showed the officer the bottom of his shoe, and the officer confirmed that it was the same pattern he observed by the damaged wires. Bischoff admitted that he walks behind the business that was damaged often, and admitted that he walked in that area earlier that day. Bischoff agreed to go with the officer to the police station to talk about the damage to property.

Bischoff was read his Miranda rights and agreed to speak to the officer. Bischoff admitted to cutting the wires, and admitted that he had cut the wires on a previous occasion as well. Bischoff stated that it was possible that he cut the wires a total of three times. Bischoff stated that he used a small blade to cut the wires. Bischoff stated that he is staying at a nearby hotel and is having trouble with pressure on his brain, which he contributes to the wires. The total cost of repairing the damage from all three incidents is in excess of $1,000.00.

FINDING OF PROBABLE CAUSE


From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendants arrest or other lawful steps be taken to obtain Defendants appearance in court, or Defendants detention, if already in custody, pending further proceedings. Defendant is therefore charged with the above-stated offense.
