The MA Department of Public Safety continues to stonewall with respect to Wonderland MA 01005's non-certified building inspector.

There does not exist one shred of evidence to suggest anything but the granting of illegal extensions by two state regulatory entities, the Building Official Certifications Committee and the Board of Building Regulations and Standards.

I am submitting arecords request
pursuant to the Commonwealth’s Public Records Law. I would like a copy ofthe following:1.
 
The Regulation and /or M.G.L which grants the BOCC
discretionary authority to provideadditional certification extensions
beyond the prescribed three as outlined in CMRR7.1.7.4.1 ;2.
 
The alleged codified amendment to R7 which took effect
February 6, 2011
thussuperceding the Jan. 1, 2008 cut-off according to BOCC members as referenced in theCommittee’s minutes dated September 7, 2011 and March 7, 2012 as well as recorded attoday’s meeting;3.
 
The transcript (or audio copy) of Mr. Ricker’s adjudicatory hearing on
March 7,
2011
asoutlined in 801 CMR Section 1.02;4.
 
The Barre Board of Selectmen’s correspondence to the BOCC as directed in the
March 7,
2011
minutes confirming the Board’s decision
to schedule training for Mr. Ricker, cut backon his duties, and provide time to study and to reimburse for training and exams
;5.
 
The BBRS’s minutes of its affirming decision upholding the BOCC’s vote with respect tothe
March 7,
2011
 
hearing;In closing, the BOCC should be reminded of
110.R7.1.7.4.3 Notice of Non-compliance
. Anyconditional appointee who has not attained passing scores in all examinations required forcertification as inspector of buildings/building commissioner and who exhausted extensiontime as afforded by 780 CMR 110.R7.1.7.4.1
shall be deemed to be in non-compliance with
 M.G.L. c.143, §3
and unauthorized to serve as aconditional appointee in the position for which they are not yet certified.Furthermore, the Town of Barre and Mr. Ricker have never publicly recognized him(self)as aconditional appointee on legal correspondences. Yet, in accordance with
M.G.L. c. 143, § 3
,
nomunicipality may offer employment to, retain for employment or permanently appoint any individualwho is not certified in accordance with 780 CMR 110.R7, except on a conditional basis
