Today\u2019s date is September 4th, 2008, time now is 1804 hours. My name is Detective Terry Jones, my Code Number is 6354, I\u2019m with the Louisville Metro Police Department. This interview is a Mr. Greg Smith, and it is in reference to File #08-197. Uh, the victim in that case number will be Max Gilpin. This interview is being conducted at 6602 T\u2026, uh, Totting\u2026, Tottenham Road.

Okay. At this time uh, would you elaborate on the details of August 20th, 2008, while attending a soccer game with your family at the PRP High School?

Yes, sir. Uh, my wife and I arrived uh, right about the, the time the game started for the soccer game. Which was uh, 5:30, maybe a couple of minutes in advance. Uhm, she went on into the game uh, but I stayed in the car. Uh, simply because we had our 3 year old daughter with us. And, she was asleep at the time. So, I parked at the end of the field, of the soccer field. And, just so happen uh, my daughter, who\u2019s the goalie for, for uh, Waggener. Uh, was at that end defending her goal. So, it was a perfect view for me to watch the game, and also stay in the vehicle. Uhm, the uh, water fountain area, which uh, Mr. Gilpin and some of the other players uh, came over to? Was in between uh, the goal uh, where my daughter was defending, and uh, the fence and my, and my car. I was approximately; I\u2019d say 20 to 30 feet from the water area. Uh, as far as being parked there. Uhm, \u2018cause I was right by, by the edge of the uh, parking lot. Uhm, uh, during the course of the game I saw numerous players come over and get water, and go back. And, I kinda took note of the piping system that the, that they had there for the water, water break. And, then I did witness uh, a black male come over and uh, with assist of a couple of other people. Uh, and be attended to uhm, like he had uh, suffered. You know, either ran too much, or suffered heat exhaustion or whatever. I know that they put his head uh, in one of the uh, little spickets that was uh, shooting water out? And, had the other spicket uh, that was had him bent over. And, the and the other spicket was, was landing on his back, and running down that way. He had no uh, shirt on, or pads or anything like that. Strictly his football pants and cleats. And, I did uh, he was

responsive and talked to them uh, uh, the coaches there. Uh, you know, several minutes uh, while he was there. But, he did stand up uh, ever so often and say his lungs were hurting him. Uh, and so I heard that numerous times. Uhm, I made a phone call and, and I went back into my cell phone. And, looked at, at that time it was 5:58. Because, I\u2019d made a phone call to a friend of mine, and I told him where I was? And, uh, \u2018cause he didn\u2019t live too far from there. And, uh, and told him what was going on, as far as, the first uh, athlete. Uhm, he actually ended up being able to walk away with the assistance of the other uh. And, and I thought at that time since he was walking uh, on, on his own strength? That he was \u2018ay okay, but I wasn\u2019t for sure. I knew he was s\u2026, wasn\u2019t gonna go back to practice for sure. But, but uhm, uh, I looked across the way, and saw uhm, a couple of kids carrying what turned out to be Mr. Gilpin. Uh, across the field uhm, and that\u2019s the first I witnessed of him. Uhm, and, and I didn\u2019t know that he was led, led down or anything. \u2018Cause, I guess something else had, had happened. And, I was focusing on something else. But, uh, I know uh, just a couple of minutes later; I saw them bring him over on the gator. Uh, and he was in the front uhm, seat leaned back, didn\u2019t have uh, any shirt on. And, no helmet on uh, strictly his football pants, and uh, and shoes. The coaches uh, were the only 2 people there at the time that he was brought over. Uhm and they hooked a hose up, and immediately started trying to give him water. Which he never, which I never saw him partake of. But, they immediately started uh, taking the hose and running it over his entire body. Uh, you know, from his neck down uh, trying to uh, I guess
