Cohn x

Shely Yeah.

Cohn And do you know a home phone number

there?

Shely
Cohn And what...do you have a cell phone?

Shely Uh, yeah.

Cohn What's that?

Shely
Cohn Alright. This statement is being tape-recorded.
Does this meet with your approval?

Shely Yes.

Cohn I am takin' a statement in reference to the

events on August the 20th, 2008, that occurred
during the PRP football practice. Please
describe the events of August the 20th, of
2008, from the beginning to the end of
practice.

Shely Alright. When practice started, we just, we

like, we did this little team where we just run,
like individuals...and then we went...and then
we went to our coaches, ran and got water, and
then we did a little drills with our linebacker
coach...did a little couple more drills...got, like
another water break like 15 minutes after we
got our first one...
Statement: Jacob Shely / Case #08197(c)
September 9, 2008

Cohn Um-hmm.

Shely And then like we would...we did uh, we did,

then we just came back and like the linemen,
like the whole defense came together, and we
just stood like the people wasn't in that sat on
the sidelines and they just walked through what
to do, like what kind of defense plays to run...

Cohn Um-hmm...

Shely ...and then after that we got like, pro'bly like

20, 15 more minutes after that we got another
water break, then we just uh, and then like,
when we'd gone back to do team like to
scrimmage each other, that's when somethin'
happened...I really don't know what
happened...then we just started runnin', and
then we ran from there to next practice, and
then, after we got done runnin', we didn't get
no water break when we was runnin', but then
after we got done runnin', he said uh, he said
break it down and go over there by the little
shade tree...and like a couple people ran over
there to get water, and he told them, he said,
don't get water right now. 'Cause he's tryin' to
talk...but he said, y'all can get water after I get
done talkin'. So they came back, they was
talkin' to him, and he talked to us, and then he
just said clear the field, and that we can leave
and then we went to go get water and we just
left.

Cohn Okay. And how were water breaks given up?

Are they given up as teams or as groups or
individuals...

Shely Uh, like, it depends like if we are like, you

Statement: Jacob Shely / Case #08197(c)
September 9, 2008

know, like linebacker coach, not

linebacker...like position coaches...

Cohn ...Right...

Shely ...then your position coach would give us a

water break like at, like every ten...ten minutes.
But then we get water breaks like as a team,
too. Like when we be doin'...right when we
first practice, alright, we stretch...and then we
go to like your defense over here, offense over
there, and they just run plays...and then like
five minutes of that, and then we get water.
And then we go to individual...individual to get
your water break, you know...

Cohn Um-hmm...

Shely ...as times goes, and then when we do teams,

Coach Stinson gives us water breaks, like as
we scrimmage each other, like after we run like
couple, you know, couple plays, a lot of
plays...then we get a water break as a team.

Cohn Okay. But y'all didn't, y'all didn't get to the

scrimmage point on this particular practice.
Right? Is that when...

Shely No. Like we was about to scrimmage and then

that's when it got, that's when we had to run.

Cohn Okay. Did uh, uh...why do you think uh, why

did he make y'all start runnin' instead of you all
go on to your scrimmage?

Shely I think 'cause like, there's like two people on

defense already in the huddle...and there's like
four people in offense already in the huddle,
Page 5 of 11
Statement: Jacob Shely / Case #08197(c)
September 9, 2008

and they were just walkin' everywhere. And

that, and that's why he made us run, I'm pretty
sure, unless it was somethin' else, but that's
what I think, 'cause everybody was walkin'...it
was like two people in the huddle, and he done
said like come on, y'all get in the huddle and
like said like twice or like three, a couple
times...and that's when he said everybody get
on lines, y'all wanna walk...

Cohn ...Um-hmm...

Shely ...then we just run around for the rest of the

practice.

Cohn So ba, it was basically because...

Shely ...No hustlin'.

Cohn ...no, they weren't hustlin' enough so he was a

little frustrated...

Shely ...Yeah...

Cohn ...and said, you know, if you're not gonna

hustle, then we're gonna run, basically.

Shely Yeah.

Cohn Basically? Okay. How many water breaks did

you take on the entire day of August 20th?

Shely Uh, at least four or five. Because like when

we, in our, uh, 'cause like sometimes we might
take more water breaks than the linemen, it just
depends on how, you know, when your coaches
like, like some coaches might give a water
break every ten minutes, then like a lineback
Page 6 of 11
Statement: Jacob Shely / Case #08197(c)
September 9, 2008

coach might give every five minutes,

so...'cause like we get water breaks like a
whole lot. When, when we went to the
linebacker, with Coach Houser, 'cause like we
do like, we go through the drill like real, real
quick and get water, come back, go through
another drill real quick, get water, come back,
and then so we five, at least we got at least five
water breaks the whole practice.

Cohn Okay. So every position's kinda different,

basically.

Shely Yeah, like, like...at least every position, they at

least give you three water breaks, but some
positions might get more 'cause it just depends
on how they do it.

Cohn Right. Okay. Now after the last water break,

what did the practice consist of? What did y'all
do after the last water break?

Shely that's when we ran.

Cohn Okay.

Shely 'Cause like we was about to go in teams and

that's when the last water break.

Cohn Okay. When you say "ran", what did, what did
y'all run?

Shely Uh, gassers.

Cohn Okay. And "gasser" is...

Shely Sideline to sideline, to sideline, stuff like from,

from here to there to there to there to there and
Page 7 of 11
Statement: Jacob Shely / Case #08197(c)

back, that's one.

Cohn Okay. How many gassers did...alright now,

before I go in to that, there's, when y'all are
lined up, there's two groups. Right?

Shely Yeah. Uh, uh...like skills people and like fat

boys...

Cohn Okay.

Shely That's how they do it.

Cohn And which group are you in?

Shely Uh, the skills people.

Cohn Okay. And how many sprints or gassers did

your group do?

Shely Uh, I don't know, I wasn't really countin'.

Cohn If you can give a guesstimation...that'd be...

Shely I'd say at least, it had to at least...10 or

12...around that, 'cause we ran for quite a bit.

Cohn Okay. How many uh, gassers did you do

before you took off your gear?

Shely Before we took off our gear? Uh, at least five

or six.

Cohn And how many after taking off your gear?

Shely Like five or six.

Cohn How long do you think...as far as time-period-

Statement: Jacob Shely / Case #08197(c)
September 9, 2008

wise, how, how long do you think you ran the

gassers?

Shely Time period?

Cohn Yeah, like how long of amount of time?

Shely I'd say at least uh, half an hour, we ran forever.

Cohn Okay. Seemed like a long time?

Shely Yeah. That's what it seemed like, a long time.

Cohn Yeah. But y'all don't wear watches so you

don't know exactly...

Shely Yeah.

Cohn Did you or any of your teammates ask for

water breaks or try to get water during the
runner, running of the gassers?

Shely No.

Cohn Did you hear anybody ask for water?

Shely Um-umm.

Cohn Were people talking amongst themselves, man,

I'm thirsty, wish we had a water
break...something like that...but nobody
specifically went to the coaches, anything like
that?

Shely Yeah, like some of them was like, I'm tired. I

wish I had a water break. But not say like,
Coach Simpson, can I have a water break.
Statement: Jacob Shely / Case #08197(c)
September 9, 2008

Cohn ...Um-hmm...

Shely But like you could hear 'em like, you know,
talkin' to other kids, like, I need some water,
stuff like that, but they never said it out loud.

Cohn Right. Nothin' was specifically brought to the

coaches that you heard. Right?

Shely Yeah.

Cohn Did you or any of your teammates become ill

during...or sick during the running of the
sprints?

Shely You mean like throwin' up?

Cohn Throwin' up, sick, fallin' out, you know,

anything?

Shely Uh, not me, but like the only person that fell
out was Max, and he fell out at the end of
it...like when we was done, but Callaway, this
one dude...he was uh, he didn't fall out, like,
but if you was runnin' real, real hard, Coach
Stinson was like, you can go sit down, you
done runnin'.

Cohn Um-hmm.

Shely And when Callaway was runnin' hard, and he

told him to, you know, come out, and then
when he came out, that's when he, 'cause he
was havin' trouble breathin' so they went over
and helped him.

Cohn Okay.
Statement: Jacob Shely / Case #08197(c)
September 9, 2008

Shely But he didn't have to keep on runnin' 'cause he

was done, he was pullin' 'im out and then that's
when "Callaway sounded like he had trouble
breathin'. But he never run no more after that,
though.

Cohn Okay. Do you know when that was, the

beginning, middle, or end?

Shely Like close to the end.

Cohn Did you see anybody else throw up or...

Shely ...No...

Cohn ...get sick at all? Nobody else, other than him

and Max?

Shely Yeah.

Cohn During any of the practices this year, have you

personally seen or heard of any teammates
being injured or quitting the team?

Shely What was it again?

Cohn During any practices this year, have you

personally seen or heard of any of your
teammates being injured or quittin' the team
during the practices?

Shely No.

Cohn Has anyone influenced you in any way to

withhold information or to change any of the
facts that actually occurred during the practice?

Shely No.

Cohn Any coaches or teachers or principals, or

anybody tell you to say anything at all?

Shely No.

And is this true, this statement and everything

Cohn you told me today truthful?

Shely Yes, sir.

Cohn Is there anything else that you wanna add to

this? Is there anything that you think we
should know or anything that you would like to
add that we haven't, that we haven't covered?

Shely No, no, sir.

Cohn Alright. This concludes our interview. The

time is now 12:34.
