In compliance with thePaperwork Reduction Act (44 U.S.C.3501

), this document announcesthat EPA is planning to submit acontinuing Information CollectionRequest (ICR) to the Office of Management and Budget (OMB). This isa request to renew an existing approvedcollection. This ICR is scheduled toexpire on January 31, 2004. Beforesubmitting the ICR to OMB for reviewand approval, EPA is solicitingcomments on specific aspects of theproposed information collection asdescribed below.

Title:
Emission Defect InformationReports and Voluntary Emission RecallReports.
Abstract:
Per sections 207(c)(1) and213 of the Clean Air Act (CAA), whenemission testing shows that asubstantial number of properlymaintained and used engines produced by a manufacturer do not conform toemission standards, the manufacturer isrequired to recall the engines.Manufacturers are also required tosubmit Defect Information Reports(DIRs) to alert EPA of the existence of emission-related defects on certainclasses of engines that may cause theengines
’
emissions to exceed thestandards and ultimately may lead to arecall. EPA uses these reports to targetpotentially nonconforming classes of engines for future testing, to monitorcompliance with applicable regulationsand to order a recall, if necessary.Manufacturers can also initiate a recallvoluntarily by submitting a VoluntaryEmission Recall Report (VERR). VERRsand VERR updates allow EPA todetermine whether the manufacturerconducting the recall is acting inaccordance with the CAA and toexamine and monitor the effectivenessof the recall campaign.The information is collected by theEngine Programs Group, Certificationand Compliance Division, Office of Transportation and Air Quality, Officeof Air and Radiation. Confidentiality of proprietary information submitted bymanufacturers is granted in accordancewith the Freedom of Information Act,EPA regulations at 40 CFR part 2, andclass determinations issued by EPA

sOffice of General Counsel. An agencymay not conduct or sponsor, and aperson is not required to respond to, acollection of information unless itdisplays a currently valid OMB controlnumber. The OMB control numbers forEPA

s regulations in 40 CFR are listedin 40 CFR part 9.The EPA would like to solicitcomments to:(i) Evaluate whether the proposedcollection of information is necessaryfor the proper performance of thefunctions of the Agency, includingwhether the information will havepractical utility;(ii) Evaluate the accuracy of theAgency

s estimate of the burden of theproposed collection of information,including the validity of themethodology and assumptions used;(iii) Enhance the quality, utility, andclarity of the information to becollected; and(iv) Minimize the burden of thecollection of information on those whoare to respond, including through theuse of appropriate automated electronic,mechanical, or other technologicalcollection techniques or other forms of information technology,
e.g.
, permittingelectronic submission of responses.
Burden Statement:
The annual publicreporting and recordkeeping burden forthis collection of information isestimated to average 21 hours perresponse. DIRs and VERRs aresubmitted on occasion, whereas VERRsupdates are submitted quarterly byapproximately 15 respondents. EPAestimates that the total cost torespondents resulting from thiscollection is approximately $353,749.This estimate includes operation andmaintenance expenses of approximately$443.
