THE WHITE HOUSEOffice of the Press SecretaryFor Immediate Release March 9, 2009EXECUTIVE ORDER- - - - - - -REMOVING BARRIERS TO RESPONSIBLE SCIENTIFICRESEARCH INVOLVING HUMAN STEM CELLSBy the authority vested in me as President by theConstitution and the laws of the United States of America,it is hereby ordered as follows:Section 1. Policy. Research involving human embryonicstem cells and human non-embryonic stem cells has the potentialto lead to better understanding and treatment of many disablingdiseases and conditions. Advances over the past decade in thispromising scientific field have been encouraging, leading tobroad agreement in the scientific community that the researchshould be supported by Federal funds.For the past 8 years, the authority of the Department ofHealth and Human Services, including the National Institutesof Health (NIH), to fund and conduct human embryonic stem cellresearch has been limited by Presidential actions. The purposeof this order is to remove these limitations on scientificinquiry, to expand NIH support for the exploration of humanstem cell research, and in so doing to enhance the contributionof America's scientists to important new discoveries and newtherapies for the benefit of humankind.Sec. 2. Research. The Secretary of Health and HumanServices (Secretary), through the Director of NIH, may supportand conduct responsible, scientifically worthy human stem cellresearch, including human embryonic stem cell research, to theextent permitted by law.Sec. 3. Guidance. Within 120 days from the date of thisorder, the Secretary, through the Director of NIH, shall reviewexisting NIH guidance and other widely recognized guidelines onhuman stem cell research, including provisions establishingappropriate safeguards, and issue new NIH guidance on suchresearch that is consistent with this order. The Secretary,through NIH, shall review and update such guidance periodically,as appropriate.Sec. 4. General Provisions. (a) This order shall beimplemented consistent with applicable law and subject to theavailability of appropriations.(b) Nothing in this order shall be construed to impair orotherwise affect:(i) authority granted by law to an executivedepartment, agency, or the head thereof; ormore(OVER)
