Puerto Rico is operating under a timeline waiver of certain assessment requirementsunder the Improving America’s Schools Act (IASA) that affects Puerto Rico’saccountability plan. Consistent with that waiver, Puerto Rico may implement itsaccountability plan as follows:
Puerto Rico administered new reading and mathematics assessments effectivewith the 2002-03 school year. Because Puerto Rico’s timeline waiver permittedPuerto Rico to administer these new assessments for the first time in 2002-03,Puerto Rico may concomitantly set its starting points, annual measurableobjectives and intermediate goals on the basis of data from those assessments anduse those starting points to make decisions about AYP for the 2003-04 schoolyear. Please provide Puerto Rico’s starting points, determination of AYP, annualmeasurable objectives, and intermediate goals, based on the new assessments, onor before September 30, 2003.Provided Puerto Rico meets the conditions above, subject to the Department’s review andconsideration, we will fully approve Puerto Rico’s accountability plan. Puerto Rico proposed to include students with the most significant cognitivedisabilities in its accountability system based on their performance on an alternateassessment that would hold those students to different achievement standardsfrom those all other students are expected to meet. All students with disabilitiesmust be included in a State’s accountability system. Moreover, §200.1 of the finalTitle I regulations requires that all students be held to the same grade levelachievement standards. In addition, §200.6(a)(2)(ii) of those regulations statesthat “[a]lternate assessments must yield results for the grade in which the studentis enrolled.”We have issued new proposed regulations that would permit a State to usealternate achievement standards to measure the achievement of students with themost significant cognitive disabilities (refer to the Federal Register notice of March 20, 2003).
