 Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘GI Bill Tuition Fair-

ness Act of 2013’’.

BY PUBLIC INSTITUTIONS OF HIGHER EDU-

CATION FOR PURPOSES OF EDUCATIONAL

 ASSISTANCE PROGRAMS ADMINISTERED BY

SECRETARY OF VETERANS AFFAIRS CONDI-
5
TIONAL ON IN-STATE TUITION RATE FOR

 VETERANS.

(a) I
N
G
ENERAL
.—Section 3679 of title 38, United
8
States Code, is amended by adding at the end the fol-
9
lowing new subsection:
10
‘‘(c) Notwithstanding any other provision of this sub-
11
title, the Secretary or the Secretary’s designee shall dis-
12
approve a course of education provided by a public institu-
13
tion of higher education unless the institution charges tui-
14
tion and fees for a veteran at the same rate as the institu-
15
tion charges for residents of the State in which the institu-
16
tion is located, regardless of the veteran’s State of resi-
17
dence. The Secretary shall notify the State approving 
18
agency of the Secretary’s disapproval of a course of edu-
19
cation under this subsection.’’.

.—In the case of a veteran or

eligible person who is enrolled before August 1,
24
2014, in a course of education provided by a public
25
institution of higher education that was approved

 under chapter 36 of title 38, United States Code, at
1
the time of the initial enrollment of the veteran or
2
eligible person but that is disapproved by the Sec-
3
retary of Veterans Affairs or the Secretary’s des-
4
ignee by reason of subsection (c) of section 3679 of 
5
such title, the Secretary shall treat such institution
6
as an institution that is approved under such chap-
7
ter for purposes of the laws administered by the Sec-
8
retary with respect to the veteran or eligible person
9
 until the veteran or eligible person completes the
10
course of education in which the veteran or eligible
11
person is enrolled.

(2) T
ERMINATION
.—

(A) L
IMITATION
.—Except as provided in
14
subparagraph (B), the Secretary of Veterans
15
 Affairs may not treat such an institution as an
16
approved institution under paragraph (1) after
17
 August 1, 2018.

(B) W 
 AIVER
.—The Secretary may waive
19
the limitation under subparagraph (A) if the
20
Secretary determines such a waiver is appro-
21
priate.
