QUESTIONS PRESENTED
This case presents the question whether Title VIIand the Equal Protection Clause allow a governmentemployer to reject the results of a civil-service selec-tion process because it does not like the racial distri-bution of the results. Specifically:1. When a content-valid civil-service ex-amination and race-neutral selectionprocess yield unintended, racially dis-proportionate results, do a municipalityand its officials racially discriminate inviolation of the Equal Protection Clauseor Title VII when they reject the resultsand the successful candidates to achieveracial proportionality in candidates se-lected?2. Does an employer violate 42 U.S.C.§ 2000e-2(
l
), which makes it unlawful foremployers “to adjust the scores of, usedifferent cutoff scores for, or otherwisealter the results of, employment relatedtests on the basis of race,” when it re- jects the results of such tests because of the race of the successful candidates?
