PETITION FOR CANCELLATION

BBK Tobacco & Foods, LLP, an Arizona limited liability partnership, having aprincipal place of business in Phoenix, Arizona (“Petitioner”), believes and alleges that itis or will be damaged by U.S. Registration No. 3,510,830 and hereby petitions to cancelthe same.As grounds for cancellation, Petitioner alleges:1. Upon information and belief, Respondent Swedish Match Industries AB(“Respondent”) is the owner of U.S. Registration No. 3,510,830 for matches(“Respondent’s Goods”) in International Class 34.2. On November 10, 2008, Petitioner filed U.S. Trademark Application(Serial No. 77/611,451) for the mark “SWAN” for the following goods and services:cigarette filters, cigarette paper, cigarette papers, cigarette rolling machines, cigaretterolling papers, cigarette tubes, cigarette-rolling machines, machines allowing smokers tomake cigarettes by themselves, pocket apparatus for rolling cigarettes, pocket apparatusfor self-rolling cigarettes, pocket devices for self-rolling of cigarettes, pocket machinesfor rolling cigarettes and pocket-size cigarette rolling machines.3. Upon information and belief, Respondent is no longer using the mark “‘THE ORIGINAL’ SWAN VESTAS MADE TO THE HIGHEST QUALITY SINCE1883” as shown in U.S. Registration No. 3,510,830 and therefore has

abandoned

themark within the meaning of Section 14 of the Lanham Act, 15 U.S.C. §1064(3).4. As a consequence, Respondent’s Registration No. 3,510,830 is toPetitioner’s damage.
