AFFIDAVIT IN SUPPORT OF CRIMINAL COMPLAINT fiND WARRANT FOR

I, Derrick F. Darwood, being duly sworn state the following:1. I am an Enforcement Officer fo'r Customs and Border Protection (hereinafter, "CBP")and have served in this position with CBP for almost two years. Prior to working as anEnforcement Officer, I worked as an Officer with CBP and a Customs Inspector with theformer U.S. Customs Service for about four years. I am currently assigned to BaltimoreWashington International Thurgood Marshall Airport. My current duties as an EnforcementOfficer involve the investigation of immigration criminal offenses related to Title 8 and Title18 of the United States Code occurring at the port of entry. This includes making arrestssubsequent to those violations, and presenting criminal cases to the U.S. Attorney's Office forprosecution .. I have successfully completed the Customs Officer Basic Training Course at theFederal Law Enforcement Training Center (FLETC) in Glynco, Georgia. I have also receivedEnforcement Officer Training (EOT) at the Customs and Border Protection Advanced TrainingCenter in Harpers Ferry, West Virginia.2. This affidavitis in support of a criminal complaint against ARYEE, Mabel Penelope,who falsely and willfully represented herself to be a citizen of the United States, acts whichoccurred within the District of Maryland and in a matter within the jurisdiction of CBP inviolation of18 U.S.C. 9911.3. This affidavit is based on the review of records, documents, other physical evidenceobtained during this investigation, as well as information provided to me by CBP Officers.This affidavit contains information necessary to support probable cause for obtaining acriminal complaint and arrest warrant. It is not intended to include each and every fact andmatter observed by me or known to the government.

FACTUAL BASIS FOR PROBABLE CAUSE4. Based on the affiant's review, the following facts among others not included for thepurpose ofthis affidavit, are known:a. On March 23,2009 at approximately 1745 hours, an individual claiming to be MelindaRochelle CHAPMAN with the birth date of October 26, 1964, arrived at BaltimoreWashington International Thurgood Marshall Airport via British Airway flight number 229 andpresented herself as a returning United States Citizen. She presented to CBP Officer Abadicoin Passport .Control Primary two United States passports, one being expired stapled to the otherwhich was valid, issued in the name of Melinda Rochelle CHAPMAN. The individual was aPassenger Analysis Unit (PAU) lookout and was referred to Baggage Control Secondary forfurther questioning in regards to her travel.b. Upon arrival to Baggage Control Secondary, CBPO Sawdoski and CBPO Hum beganinterviewing the individual claiming to be CHAPMAN. CBPO Sawdoski questioned herabout her trip. The individual stated that she was returning from visiting friends and family inAccra, Ghana, and that she was there for three months. While in secondary, a bindingdeclaration was obtained by CBP Officers stating that the individual was the rightful owner of all the luggage she was carrying and all the possessions located inside her luggage. Luggageexamination revealed a Maryland driver's license and a Fort Washington Hospital woridentification card, all in the name of Mabel Penelope ARYEE. When questioned about thedriver's license and the ~ork identification, the individual stated that they belonged to a friendwho left them in Ghana, and she was returning the identifications to her as a favor. CBPOfficers observed that the photographs on the identity documents appeared to be the individualin front of them. Based on the identification found and the claim as to why the individual hadthe identifications, CBP Officers retrieved a documented copy of the individual's United Statespassport application and began to ask the individual questions contained in the passportapplication. The individual was asked her mother's name and provided a different name thanthat on the passport application. When confronted with the fact that she was unable tocorrectly identify her mother's name, the individual responded that she forgot her mother'sname. Additional discrepancies were identified utilizing the passport application, and as aresult the determination was made to fingerprint the individual in an effort to establish trueidentity. The individual's fingerprints were taken and run through the Federal Bureau of Investigation (FBI) Integrated Automated Fingerprint Identification System (IAFIS) resultingin a match to Mabel Penelope ARYEE with the birth date of January 03,1949. ARYEE wasthen confronted with the results of the fingerprint identification and ultimately admitted tobeing Mabel Penelope ARYEE.c. ARYEE was given her Miranda Rights verbally and in writing. ARYEE choose towaive her Miranda Rights and in her statement, ARYEE stated that she obtained the UnitedStates passport by using her friend's (Melinda Rochelle CHAPMAN) birth certificate andsocial security number. ARYEE also stated that she was born in Ghana, is a citizen of Ghana,and has no claim to United States citizenship.
