O T T A W AApril 29, 2013The Honourable Rob Nicholson, P.C., M.P.Minister of JusticeHouse of CommonsOttawa, ON K1A 0A6Dear Minister:As you are certainly aware, the Supreme Court of Canada sent out a brief press release on Friday afternoon saying that it found nothing in its filesregarding communication between former judges and representatives of theCanadian and British governments in the months preceding the unilateralrepatriation of the Constitution.However, historian Frédéric Bastien recently published information,supported by documentation provided by the British Government, showingthat such communication took place. As for the documents provided to Mr.Bastien by the Government of Canada on this same subject, they wereredacted.The Supreme Court limited its review to the content of its own recordswithout seeking to obtain documents from other sources to ascertain whetherthere was indeed inappropriate communication between one or more of itsmembers and the Executive Branch of the Canadian and/or Britishgovernments.Conversations like those reported by Mr. Bastien raise important questionsregarding the separation of judicial and legislative powers.

 -2-The Quebec National Assembly, by way of a unanimous resolution supportedby all parties, both federalist and sovereignist, has asked that light be shedon this matter which could undermine
citizens’ confidence in our democratic
institutions.The Constitution of Canada was modified unilaterally in 1982 without
Quebec’s consent. This unilateral repatriati
on was based on a Supreme Court judgement.We believe it is important that the facts of this matter be known, in theinterest of our democratic institutions and to preserve public trust in theirintegrity.We hope to see the House of Commons unanimously adopt a motion callingfor the publication of all available documents relevant to this issue.We are asking you to indicate your interest in such a motion and whetheryou wish to participate in drafting a motion with us.Here is our proposal:
That this House call on the government to announce the measures it will undertake in response to the unanimous motion adopted by the Quebec National Assembly on April 16, 2013.

Les documents fournis à M. Bastien par leGouvernement du Canada sur ce même sujet étaient quant à eux caviardés.La Cour suprême s'est bornée à regarder le contenu de ses propres registreset n'a pas cherché à obtenir des documents d'autres sources pour savoir s'il yavait effectivement eu des communications inappropriées entre un ouplusieurs de ses membres et l'exécutif des gouvernements canadien et/oubritannique.Des conversations comme celles qui sont rapportées par M. Bastiensoulèvent des questions importantes sur la séparation des pouvoirs juridiques et législatifs.
