Paragraph (b) of subsection (2) of section6195.11, Florida Statutes, is amended, and paragraph (h) is added62to subsection (5) of that section, to read:6395.11 Limitations other than for the recovery of real64property.
Actions other than for recovery of real property shall65be commenced as follows:66(2) WITHIN FIVE YEARS.
67(b) A legal or equitable action on a contract, obligation,68or liability founded on a written instrument, except for an69action to enforce a claim against a payment bond, which shall be70governed by the applicable provisions of paragraph (5)(e), s.71255.05(10), s. 337.18(1), or s. 713.23(1)(e), and except for an72action for a deficiency judgment governed by paragraph (5)(h).73(5) WITHIN ONE YEAR.
74(h) An action to enforce a claim of a deficiency related75to a note secured by a mortgage against a residential property76that is a one-family to four-family dwelling unit. The77limitations period shall commence on the day after the78certificate is issued by the clerk of court or the day after the79mortgagee accepts a deed in lieu of foreclosure.80Section 2.
