The Depament of Homeland Security ("DHS") appeals fom the decision of the Im gation
Judge dated September 8, 20 I 0, terating proceeings. The appeal W be sustained, the
procedings WNreinsated, ad the rerd will be readed fr frher proceedings cnsisent
with this deision. The reuest fr recusa or reassigment of the matter to aother Immgation
Judge is deied.
We revie fdings of fc, including creibilty deteninations, unde the "clealy erroneus"
standard. See 8 C.F.R. 1003.l(d)(3)(i); see also Mater of J-L-,24 I&N De. 260 (IA2007);
Mater of S-H-, 23 I&N Dec. 462 (IA 2002). We reiew questions of law, discretion, or judgent,
ad Nother issues de novo. See 8 C.F.R. 1003.l(d)(3)(ii).
I addressing the DHS's appellate arguments, we note that the tascipt of proce gs does not
refet that pledings wee taen and the Im gaton Judge's deision does not contain fdings ad
a explaation how she arved at her cnclusion that the respondent is a Unite States citen, ad
therefre not subje to removal. Such fdings ae reuired fr us to detenne d we have jurisdicion

The respondent is before the Court, charged with being
an overstay. However, he appears, after testimony and evidence
presented, to be a citizen of the United States. The Government
has been given ample opportunity to overcome that proof and they
have been unable to do so. Therefore, based on the evidence
presented and the testimony of the respondent, I find that he is
a United States citizen and the Court has no jurisdiction over
the respondent. It is, therefore, the decision of the Court that
these proceedings be and are hereby terminated.
