For the period of April1, 2006 to March 31, 2012, 44 taxpayers have been convicted of tax evasi>n
related to money and ether a'ssets held offshore. This involved $7.7 million in federal tax evaded and
the court sentences totaled $6.8 million in fines and 337 months in jail .
.
Criminal charges fall un der section 239 of the Incarne Tax Act (ITA), section 327 of the Excise Tax Act
(ETA), and/or section 380 of the Criminal Code.
Part (b):
(i) The conviction details related to manies or assets located offshore are, in most of the cases noted,
not part of the public record and not detailed in the court records. The CRA cannat provide the
information in the manner requested, as tc do so would contravene the confidentiality provisions of the
ITA (i.e., Section 241) which prohibits the release of confidential taxpayer information. Furthermore, to
provide the information sought might lead ta inferences being drawn between those named and any
assets and money held offshore, which, by extension, would also contravene Section. 241 of the ITA.

}here is an important distinction in instances where information is part of the public record and detailed
1n the courts. ln such cases, the CRA does seek publicity on conviction in the case of tax evasion. lt
does this to maintain confidence in the integrity of the self-assessment system, and to increase
compliance with the law through the deterrent effect of such publicity.
As stated on the CRA Web site, the CRA " ... advises the media of cases of people, corporations, and
trusts convicted in the courts for tax evasion or for failing to file in come tax returns when required. The
information released to the media is available to the public since it is derived strictly from court records
and not from confidential information held by the CRA."
(ii} Ali offences are criminal offences under the ITA, the ETA, and/or the Crimina/ Code.

(v) lncome Tax Act (section 239):
While the CRA can't provide specifie information for each case for the reasons cited in Parts (b) iii) and
(b) iv), in general, the range of penalties for the relevant acts follows:
Summary Conviction:
a fine of not less th an 50% and not more th an 200% of the tax that was sought to be evaded, or
both the fine described above and imprisonment for a term not exceeding 2 ye.ars
lndictment:
a fine of not Jess th an 1 00% and not more than 200% of the a mount of tax th at was sought to be
evaded, and
imprisonment for a term not exceeding 5 years
Excise Tax Act (section 327):
Summary Conviction:
a fine of not less th an 50%, and not more than 200%, of the a mount of the tax or net tax th at was
sought to be evaded, or of the rebate or refund sought, or, where the arnount th at was sought to be
evaded cannot be ascertained, a fine of not less than $1,000 and not more than $25,000, or
both a fine referred to in paragraph above and imprisonment for a term not exceeding 2 years

Summary conviction under Section 787 and fiable to:
o a fine not exceeding $5000, or
o a term of imprisonment not exceeding 6 months, or
o bath a fine and a term of imprisonment
(vi) ln relation to the 44 convictions, the fines ranged from approximately $12,000 ta $1.1 million. The
jail sentences ranged from zero ta 48 months. Further details cannat be provided because revealing
case specifie information relating ta jail times could by extension identify the taxpayers involved and as
previously noted, contravene section 241 of the IT A. Details relating to mo ney and as sets offshore are
not part of the public record and the CRA cannat provide information that results in the extrapolation of
information which is not in the public record.
(vii) ln relation to the 44 convictions; seven were achieved via trial and 37 were achieved via guilty
pie as.
(viii) The amount of time between the commencement and finalization.of various compliance actions in
respect of tax offences varies from file to file, depends upon the complexity and availability of the
information involved, and can take years.
As the protection of taxpayer's information is of utmost importance, the confidentiality provisions of the
Acts administered by the CRA prevent the disclosure of specifie taxpayer information.
Part (c):
An offense is a criminal matter; the CRA does not prosecute civilly for an offence. As noted in Part (a),
cri minai charges fall under section 239 of the ITA, section 327 of the ETA, and/or section 380 of the
Cnininal Code.
However, fa il ure ta report income and ath er assets held offshore can trigger a reassessment of tax,
including interests and penalties. A taxpayer who disagrees with a reassessment can file an appeal
with the Tax Court of Canada which constitutes a civil process.
For the period of April 1, 2006 to March 31, 2012, 7, 761 Aggressive International Tax Planning civil
audit cases (i.e., via a civil process) have been completed.
Part (d):
While the CRA does not track offences "considered", it can provide the following information. For the
period of April 1, 2006 to March 31, 2012, of the cases where there were links to mo ney and ether
assets held offshore, there were 11 cases th at did not go to trial, as follows:

Part (e):
1t is important to clarify that when the CRA refers to prosecutions, this always refers to criminal
matters. Civil matters are not criminal prosecutions. Therefore, the CRA cannet provide information in
the manner requested. An expia nation of the CRA's civil audits and civil processes are noted in
Part ( c) above.
Part (1):
While the CRA cannet provide the information in the manner requested, for the period of April 1, 2006
to March 31, 2012, it can confirm that five cases involved acquittais or the withdrawal of charges.

Pour la priode du 1er avril 2006 au 31 mars 2012, 44 contribuables ont t trouvs coupables de
fraudes fiscales relatives de l'argent ou d'autres biens dtenus l'tranger. Ces fraudes quivalent
un montant total de 7,7 millions de dollars en impt fdral lud. Les tribunaux ont par ailleurs
impos un total de 6,8 millions de dollars d'amendes et prononc des peines totalisant 337 mois
d'emprisonnement.
Les accusations criminelles relvent de l'article 239 de la Loi de l'impt sur le revenu (UR), de
l'article 327 de la Loi sur la taxe d'accise (L TA) ou de l'article 380 du Code criminel.
Partie b):
(i) Les dtails des condamnations ayant trait l'argent ou aux biens qui se trouvent l'tranger ne font
pas partie, dans la plupart des cas relevs, des dossiers publics et ne sont pas prciss dans les
dossiers du tribunal. L'ARC ne peut donc pas fournir les renseignements tels qu'ils sont demands
puisqu'elle contreviendrait aux dispositions de la UR en matire de confidentialit (c'est--dire l'article
241), lesquelles empchent l'ARC de divulguer les renseignements confidentiels des contribuables. En
outre. fournir les renseignements demands pourrait mener ce que des infrences soient tires entre
ceux qui sont nomms et les biens et l'argent dtenus l'tranger, ce qui, par ricochet, pourrait
galement contrevenir l'article 241 de la UR.

11 y a une distinction importante faire dans les cas o les renseignements font partie du dossier public
et sont dtaills dans les tribunaux. Dans ces cas, l'ARC tient rendre publiques les condamnations
pour fraude fiscale. Cette mesure vise maintenir la confiance dans l'intgrit du rgime
d'autocotisation et accrotre l'observation de la loi grce l'effet dissuasif de cette publicit.
Comme cela est indiqu sur le site Web de l'ARC, l'ARC ... informe les mdias sur les cas de
personnes, de socits ou de fiducies condamnes devant les tribunaux pour fraude fiscale ou pour
dfaut de produire une dclaration de revenus exigible. L'information transmise aux mdias est
accessible au public, puisqu'elle est tire du dossier du tribunal et non des renseignements
confidentiels que possde l'ARC.
(ii) Toutes les infractions sont des infractions criminelles selon ta LIR, la LTA ou le Code criminel.

Bien que l'ARC ne puisse fournir de renseignements prcis pour chaque cas pour les motifs
mentionns aux parties b) iii) et b) iv), en rgle gnrale, voici l'ventail des pnalits pour les lois
pertinentes :

une amende allant de 50 % 200 % de l'impt qu'elle a tent d'luder; ou
la fois l'amende prvue ci-dessus et un emprisonnement maximal de deux ans.
Mise en accusation :
une amende allant de 100 % 200 %de l'impt qu'elle a tent d'luder;
. un emprisonnement maximal de cinq ans.
Loi sur la taxe d'accise {article 327) :
Dclaration de culpabilit par procdure sommaire :
une amende allant de 50 % 200 % de la taxe ou de la taxe nette qu'elle a tent d'luder ou du
remboursement qu'elle a tent d'obtenir ou, si le m9ntant n'est pas vrifiable, une amende allant
de 1 000 $ 25 000 $; ou
la fois l'amende prvue ci-dessus et un emprisonnement maximal de deux ans.
Mise en accusation :
une amende allant de 100% 200% de la taxe ou de la taxe nette qu'elle a tent d'luder ou du
remboursement qu'elle a tent d'obtenir ou, si le montant n'est pas vrifiable, une amende allant

Code criminel (article 380) :
La valeur de l'infraction excde 5 000 $ :
Mise en accusation : emprisonnement maximal de 14 ans.

La valeur de l'infraction n'excde pas 5 000 $ :
Mise en accusation : emprisonnement maximal de deux ans; ou .
Dclaration de culpabilit par procdure sommaire selon l'article 787 et passible de:
o une amende maximale de 5 000 $;ou
o un emprisonnement maximal de 6 mois; ou
o la fois une amende et un emprisonnement.
(vi) En ce qui concerne les 44 condamnations, les amendes variaient d'environ 12 000 $ 1,1 million
de dollars. Les peines d'emprisonnement variaient de 0 48 mois. L'ARC ne peut pas fournir d'autres
dtails, car la divulgation des renseignements d'un cas prcis relativement aux peines
d'emprisonnement pourrait, par ricochet, permettre d'identifier le contribuable vis et, comme nous
l'avons mentionn prcdemment, contrevenir ainsi l'article 241 de la UR. Les dtails concernant
l'argent et les biens trangers ne font pas partie du dossier public et l'ARC ne peut pas divulguer de
renseignements qui feraient en sorte que des personnes pourraient extrapoler des renseignements qui
ne sont pas dans le dossier public.
(vii) En ce qui concerne les 44 condamnations, sept se sont rgles par un procs de premire
instance et 37' par des plaidoyers de culpabilit.
(viii) Le temps requis entre le dbut et la fin des diffrentes mesures d'observation lies des
infractions fiscales varie d'un dossier l'autre, selon la complexit et la disponibilit des
renseignements viss, et cela peut prendre des annes.
Puisque la protection des renseignements des contribuables est de la plus haute importance, les
dispositions en matire de confidentialit des lois appliques par l'ARC empchent la divulgation de
renseignements prcis sur un contribuable.
Partie c):
Une infraction est une affaire criminelle. L'ARC ne procde pas une poursuite civile pour une
infraction. Comme nous l'avons mentionn la partie a}, les accusations criminelles relvent de
l'article 239 de la LIR, de l'article 327 de la LTA ou de l'article 380 du Code criminel.
Toutefois, le dfaut de dclarer un revenu et d'autres biens dtenus l'tranger peut entraner une
nouvelle cotisation de l'impt, y compris des intrts et des pnalits. Un contribuable qui n'est pas
d'accord avec une nouvelle cotisation peut interjeter appel auprs de la Cour canadienne.de l'impt,
ce qui constitue un processus civil.
Pour la priode du 1er avril 2006 au 31 mars 2012, l'ARC a achev 7 761 cas de vrification civile lie
la planification fiscale internationale abusive (c.--d. par processus civil).

Partie d):
Bien que l'ARC ne fasse pas de suivi des infractions prises en considration, nous pouvons donner
les renseignements suivants. Pour la priode du 1er avril 2006 au 31 mars 2012, parmi les cas qui
taientlis de l'argent ou des biens dtenus l'tranger, il y en a eu 11 qui n'ont pas fait l'objet
d'un procs. Voici leur rpartition :

Partie e):
Il est important de prciser que lorsque l'ARC fait un renvoi en vue d'une poursuite, il s'agit toujours
d'une affaire criminelle. Les affaires civiles ne sont pas des poursuites criminelles. Par consquent,
l'ARC ne peut pas fournir de renseignements de la manire demande. Une explication des
vrifications civiles et des processus civils de l'ARC est donne la partie c) ci-dessus.
Partie f):
Bien que l'ARC ne puisse pas fournir les renseignements de la manire demande, pour la priode du
1er avril2006 au 31 mars 2012 elle peut confirmer que cinq cas ont donn lieu des acquittements ou
au retrait des accusations.
