Theprosecutionstoryinbriefisasunder: A home meant for mentally challenged girls under the

nameKalyaniMahilaandBalkalyanSevaSanstha(hereinafter referredKalyaniSanstha)wasbeingrunbyMr.Ramachandra Karanjule (Accused No. 1) at Khanda Colony, Kalparaj Row House, New Panvel, Dist Raigad. Nineteen mentally disabled girlsweretheinmatesofthesaidhome.Atthesameaddress, earlier,sincetheyear2003,AnandMahilaandBalkalyanSeva Sanstha,Shirur,Pune(hereinafterreferredasAnandSanstha) wasbeingrunbyMr.JayantSarodeofwhichA/1wastheVice President. DuetosomefinancialdisputebetweenMr.Sarode andA/1fordonationamount,theAnandSansthadisassociated itselffromthishome.However,thesaidhomewascontinuedto

berunbyA/1underthenewnameKalyaniSanstha.Accused no.1gotregistrationofKalyaniSansthaunderPublicTrustAct on 19/07/2005 (Ex. 184) and from Women and Child department on 5.12.2009. All the 19 inmates originally belonging to Anand Sanstha continued to live in the same premisesownedbyA/1withoutperforminglegalformalitiesfor transferringthegirls.

ItisfurthertheprosecutioncasethatinOctober,2010,

Mumbai Mirror (a local newspaper) of Times of India Group broke the story of pitiable condition of mentally disabled inmatesatKavdasvillageinShahpurTalukaofThanedistrict. Takingcognizanceofthenewsitem,HonbleHighCourtvidea SuoMotoPublicInterestLitigationNo.182/2010,appointeda Maharashtra State Coordination Committee headed by Prof. AshaBajpaiinteraliatoassessandreviewthequalityofcare and management in Childrens Homes across the State of Maharashtra. At the same time, seven Regional Committees were also set up to inspect homes for mentally challenged childrenandsubmittheirreporttotheChairpersonoftheState Committee.

Accordingly,KonkanRegionalCommitteewhileinspecting

homes for mentally challenged children being run in Konkan region, inspected Kalyani Sanstha on 15Feb2011 and 22 Feb2012. The regional committee witnessed gross mismanagement in the affairs of the said Sanstha and also suspectedphysicalandsexualharassmentoftheinmatesand

accordingly submitted its report to the Chairperson, State Committee. The Konkan committee also directed the Child Welfarecommittee(CWC),RaigadandalsotheChildWelfare Officer, Alibag to visit and verify the condition of the said Sanstha.Accordingly,on28thFeb2011,theCWCmembersand the officers from Child Welfare Office, Alibag visited the said Sansthaandfoundmismanagementandalsosuspectedsexual abuse.Immediately,on2nd March2011,theinmatesweregot medicallyexaminedatKarjatRuralHospitalandfivegirlswere foundtobehabituatedtosexualintercourse.

Basedonthisfinding,alltheinmateswereimmediately

shiftedtoKripaMahilaSansthaatKarjatwithPoliceaid.On4th March2011,CWCChairpersonMs.NeelaTulpulelodgedFIR withtheKalmboliPoliceStation.Onthebasisofherreport,the police registered crime at C.R.no.125 of 2011 against the accused persons for the offences punishable under sections 376/109/114oftheIndianPenalCode.

On4th itself,PIShuklaofKalamboliPoliceStationalong

with the complainant, Mrs. Tulpule visited the spot of the incident.Heseizedsevenfilesrelatingtovisitorsregister,MC register of the girls, register of names and addresses of the officebearers,visitregisterofGovt.OfficialsandGateregisters from the spot in the presence of panchas and prepared spot Panchanama (Exhibit82). PI Shukla also called the photographer(PW.15)andtookphotographs(Exhcolly,15nos.) ofthespot.PIShukladepositedthemuddemalatMalkhanaon

4.3.2011itselfvidemuddemalreceipt(Exh.128).

Onthesamedayhearrestedaccusedno.1Ramchandra

Karanjule, accused no.9 Surekha Karunjale, accused no.5 Kalyani Karanjule and accused no.6 Sonali Badade. On the same day accused no.1 was sent for medical examination at Ruralhospital,Panvel.

On 5.3.2011, the medical examinations of the victims

On 6.3.2011, PI Shukla seized other documents and

articles from the spot in the presence of two panchas and accusedno.1.Inall,191articleswereseized.Thearticleswere includingvariousfilesofcorrespondences,accounts,registers, bill,vouchers,medicines,computer,condoms,contraceptivepill etc. vide seizure Panchanama (Exh.52 colly.) PI Shukla depositedtheseizedarticlesatMalkhanaonthesamedayvide receiptExh.129.

Onthesameday,hearrestedParvatiMavle(A/10). On

7.3.2011 Narendra Mehta (A/8), on 8.3.2011 Nanabhau Karunjale (A/2), on 12.3.2011 Prakash Khadke (A/4), on 15.3.201DhirubhaiLimbani(A/7)werearrestedsentthemfor medicalexaminationatRuralhospital,Panvel.

Thereafter,aspertheorderofDirectorGeneralofPolice,

the investigation of this case was marked to ACP Smt.Karandikarvideletter(Exh.178).

On 16.3.2011, ACP Ms.Karandikar arrested Deepak

Mayekar (A/3). On 18.3.2011, the identification parades of accused no.3 and other accused were conducted. On 12.4.2011, the statements of victim girls Kusum (PW.17), Chandramukhi (mute) and Anamika (mute, PW.18) were recorded with the helpof Dr. ArchanaSingh, the Psychiatrist (PW.6),andMrs.SunandaTarte,theinterpreter(PW.7).

On 13.4.2011 and 15.4.2011 the victim girls were

medicallyexaminedbytheteamofdoctorsofKEMhospitalat Karjat hospital which included Forensic Experts, Gynecologist andPsychiatrist.

On 13.4.2011, ACP Karandikar recorded statement of

Mr.Gawhane,(DW7) the officer from Women and Child Development Office, Raigad District.On 14th and 18th April, 2011,thestatementsofothervictimgirlswererecorded.

ACP Ms. Karandikar recorded the statements of other

witnessesandalsogathereddocumentsrelatingtoeligibilityof Superintendent, requirements for sanctioning home for mentallychallengedandthepapersregardingrequiredstafffor school for mentally challenged vide letter dated 26.4.2011 (Exh.179 colly.) ACP Ms.Karandikar also collected the documentstoshowthataccusedno.1RamchandraKarunjaleat

therelevanttimewasworkingatCentralRailway,Matungavide letterExh.180.

ACP Ms.Karandikar also collected information from

Lokmatoffice,Mumbai,whereaccusedno.2wasworkingasa DeputyEditorabouthisaddressvideletterExh.181colly. ACP Ms. Karandikar collected certified copies of registration documents (Exh.184 colly.) of the Sanstha with Charity Commissioneroffice,Raigad.

On1.5.2011,ACPMs.Karandikarreceivedreports(Exh.97

colly.) from Dr.Harish Shetty, Psychiatrist, about psychiatric evaluation of the girls.The victim girls were also sent for recordingof164statementsbeforetheMagistrateon19th,20th and27thApril2011.

After investigation ACP Ms.Karandikar filed first

chargesheeton3.5.2011beforetheCourtofMagistrate,Panvel and second chargesheet in the month of July2011 after collectingmobiledetailsoftheaccusedpersons.

The offence punishable u/s.376 of Indian Penal Code

beingexclusivelytriablebytheCourtofSessions,theCourtof Magistrate,initsturncommittedthecasetotheSessionsCourt, Raigad,videcommittalorderdated11.5.2011.

High Court was pleased to transfer this case from Sessions Court,RaigadtotheSessionsCourt,Mumbai.

The predecessor of this Court framed charge (Exh.21)

againstalltheaccusedpersonsfortheoffencespunishableu/s. 376(c),307,377,324,323r/w.section109,114andsection34 ofIndianPenalCodeandsections23,25,and28oftheJuvenile Justice(CareandProtectionofChildren)Act,2000andsections 467, 468, 471 r/w. section 34 of Indian Penal Code against accusednos.1,2,and5saperately.Thechargeswerereadover and explained to the accused persons in their vernacular to whichtheydeniedthechargesandclaimedtobetried. Their defenceisoftotaldenialandfalseimplications. Thepleasof theaccusedpersonswererecordedvideExh.22to31.

The Konkan committee visited the present Kalyani Sanstha on 15th and 22nd Feb, 2011 and submitted its report to the Chairperson, State Coordination Committee,Prof.AshaBajpai.

The prosecution examined the members of Konkan

Committee Ms. Naina Athale (PW3) and Dipali Bhattacharya (PW4).Boththesemembersconsistentlybroughtonrecordthe

Attheentry,therewasshoplikeshutter.Iftheshutter isdown,noscopeforventilation. iii. Therewere1819girls,someweresittingandsome werelyingdownonthefloor. iv. TheSuperintendent,Sonali(A/6)wasreluctantto showfilesanddocumentstothemembersasitwere notkeptproperly. v. TheMOUoftheSansthawasaprintedreadymade proformaavailableinmarket. xii.ThedocumentsoftheregistrationofCharity Commissionershowedthatthesansthaisallowedto domanysocialactivities.Theexplanationwasgiven byMr.RamchandraKaranjulethatifhisworkwith childrenisdiscontinuedthenhecandoanyother socialwork.
xiii.Thecommitteememberswantedtotalkwiththegirls,

butRamchandra(A/1)andSonali(A/6)werenotco operatingandnotallowingthegirlstotalkwiththem privately. xiv.ThemembersnoticedonegirlbynameKusumwas continuouslyspittinganditwasoneofthesymptoms ofsexualabuse. xv. ThefileofonegirlbynameSeetawhohaddied,was notavailable. xvi.MC.Registerwassignedbymaledoctor.

ThecommitteesubmitteditsreporttotheChairpersonMs.

AshaBajpai.ThereportEx.58depictsindetailthesordidaffair of the Kalyani Sanstha. In fact, the Konkan Committee laid foundationforthisunparallelandsensationalcaseofrapeof19 girlsintheKalyaniSanstha.Here,thisreporthasaprobative valueasthereportissubmittedbythecommitteeappointedby the government of Maharashtra through resolution at the instanceofHonbleBombayhighcourt. 36. In the instant case, the prosecution examined in all 22

witnesses in the nature of complainant, 2Konkan regional committee members, 2panchas for spot panchanamas, 5 doctors, 2psychiatrists, interpreter, neighbour witness, 3 victims, photographer, magistrate and 2investigation officers. Thoughthevictiminmatesare19innumbers,theprosecution could examine only the three inmates i.e PW17, PW18 and PW19 as per reports of Dr. Harish Shetty, (Ex.212 colly and

PW1,Adv.Sau.NeelaTulpuleistheinformant.Sheisthe

presidentofChildWelfareCommittee,Alibag.Herevidenceis onlyonthepointthatshealongwithCWCmembersandofficer from Women and Child Development Department visited the spoton28thFeb2011. 38. PW.1, the complainant, deposed that the Konkan

committeedirectedthemandtheChildWelfareOfficer,Alibag tovisittheKalyaniSansha.Accordinglytheyvisitedthesanstha on 28th Feb and talked with the children. They suspected physicalandsexualabuseonthegirls.Theyalsosuspectedthat somecollegeboysalsocomeintheSanstha.Immediately,the girls were referred for medical examination. The medical findingswerepositiveandthereforethecrimewasregistered. (FIREx41) 39. IntheabovereferredSuoMotoPublicInterestLitigation, theHonbleBombayHighcourtwaspleasedtodirectthat,this courtmayrecordtheevidenceofthevictimsbywayofvideo conferencing. TheHonbleHighCourtalsomadeitclearthat theordershallnotpreventthesessionsCourtfrompassingsuch orderandfurtherorderasmaybenecessaryinthefactsand circumstancesofthecase. 40. Theprosecutiontriedtoinstallvideoconferencingfacility

attheplacewherethevictimswereplaced,buttheycouldnot. Therefore,ontherequestofLd.SPP ,themodalitieswerefixed torecordtheevidenceofinmatesintheCourtbykeepingin view, the guidelines given by Honble Apex Court in Sakshis case,andordertothateffectwaspassedbelowExh.122and 138.

TheevidenceofthevictimswererecordedintheCourt

hall in camera by creating victim friendly atmosphere. The accused persons were seated behind the partition wall of cupboards.Precautionwastakenthatvictimcannotseeasingle accused. Their evidences were recorded in the presence of Psychologist as directed by Honble High Court in the above referredpetition. SubmissionsoftheLd.counsels. 42. Learned SPP Ms.Rohini Salian on behalf of the State

stronglyarguedthathereweareindependentandnotexcited bythefactthatHonbleHighCourthastakencognizanceabout thepitiableconditionsoftheinmatesinthehomesforchildren alloverMaharashtra.Shesaid,societyisdeterioratingandwe havetochangethemindset.TheincidentsatKalyaniSanstha shocked the judicial conscience. Godman became devils workshop.Toimaginetheplightofmentallychallengedwhen theirparentshavethrownout.Somecannotwalk,somecannot speak. Itisnotanormalcase. Itisacaseofnormalpeople becoming abnormal. The mental problem of these people is theirinsatiablelust. Weareboundbytheruleoflawandthe

Constitution of India. No person have right to do anything. Therearelimitationsandrestrictions.Anythingisinexcess,it has to be controlled. Victimsthe helpless human being are exploitedtowhatextentbyforminganorphanage. WhatBal KalyanSanstha.Shedoesnotknow.Howaccusedno.1,earlier memberofAnandSanstha,exploitedthegirl,takenoverAnand Sanstha.Allthe19girlsareexploitedphysically,mentallyand sexually.WeareaccountedtoGod.Donationsafterdonations keep flowing. The medical reports of the girls are positive. Whodidthis?Theincidentregisteredinthemindsofmentally challengedgirland they kept repeatingit. Their memory as regards the incident is intact. The evidence has to be read sympathetically. Thesegirlscannotbetutored. Theplaceof Wakdi,theunderconstructionsitewasalsousedforexploiting the children. The horror picture committed on the helpless children. 7 girls died. No document regarding Sita. What traumathegirlsmusthaveundergone.Noaccusedbespared.

Onthecontrary,learned defencecounselShri. Moreon

behalf of accused nos.1, 7 & 8, argued in the line that the accusedno.1hasnothingtodowiththisincident.Hehadgiven hispremisestoAnandMahilaBalKalyanSevaSanstha,Shirur, Puneonrentalbasis.ThePresidentofthisSansthaShri.Jayant Sarodefalsely implicatedtheaccused inthiscase. There was emotionaleffortstobringthetears.Thetearswerecrocodileto grab the object. The Anand Sanstha was working since 3.6.2003 to 17.3.2011, on which date its registration was cancelled.TherewasnotransferorderfromAnandSansthato

Kalyani Sanstha. The report submitted to the Honble High CourtwasbogusandtherebymisguidedtheHigherauthorityby suppressingthetruththatthechildrenwereofAnandSanstha. Ld.counselShri.Morealsoarguedonthepointoftutoringthe witnessesbydoctorHarishShetty(PW.11)andtheinterpreter Tarte madam (PW.6). The prosecution brought distorted evidencebeforetheCourtwhichisnotacceptable. Thegirls werediednaturally.Thepanchwitnessistheregularpanchof Kalambolipolicestationandhenceseizureisdoubtful. Inthe lastld.counselsubmitsthatprosecutionhavefailedtoprovethe chargesagainsttheaccusedpersons.

Ld.counselMs.LatikaBelindageforaccusedno.3argued

thatoffenceu/s.377ofIPCisnotproved. Accusedno.3was stayingatKopargaon,500kilometerawayfromPanvel.Hehas beenfalselyimplicatedinthiscase.

45.

Ld. counsel Ms.Anjali Patil for accused no.4 strongly

argued against improper medical examinations of the girls. Therewasnohymentestsetc. Accusedno.4wasworkingat Lonvala and there was no occasion for him to come to the KalyanSanstha.

46.

The ld. counsel Shri.Vaswani for accued no.2 highly

stressedonthepointthatthesignlanguageofAnamikawasnot recordedwhichistherequirementofthelaw.

and9stressedthattheprosecutioncouldnotprovethatthese accused persons at any time instigated or abetted in the commissionofcrime. NowIproceedtodealwiththepointsfordetermination. Reasonastopointsrelatingtochargesofrape,gangrape and sodomy and admistering intoxicants to the juveniles againstaccusedno.1Ramchandra(papa)and3Mayekar. ForconvenienceIamtakingthesepointstogether. 48. At the outset, undisputedly the inmates in the Kalyani

Sanstha used to call accused no.1 Ramchandra as Papa and accusedno.9Surekha(wifeofA/1)asMummy.PW.17Kusum wasoneoftheinmatesofKalyaniSanshta. AsperPsychiatry reports(Ex.97colly,Ex.115colly)herintelligencewasborder line,mildmentalretardation.Thecourtaskedthewitnesssome introductoryquestionstowhichshegavetheproperanswers. She was knowing sanctity of oath. Hence, oath was administeredtoher. ThePsychologistVinitaKhedkarwasalso administeredtheoath. Asregardsallegationofrapeagainstaccusednos.1and therelevantparasofhertestimonyarereproducedbelow.
3. Ramchandrahadcomeonmybody.Hegaveburns.WhenI wassleeping,heaskedmetogetupandtocomeupstairs.WhenIwas notgoingheslappedme.Hesaidnottodisclosethisincidenttoanybody. Hepressedmymouth.Heaskedmetolickhisurinalorgan.Helickedmy upperbreast.Thisthingwasdonepriortomanydays.Hesqueezedmy breast.Heremovedhisclothes.Heremovedmyclothes.Heinsertedhis

bodyofSonalKasle.Mayekaraskedmenottodisclosethisincidentto anybody. I said I will disclose to all. When I disclosed the incident, Mayekarconfinedmeinoneroom.

The testimony of this witness shows that

Ramchandra(A/1)committedrapeonherself,Mayekar(A3)on Sonal. However she could not stand in the extensive cross examinations. She conceded for almost all the suggestions. Learned defence counsel also brought on record some improvementsinherdepositionwhichshehadnotmadebefore theMagistrateinher164statementorbeforethePolice. 50. Here, as regards the improvements, undisputedly, the

inmateswereintheKhandacolonysince2003.Asperevidence on record Ramchandra (A/1) wasVice President of erstwhile AnandSanstha.Admittedly,AnandSansthawasrunninginthe rowhouseownedbyRamchandraKaranjule(A/1)atKhanda Colony.EvidenceonrecordshowsthatRamchandraKaranjule with his family was residing in the same row house at the relevant time. The incidents of sexual assault is stretched during the period between 2003 to February2011. In such circumstances,itisnotpossibleevenforthenormalwitnessto depose exactly in chronology with date and time about the incidents.Undisputedly,thiswitnessismentallysubnormal.For this witness, omissions are bound to occur. The cumulative effectofherevidencebeforethecourtandher164statementis

to be tallied. The apparent conflict or improvement in their version has to be understood in the light of the factual backgroundandthecircumstancesunderwhichthesegirlswere placedatthattime. 51. As regards, admissions in cross examination, the Court obtained opinion of the Psychologist who was present throughout, during the recording of evidence of this witness. The Psychologist Ms.Vinita Khedkar who has done Master in Counselling Psychology and who is working with this inmate since April2012, deposed that the witness PW.17 should not havebeenaskedclosedendedquestions.Hermemoryisshort termmemory.Shetendstorememberendpartofthequestion andnotthewholequestion.Thequestionsweresuggestiveand hence she gave most of the answers in affirmative. About memoryshegaveopinionthathermemoryspeciallyaboutthe traumaisintact. Shedoesnothavetheconceptoftime,date and year. The Psychologist also opined that tutoring can be possibletothiswitnessbutitrequireslotoftimetotutor.Tothe court,PW17wasnotappearingtobeatutoredwitness. 52. As regards competency of this witness, she could not understandallthequestionsputtoherinthecrossexamination nor could be able to give the rational answers. Prudency requiresthatonthesoletestimonyofthiswitness,conviction cannot be granted. I am not using her testimony as a substantive evidence against the accused persons as far as seriouschargesareconcerned.Fromhertestimony,broadly,it

can be said that the incidents of rape occurred at Khanda ColonySanstha.AsshewasatKhandaColonysince2003with othergirlslikeAnamika,Zaidaetc.hertestimonywillbemore usefultounderstandthesignlanguagedevelopedbythemute girlsatKhandacolony. 53. Itisalsonecessarytomentionherethatwhenthecourt

startedrecordingherevidence,itdidnotoccurtothecourtthat she wont be able to understand the questions in the cross examinationandwillnotbeabletogivetherationalanswers andthereforecourtstartedrecordingherevidenceinnarrative form. As soon as the court realized that the witness is not understandingthequestionsputtoherincross,courtstarted recording her further evidence in questionanswer form and attemptsweremadetounderstandherthequestionsproperly. 54. TheprosecutionalsoexaminedtheinmateZaidaPW19.

AsperPsychiatryreport(Ex.97colly.ex.115colly)ofZaida,her intelligencewasbelownormal,mildmentalretardation. The relevant portion of the testimony of Zaida is reproducedbelow.

toherincrossexaminationandshewasnotabletogivethe rationalanswers.Manytimesshetalkedirrelevantthings.She wasrepeatingtheincident.PsychologistMs.SamrinShaikhwas presentduringrecordingofherevidence.Tothecourtquestion, thepsychologistopinedthathermemoryasregardsthetrauma isintactandshecannotbetutoredastheconceptwhichshe hasnotundergone,shecannotbetutored. 56. Fromhertestimony,broadly,itcanbesaidthatthe

incidentsofrapeoccurredatKhandaColonySanstha.However, hertestimonycannotbeusedasasubstantiveevidence.Itcan be used only as the corroboration. As she was at Khanda Colonysince2003withothergirlslikeAnamika,Kusum,etc. her testimony will also be useful to understand the sign languagedevelopedbythemutegirlsatKhandacolony. 57. TheprosecutionalsoexaminedanothervictimAnamika, PW.18,whoisamutegirl.Sheisunabletospeakandhearbut herIQasperexpertsopinion(PW6,PW11andEx.97colly)is normal. She being illiterate, her testimony could not be recorded by putting questions to her in writing as required u/s.119ofIndianEvidenceAct.Hertestimonyisrecordedwith the help of interpreter Mrs. Sunanda Tarte.(PW7) and the

Qt.19WhatelseRamchandradowithyou? Ans. Hegavememoneyfornottellingthesethingstoanybody.I gavethemoneytoMummy. OnedayPapaandDeepakMayekarhadcomewithtwobottlesof liquor.Papacalledmeandaskedmetoheadmassage.Heopenhis shirtbuttons,hetookmeinhisarmandthenheleft.Thereafter, both Ramchandra and Mayekar went upstairs and asked me to bringfood.Itookthefoodup.TheyaskedforKusum,Pinkyand Sonal.IsaidIdidnotknow.Hecalledweallfourup.Hetookout liquorintwoglassesandmixedit(gestureofmixing)andgaveitto allofus.Mayekarwentoutandbroughtsixcondoms(gestureofsix byfingersandsignofballoon).SonaliandKalyaniwerethereand they leftbybolting thedoor from outside. They leftand slept. RamchandraandMayekarremovedourclothesandrapedus.

From her testimony, we can get the clear idea as to how the physically and mentally disabled orphanswerephysically,sexuallyandmentallytorturedbythe accused no. 1 Ramchandra (papa) with the assistance of his friends including accused no. 3 Mayekar. How accused no. 1 usedtodounnaturalsexwiththesegirls.Howhewasscaring the girls. How they used to commit gang rape on the girls. Accused no. 1 was not doing work and only taking rest and doingtheseactivitieswiththegirlsbyconsumingliquor.The girls were calling him the papa and papa is doing all these horriblethingswiththedaughtersbyforgettingallmoralityand rulesofsocietyandthedharma. 60. Anamikaisconsistentinhertestimony.Shecouldfacethe

extensive cross examination. She stuck up to her testimony. Therearesomeminorimprovementsinhertestimonywhichare boundtobethereinviewofthelongperiodoftorturestretched for7years.Shewasgivinghertestimonybyrememberingeach incidentandwastakingpauseinbetween.Whenthequestion inthecrossexaminationwasaskedtoherastowhyshedidnot tellthisbeforethelowercourt,shesaidshehadforgottento tell.Itisbutnaturaltohappenthatwhentherearesomany incidentswithmanygirlsduringaspanof6to7years,whatever she remembered she stated before the police and before the Magistrateandwhateversherememberedshestatedbeforethis court. There is no material contradiction or omission in her statements before all the three authorities, if tallied together. Manytimesshewasappearingemotional.Tearshadalsocome

inhereyes.Onceshefeltgiddiness. Wholeofhertestimony reflects natural flavor. Abortive attempts were made during crossexaminationtobrandherasatutoredwitness.Shedenied allthesuggestions.Hadshebeentutored,shewouldnothave toldaccusedno.5,7and8,asgood.Shewouldnothavetaken thenameoffriendofRamchandra,whoisnotmadeaccusedin thiscase,forcommittinggangrapewiththegirlsatWakadi. Her testimony remained unshaken during the cross examination. 61. Her testimony lends further corroboration from the

testimonyofothervictimsPW17andPW19asregardsthefact of rape, sedative material etc. The articles like, packet of condom(Art.189)andcontraceptivepill(Art.191)seizedfrom the spot and the positive medical reports also supports her testimony.ThesignsusedbyAnamikaaretalliedwiththesigns showedbyKusum,Zaidaandtheinterpreter.

ThetestimonyofPW18issonaturalthatanydoubtonit

would entailinsult to her. Her testimonyinspires confidence. Hersoletestimonyissufficientforconvictioninthiscase.Her testimonylendsfurthercorroborationfromher164statement. (Ex.194colly)

Most of the gestures of this witness were so perfectthatevenacommonmancanunderstandit.Itwaseasy tounderstandhersignlanguagebutitwasdifficulttomakeher understand the suggestions put in the cross examinations. However, her evidence was recorded after properly understandingthewitnesseachofthequestionputduringcross and the answers were recorded after full satisfaction of the prosecution,defence,theinterpretersandthecourtaboutthe interpretationofhersignlanguage.Tounderstandthenamesof inmates and the accused persons, along with gestures, lip readingwasalsoused. 66. Ld.defencecounselShri.Vaswaniforaccusedno.2relied

onthefollowingauthoritiesandstressedfornotrecordingthe evidence of mute girl in sign language. As I said earlier, her examinationwasstretchedfor5longsessions.Thevictimgirl was getting exhausted during long sessions of cross examinations.Itwastakingmuchtimetounderstandthemute girl, the ticklish suggestions during cross examination. The presentcaseisnotthecaseofsingleincidentwithoneaccused andonevictim.Inthepresentcase,thereareseriesofincidents stretched during the period between 2003 to 2011 with nineteen victims and multiple accused. All the inmates were insane except this mute girl. I wonder as to how she was managing herself with these girls whose IQs were below normal. Where ever possible this court recorded the sign

Defence also raised the objection for assistance of Ms.Sunanda Tarte and Ms.Samrin Shaikh, being interested witnesses. I do not find substance in this argument. Insuchacase,to understandherlanguageitisnecessaryfirsttodeveloprapport withthegirl.TheinterpreterMrs.Tarte,firstdevelopedrapport withthegirlsbyattendingthegirls4to5timesandunderstood

theirlanguage.Priortothiscase,shewasunknowntothegirls. AspertherequisitionofPSKalamboliandasperthedirection oftheHeadMistressofherschool,wheresheisworking,she assistedthePoliceinrecordingthestatementsofmutegirlsand to the court forrecording the evidence of Anamika. She had alsohelpedtheLd.Magistratetorecordher164statement.She hadnoknowledgeabouttheaccusedpersons. Shenevermet them. Insuchcircumstances,theinterpreterMrs.Tartecannot bebrandedastheinterestedwitness. 69. TheprosecutionexaminedMrs.SunandaTarte(PW7),the

interpreter,asawitnessonlyonthepointthatsheassistedthe I.O.inrecordingherevidenceandwhatsheunderstoodabout specificsignlanguageofthemutegirls.TheinterpreterPW7 deposedthatherqualificationisBA.B.Ed.forhearingimpaired. Shehaddonespecialcourseofhearingandsince1993,sheis workingatIndianCouncilforthementalhealth. Shetaught about150students. Shefurtherdeposedthaton4.3.2011,in the school, her Head Mistress sent message to her that PS Kalamboli required her assistance in recording statements of mentallyretardedgirls.OnthesamedayshewenttoKalamboli PoliceStation. FromthereshewastakentoKarjatwherethe victim girls were kept. Amongst victims, Anamika, ChandramukhiandNidhiweredeafanddumb.Theydeveloped theirownsignlanguage.ShehadtakenhelpofKusum,oneof theinmatesinunderstandingtheirsignlanguage.

70. As regards, Ms. Samrin Shaikh, the psychologist, before

the court she testified, she had helped Dr Harish Shetty for psychiatric evaluation of the victim girls. She had developed rapport with the girls during such evaluation. During her assistancetothecourt,itdidnotoccurtothecourtthatsheis theinterestedwitness.Onthecontrary,shewasexertingmuch tounderstandthemutegirlthecomplicatedquestionsincross examinations. The assistance of the interpreter and the psychologistwasmoreusefulduringcrossexaminationofthe victim.

ThequestionwasalsoraisedthatMs.SamrinShaikhhas noknowledgeaboutspeciallanguageofthemutes.Inhercross examinationbyadv.Shri.Gurav,foraccusedno.5,6and9,Ms. Samrin Shaikh deposed that Anamika, herself made her understandhersignlanguageandtheotherinmatesalsohelped her sometimes. Ms. Samrin Shaikh also deposed in her cross thatshewasnotknowingthehistoryofgirlsbeforegoingto Karjatbutshewasknowingforwhatpurposetheyweregoing toKarjat.Ithasalsocomeinhercrossthatshedidnotinteract with thegirls before coming to the court. Shesaid, she has done specialization in Counseling psychology in 2006. She deniedthesuggestionthatsheneverhadcounselingwithdeaf anddumbchildren.Shesaid,shehadinteractionwiththemfor oneyearduringInternship.Shelearntthelanguageofdeafand dumbinhercurriculum.Shesaidthattheconversationwiththe girlswascheckedonmultipleoccasionsandvalidated.

Accused no.1 committed unnaturaloffenceonKusumandPinkyRamsingh.Theaccused nos.1and3arealsoliablefortheoffencespunishableu/s.25of theJuvenileJusticeCareandprotectionofChildrenAct,2000, as they forcibly administered liquour and psychotropic substancestotheinmatestofacilatethesexualoffenceswith thegirls. Theoffenceofcriminalintimidationisalsoproved againstaccusedno.1asheusedtothreatsthegirls.Thoughthis chargeduetoinadvertencemistakecouldnotbeframedagainst accused no.1, no prejudice will be caused to him, being the minoroffenceandhehadnoticeaboutit.Itisunfortunatethat theprosecutioncouldonlybringthreeinmatestoproveitscase. Theotherinmatescouldnotbebroughtinviewoftheirtrauma andmentalintervention.Ianswerallthepointsaccordingly. ChargesagainstaccusedNo.4PrakashKhade 76. At the outset accused no. 4 in his 313 statement , has

admittedthathehadworkedintheSansthaatKhandacolony during2003and2004forninemonths.

As per testimony of PW18, the mute witness, after

committing rape with Sonal, by evening he (A/4) left. This shows that accused no. 4 used to come at Khanda Colony. Further more the Ld. Counsel for accused no.4 examined defence witness DW1 Shri. Ramesh Gupta, a resident of Bombay,whorunsahomeforseniorcitizensinthenameof RamanandCharitableTrustatLonavala,toshowthataccused no.4wasworkingandresidingtherewithhisfamilyandnever visitedKhandacolony. However,inhiscrossexaminationhe hasadmittedthathedoesnotknow,duringthedaywherethe accusedno.4goesasheusetovisitLonawalaonceinamonth. In addition to this, all the three victims made the sign of

accusedno.4bymovinghandaboveforeheadtoshowthatheis bald towards front and which matches with his actual appearance before the court. Defence could not create a probable doubt in the prosecution story as regards accused no.4. Furthermore the medical reports (Ex. 68 and 116) of Sonalispositiveanddoctorsopinedthatshewashabituatedto sexualintercourseandherhymenispatulous(loosened).Her testimony(PW18)isfurthercorroboratedwiththetestimonyof KusumPW17andthehistorygiventothedoctorinher(Sonal) medicalreport.Hertestimonyisalsocorroboratedwithher164 statement (Ex.194). Though there are some omissions, but insufficienttobeliehertestimony.Inadditiontothis,theintake register(Art112)seizedfromthespotshowsthatSonalisfrom Lonavala and her sister is also residing at Lonavala. The prosecutioncouldprove thechargeofrapeonSonalagainst theaccusedno.4.Ianswerallthepointsaccordingly.

ChargesagainstaccusedNo.2Nanabhau 78. Undisputedly, the accused no. 2 was residing near the

spot.EvidentlyandaspertherecordoftheSanshtaseizedfrom thespot,accusedno.2isshownasSecretaryofKaylaniSanstha since2005. As regards the allegations against accused no. 2, the relevantparasofthetestimoniesofthevictimsarereproduced below. PW18 Qt.24WhatdidNanabhaudo?

Nanabhau was insertinghisurinalorganintheurinalorganofAnamika.Atthat time,policewalicame.PolicewaliiswifeofNanabhau.Itoldher that Nanabhauis doingdirty work with Anamika. One canteen walahadcomeonmybody.Hehadpulledmyhand.Isaidwhyhe ispullingmyhand.Hedidnotgetanothergirl.Hesaidhelikes me. 79. AsIsaidearlier,Iamnotconsideringtheevidence

of PW17 and PW19 as the substantive evidence due to their incapacitytostandduringcrossexamination.Theirevidenceis usedonlyascorroboration.Inhercrossexamination,PW18has admittedthataccusedno.2 hasdonethiswithheronlyand nottheothergirls.AspertestimonyofAnamika,theaccused no. 2 is only responsible for the charge of outraging the modestyofAnamika,whichisaminoroffence,theingredients ofwhichareincludedintheoffenceofrape.Theprosecution could not prove all the other charges against accused no.2. HenceIanswerallthepointsaccordingly.

ChargerelatingtomurderofSeetabyaccusedno.1and10 80. AsregardsdeathofSeeta,PW18deposedthatEarlierSeeta

wasofgoodhealth.RamchandraandAajiusedtobeather.Shebecameweak andonedayshedied.Shewastakensomewhereandtheydumpedherbody somewhere.

Atotherplaceshedeposed RamchandraandMavleaajibeat
Seeta(gestureofbeating).Shedied(gestureofsleeping).Thenherbodywas wrappedinclothandtooksomewhere.Mavleaajiusedtobeatthegirls

ThetestimonyofPW18isfurthercorroboratedwiththe testimonyofPW19,who deposedthat PapakilledSita.Sita wastakentohospital.Shesawwithherowneyes. 81. To rebut the charge of murder on accused no.1, Ld.

defencecounselShri.MorecalledthemedicalpapersofSeeta fromJ.J.hospitalandalsoexaminedthreemedicalofficersto showthatthedeathofSeetawasbyillness.Initially,JJhospital could not trace out the original medical papers of Seeta and could only trace out the PM pathology report, which was prepared by feeding data on the computer from the original medical papers. DW 4 and 5 were examined to prove the pathologyP .M.report. However,laterontheoriginalmedical papers could be traced out and the defence examined DW6. NowIproceedtoappreciatethemedicalevidencebroughton record. 82. ThedefencewitnessDW6,Dr.VinayakSawardekar,inhis

examinationinchiefdeposedthatasperrecord,deceasedSeeta wasgiventreatmentbyDr.S.K.GhadgeandheisnotinJ.J.

hospital now and he might have been retired. DW6 further deposedthatasperrecord,SeetawasadmittedinJ.J.hospital on24/04/2006atabout2.30p.m.byorphanageAnandMahila andBalkalyanSanstha,Panvel.Asperrecord,shecomplained ofabdominalpainsince15days,stiffnessofkneejointsince3 months,swellingoflegssince2days,vomitingandjointpain. Asperrecord,shehadsevereanaemia.Herhaemoglobinwas 3.3.Asperrecord,afterexamination,itwasfoundthatshehad respiratorypathologyonadmission,whichisabnormalandthe causeofrespiratorypathologywasprobably,T.B.On26th she hadhypotension.On29thshewentintoagaspingcondition,for which she was shifted in critical care unit and was given emergencytreatment.Butshecouldnotberevived.Shediedon 29thAprilat7.15p.m.Hefurtherdeposedthattheexactcause ofanemiacouldnotbedeterminedtillthattime.Hesaidthe causeofdeathisprobablysevereanaemiawithdisemminated coxwithperisepsis. 83. DW 6 had brought original medical file of Seeta along

withitsphotocopyandafterverification,photocopywastaken onrecordandmarkedArt.X.Atthatstage,Ld.SPPonbehalfof theState,hadtakenobjectionforexhibitingthisdocumenton thegroundthatthewitnessisnotacquaintedwiththesignature oftheauthorofthedocument.Howeverthisdocumentcanvery well be read u/s 32(2) of Evidence Act, being a record of document kept in the ordinary course of business of the HospitalinthedischargeofProfessionalduties.Intheinstant case, the author of the document could not be called as the

authorisretiredandhisaddressistobesearchedoutandthis matterisexpeditedbytheHonbleHighcourt. 84. In his cross examination, he has admitted that, as per

record, the patient was brought by Parvati Mavle (A/10), guardianandabovehername,thumbimpressionisappearing. He has also admitted that if the patient has taken treatment earlier,theycalltheearlierrecords.Hehasalsoadmittedthatif thepatientisdeafanddumbormentallyretarded,theyhaveto callforearlierrecord.Hehasadmittedthatintheentirerecord, it is not reflected that the earlier record was called. In the medicalpapersitismentionedthatSeetawasapparentlyalright threemonthsback. 85. ThedefencealsoexaminedDW5,Dr.VijayJuvekar.This

witnessdeposedonthebasisofpathologyPMreport,whichwas preparedbyfeedingthedatainthecomputerfromtheoriginal record and which was not traceable on the date of his examination. In his examination in chief, he said the PM findingsasperreportwerethatSeetawasmalnourished.She washavingpallor,cervicallymhanedopathy,liverwasenlarged andyellow.Hefurtherdeposedthatasperreport,thecauseof death was tuberculous bronchopneumonia with tuberculous lymphadenitis with fatty liver. In his cross examination, he agreedthatifapersonwithallsuchailmentsisbeatenup,he will die. He also agreed that the ailment tuberculosis, bronchopnuemoniaarecurable. 86. ThedefencealsoexaminedDW2,Dr.RavindraChavan.In

his examination in chief, he has deposed that ante mortem diagnosis as per record, show that Seeta was deaf, mute, severely mentally retarded with severe anemia with disseminated cox with sepsis. In his cross examination, the witness is shown PM report, Ex.254/D6. He said column external examination, shows Macular rash means reddish inflammatory patches all over the body. Distented means extendedalloverthebody.HealsodeposedthatinPMreport, thecauseofsuchexternalmarksarenotwritten. 87. The testimonies of these witnesses coupled with the

medicalrecordofSeeta,showthatSeetawasadmittedatJ.J. hospitalon24thAprilanddiedon29thAprilandwasbroughtby MavleAaji(A/10).Herantemortemfindingswere shewas deaf, dumb, mentally retarded with severe anemia and disseminated cox sepsis. She was having complaint of abdominal pain, stiffening of knees, swelling of legs, vomitingandjointpain.Asperbloodreport,herhemoglobin was3.3.Themedicalpapersonrecordalsoshowrashesallover herbody. 88. Seetawasbroughtbyaccusedno.10.Here,thehistoryof

beatingwasnotgivenbyA/10tothedoctorassheherselfwas theperpetratorofthebeatingaspertheevidenceofPW18.The antemortemfindingsi.e.Jointpain,stiffeningknees,rashesall overbody,incommonparlancecorrespondswiththehistoryof beating.PW18deposedthatduetobeatingSeetabecameweak which corresponds with the ante mortem finding of severe anaemia/malnourishmentwith3.3haemoglobin.Herliverwas

enlarged. Defence witness No.5 admits that if the person withallsuchailmentsisbeaten,hewilldie. 89. Nowthequestioniswhethertheactofbeatingcoupled

withillegalomissioninnottakingpropercareandnotgiving timelytreatmenttoSeeta,madehermalnourished,amounting tomurder. Hereitisnecessarytostudythelawdevelopedonit. Aspersection300,clause2ndlyifit(act)isdonewith the intention of causing such bodily injury as the offender knowstobelikelytocausethedeathofthepersontowhomthe harmiscaused,.. 90. TheHonbleApexCourtinterpretedtheclausesecondlyin

thecaseof,ShaktiDanV/sStateofRajasthan2007(3)Supreme 901whichisreproducedbelow,
15.Clause(b)ofSection299correspondswithclauses(2) and(3)ofSection300.Thedistinguishingfeatureofthemensrea requisite under clause (2) is the knowledge possessed by the offenderregardingtheparticularvictimbeinginsuchapeculiar conditionorstateofhealththattheinternalharmcausedtohimis likelytobefatal,notwithstandingthefactthatsuchharmwould notintheordinarywayofnaturebesufficienttocausedeathofa person in normalhealthor condition. Itis noteworthythatthe 'intentiontocausedeath'isnotanessentialrequirementofclause (2).Onlytheintentionofcausingthebodilyinjurycoupledwith theoffender'sknowledgeofthelikelihoodofsuchinjurycausing thedeathoftheparticularvictim,issufficienttobringthekilling

:66:JUD.SC.201100688 withintheambitofthisclause.Thisaspectofclause(2)isborne outbyillustration(b)appendedtoSection300. 16.Clause(b)ofSection299doesnotpostulateanysuch knowledge onthe partoftheoffender.Instancesofcasesfalling underclause(2)ofSection300canbewheretheassailantcauses deathbyafistblowintentionallygivenknowingthatthevictimis suffering from an enlarged liver, or enlarged spleen or diseased heart and such blow is likely to cause death of that particular personasaresultoftheruptureoftheliver,orspleenorthefailure oftheheart,asthecasemaybe.

Intheinstantcase,aspermedicalevidenceofSeeta,she

wassufferingfromsevereanemia,herhemoglobinwas3.3,her liverwasenlarged,shewashavingtuberculosis.Priortothree months,shewasalright.Thedoctoradmitsthatthepatientwith allsuchailmentsisbeatenup,hewilldie. 92. Nowitisnecessarytoseetheconductelementofoffences

underIndianPenalCode. Sections32,33,36,39and43are

therelevantsectionsandwhicharereproducedhereinbelow: 32.Wordsreferringtoactsincludeillegalomissions.In everypartofthisCode,exceptwhereacontraryintention appears from the context, wordswhichrefer to acts done extendalsoillegalomissions. 33.Act.Omission. Thewordactdenotesaswella seriesofactsasasingleact;thewordomissiondenotesas wellaseriesofomissionsasasingleomission. 36.Effectcausedpartlybyactandpartlybyomission. Aspersection32,theactincludesillegalomission. As per section 33, act denotes a series of acts and omissiondenotesaseriesofomissions. As per section 36, the causing of a certain effect is an

In the instant case, the accused no.1 was the Vice

Presidentoftheerstwhile AnandMahilaBalKalyanSanstha, Khanda colony, Panvel and President of Kalyani Mahila Bal KalyanSansthawhichwasstartedbyaccusedno.1in2005by getting registration under Public Trust Act, when there was dispute between accused no.1 and the President of Anand MahilaShri.Sarodeontheissueofamountdonation. Since, beginning Anand Sanstha was in the premises owned by accused no.1 and who was residing there. The newspaper cuttingsfileseizedfromthespotshowsphotosofthechildren withaccusedno.1,andthenewsisposingthataccusedno.1 dedicatedhimselfforthecauseoftheorphans. Accusedno.1, being the whole and sole in running the Sanstha, and was residinginthesamepremises,therewasnoquestion thathe wasnotknowingabouttheweakconditionofSeeta.Seetawas in the custody of accused no.1, it was his legal duty to take propercareofSeetaandtogivehertimelytreatment.Shewas having ailment since 23 months. After she became severely anemic with hemoglobin 3.3, with other complications and beatings,shewastakentothehospitalatthelastmomentand withinfive daysshe died.Had shebe givenproperattention andtimelymedication,herlifecouldhavebeensaved.Thisis notwithSeetaonly.Fiveinmateshavealsodiedinaspanof34 years. I dont understand how accused no. 1 was managing

thesementallychallengedgirlswithoneilliteratecaretakerand one unqualified superintendent. With such minimal and unqualified and untrained staff, with physical tortures, the deathoftheinmatesisboundtooccur.Canthisnotbetermed asmurder.Doesitnecessaryforthemurderthatthereshould alwaysbestabbing,shootingetc.

95.

Accusedno.1wasrunningtheInstitutionformentally

challenged.Headoptedthisworkfullyknowingabouttherisk factorinvolvedinthiswork.Itwashisboundeddutytotake proper care of the girls. Thoughostensiblyit was appearing thathewastheGodfatheroftheorphansanddedicatedhislife forthecauseoforphans,butindisguise,hismainmottowasto sexuallyandphysicallyexploitthegirlsandalsotogainmoney by gaining sympathy from the donors. It was his absolute liabilitytotakepropercareofthegirls.Helackedinit.Five girlshavediedinthissansthawithnoreportstotheWomen and ChildDepartment. Two girlsfledaway. Seetadiedwith absolutelynorecordinthesansthaaboutSeeta.Thishascome intheevidenceofPW10,PW3and5.Thisisextremelyserious. But he was taking everything casually. Furthermore, the documentsinfilesseizedfromthespotalsodonotshowany record about Seeta nor any correspondence in this regard is madetotheCWC.ThedeathofSeetaiscustodial.Thecustodial deathisitselfaseriousissue.Theaccusedhastoexplainthe circumstances,especially,withinhisknowledge.Intheinstant case, both the accused in their 313 statement are silent. Custodialdeathisperhapsoneoftheworstcrimesinacivilized

societygovernedbyruleoflaw.Itisaggravatedbythefactthat crime in custody is committed by persons, who are under fidituaryrelationshiporlocoparentisposition. Intheinstant case, the evidence on record show that the accused no.1, blatantlydestroyedthebasicrightsoftheinmates.

96.

In the instant case, the oral and medical evidence on

recordaboutthedeathofSeetacoupledwiththecumulative effect of all the matters before the court, taken into consideration,i.e.oralandmedicalevidence,deathofotherfive inmates,custodialdeath,legaldutyoftheaccusedno.1,illegal omission in taking proper care and giving timely treatment, physicalandsexualtorture,humanrightsofinmates,mentally challenged and orphan inmates, insufficient, unqualified and untrainedstaff,nopsychiatristorallopathicdoctorattachedto theSansha,insufficientplaceforhabitation,aprudentmanwill definitelyreachtotheirresistibleconclusionthatthedeathof Seetawashomicidal,amountingtomurder.Itisnotnecessary inlawthatthemurdershouldalwaysbebystabbingorshooting withtheintentiontocausedeath.Thisistherarestofrarecase of act plus illegal omission amount to murder. Such type of casesareveryrare.Theaccusedno.1hasdonetheactwiththe intentionofcausingsuchbodilyinjuryashewasknowingitto belikelycausethedeathofSeeta.Heretheactincludesillegal omission.Bywayofhisact(beating)andillegalomissionnot givenpropernourishmentandtimelytreatmenttherebymade her severe anemic with many complications, and he was knowingthatitmaycausedeathofSeeta.

As per definition of proved under section 3 of the

Evidence Act, A fact is said to be proved when, after consideringthemattersbeforeit,thecourteitherbelievesitto exists,considersitsexistencesoprobablethataprudentman ought, under the circumstances of the particular case, to act uponthesuppositionthatitexists. Theproofofafactdependsuponthedegreeofprobability of its existence. The expression matters before it includes matters which do not fall within the definition of the evidenceinsection3ofEvidenceAct. The Honble Apex Court is reiterating for developing sensitiveness to the lower judiciary in rape and child assault cases.

In its 113th report, the Law Commission of India

recommendedtheamendmenttotheIndianEvidenceAct,1872 (hereinafter called"Evidence Act"),toprovide that in caseof custodialinjuries,ifthereisevidence,thecourtmaypresume thatinjurywascausedbythepolicehavingthecustodyofthat person during that period. Onus to prove contrary is on the police authorities. Law requires for adoption of a realistic approachratherthannarrowtechnicalapproachincasesof custodial crimes. (Vide: Dilip K. Basu v. State of W.B. and Ors.

Evidentently,thedeathofSeetawasnotduetoprolonged

illness.AtthetimeofheradmissiontoJ.J.Hospital,noprevious recordofherailmentwasgiven.Themedicalpapersshowthat shewasapparentlyalrightpriorto3months.Itiswithinthe specialknowledgeoftheaccusedastowhySeetahadsevere anaemia. Why the file of Seeta was suppressed. These are additionalincriminatingcircumstanceagainsttheaccused.All the medical facts regarding Seeta have come in the defence evidence.Furthermore corpusdelecti isnottherequirementof law.

100.

If the deaths of the children in Childrens Home

occurs,anditremainedunreportedforalongtime,whetherthe criminaljusticesystembecomeshelplessandadamantonthe point for conclusive proof to fix the liability against accused personsbeyondreasonabledoubt.Insuchasituation,itwillbe very difficult for the police to gather materials and the real culpritswillbeletfree.Inthisrespect,itisrelevantheretocite the observation of Hon'ble Supreme Court in the case of TrimukhMarotiKirkanVs.StateofMaharashtrareportedin 2006(10)SCC681,whichisreproducedbelow,
AJudgedoesnotpresideoveracriminaltrialmerely to see that no innocent man is punished. A Judge also presidestoseethataguiltymandoesnotescape.Bothare publicduties.(SeeStirlandv.DirectorofPublicProsecution

5inmatesatKalyanisanstha,duringtheperiodof34years.It isalsooneofthestrongestincriminatingcircumstancesagainst accusedno.1.Thevisitingregister,Art.195,showsthatfromtime to time, the Government officials from Women and Child Development Department, were giving instructions to the accusedno.1fortakingpropercareoftheinmateswhowere sufferingfromillnessordiseases.Itappearsthataccusedno.1 was not serious in taking care of the inmates. nohesitationtoholdthataccusedno.1committedmurderof Seeta by intentionally beating Seeta and illegally omitting to take proper care of Seeta and to give her timely treatment, madehermalnourishedandanemicandcontinuedbeatingwith full knowledge that she is weak and ailing and with full knowledge that beating to her may cause her death. As regards the points relating to abetment of sexual offences: 115. Attheoutset,asperExplanationtoSection107of

Indian Penal Code, any willful misrepresentation or willful concealmentofmaterialfactwhichheisboundtodisclose,also comewithinthecontoursof'abetment'.Undisputedly,accused no.9iswifeofaccusedno.1andaccusedno.5ishisdaughter. and PW.18 stated that she was good. No allegations at all againsttheaccusedno.5,thoughshewasmadePresidentofthe KalyaniSansthain2010afterresignationofRamchandra(A/1), beingaGovernmentemployee. Hadshebeeninvolvedinthis casebyillegalomissionbyconcealingthefactsofrapebyhis fatheronthevictims,thevictimscouldnothavestatedhertobe good. She might not be liking all such illegal and immoral activitiesofherfather,butbeingthedaughter,shewashelpless. Shewasknowingabouttheriskindisclosingthesefacts,which mayruinherparentalfamily. Attherelevanttimeshewasof teenageonly. Itcannotbesaidthatitwasherlegaldutyto reporttothepoliceaboutthecriminalactivitiesofherfather. Shewasunderundueinfluenceofherfather.Wecannotbrand herasabettedherfatherbywayofillegalomissions. Insuch circumstances,itisnecessarytogiveherthebenefitofdoubt. 117. As regards accused no.9, PW.18 does not say

anythingaboutherexceptthatshewasmakingthegirlstodo domestic work like washing, mopping, cleaning, etc. PW.17 deposedthatMummy(A/9)wasgood.Itcannotbesaidthatit washerlegaldutytoreporttothepoliceaboutthecriminal

activitiesofherhusband.Beingwife,shemaynotbelikingthe sexualactivitiesofherhusbandwithyounggirlsinherhouse itself. Again,shewashelpless. Nobody,woulddareinsuch circumstancestodiscloseatthecostofmarriedlife.Shewas themotheroftwochildren.Onedaughterandoneminorson. Herdaughterwasrecentlymarried. Hersonisschoolgoing. Shewasthevictimofcircumstances.Shecannotbebrandedas the accused by way of abetment and illegal omissions. Furthermore,PW.9SheelGaikwad,theneighbouringwitnessof Khanda colony deposed that on the day when the girls were shifting from Khanda colony by the Police there was a big quarrelintheirhousetill12.00inthenight.Fromthisitcan be inferred that the wife(A/9) and the daughter(A/5) of accusedno.1mightbescoldingaccusedno.1forallhisillegal activities.Insuchcircumstances,Idonotfindthatboththese accusedpersonsareliableu/s.376(2)(c)r/w.s.109,376(2)(g) r/w.s.109,377r/w.s.109,u/s.467,468,471r/w.s.34ofIPC and u/s.23 of the Juvenile Justice (Care and Protection of Children)Act,2000. 118. Asregardsaccusedno.6whowasjoinedascookand

physicallydisabledandorphaninmates.Onthecontrary,ithas clearlycomeonrecordthataccusedno.1andaccusedno.6were havinggoodrelationsandtheywerehuggingandkissingeach other.Once,PW.18andPW.17hadseenaccusedno.1,hugging and kissingaccusedno.6. This showsthat she was not only abettingaccusedno.1indoingsuchactivitiesbutsurrendered herselftothelustofaccusedno.1also. Thisisactuallyvery shocking.Therewasnohelplessnessonherpart.Shewasnot thevictimofcircumstances. Shewasphysicallyexploitingthe inmates. PW.18testifiedthataccusedno.6wasnotdoingany workandonlyeatingandputtingonweight. Sheusedtoget doneallworkofwashing,sweeping,etc.fromthegirls. Ido not find that she was innocent in not disclosing the criminal activitiesofaccusedno.1.TherecordoftheSanshaseizedfrom the spot shows that initially many employeeshadjoinedand left.However,accusedno.6andno.10wereworkingsincemany years.OnceAccusedno.6hadleftandagainjoined. Thishas come in the cross examination of PW.18. the accused no.6 abettingaccusedno.1todoalltheseactivities.Inviewofthe above circumstances, I found accused no.6 is responsible for abetmentbyconcealingtheillegalactivitiesofaccusedno.1and therebyfacilitatingaccusedno.1andtheotheraccusedpersons forcommittingthecrime. 119. Asregardsaccusedno.10,shewasthecaretaker.It

was her duty to take care of the physically and mentally disabledinmates. Whattypeofcareshewastaking,Idonot understand. She was illiterate. She was old and was having

habit of chewing tobacco. She used to force the girls for chewingtobacco. Accusedno.1hasdeliberatelykeptthislady as acaretaker. She was assistingaccused no.1inconcealing such acts. It cannot be said that since many years she was unknowntothesaidactsofaccusedno.1.Shewasresidingin thesamepremises.Accusedno.1usedtogetupthegirlsduring nightandusedtopulltheirhandsandusedtotakethemto upstair,thegirlsusedtoweep,accusedno.1usedtobeatthem, accusedno.1andno.3usedtopourliquorforciblyinthemouth of the girls, the girls used to feel giddiness, in such circumstancesitcannotbesaidthataccusedno.10wasunaware aboutalltheseactivities.Shecannotdenyherknowledgeabout it. Beingthecaretaker,itwashersolemndutytotakecareof thegirls. However,byillegalomissions,sheindirectlyabetted andfacilitatedaccusednos.1,3and4indoingsuchacts. 120. At23places,ithascomeintheevidenceofPW.18

thatwheneverthereusedtobenobodyinthehouse,heusedto dosuchacts. Here,nobodydoesnotmeantoincludeaccused nos.6and10. BeingSuperintendentandCaretaker,theyhave tobethereforthewholetime.Fromthematerialonrecord,I findinvolvementofaccusednos.6and10intheabetmentof crime by accused nos.1, 3 and 4. I answer these points accordingly. Astopointrelatingtoforgeryagainstaccusednos.1,2 and5. 121. As to points relating to the forgery of documents,

TheprosecutionexaminedPW10,Mr.Kuvalekar.However,the prosecution could not bring on record the original document whichisallegedtobeforged.Theaccusedno.1obtainedthe registration of the Sanstha by suppressing the fact of his employment in central Railway. However, in the absence of forged document before the court, the accused persons are entitledtobeacquittedintheseoffences.Hence,Ianswerthis pointaccordingly. 122. TheprosecutionalsoexaminedDr.HarishShettyas

PW11,thepsychiatrist,whohasdonepsychiatryevaluationof theinmates. HedeposedthathisqualificationsareM.B.B.S., MDinpsychiatry,Diplomainpsychologicalmedicineandpost graduatediplomaincomparativemythology,allfromMumbai University.Hestartedworksince1989andextensivelyworked withchildren,bothnormalanddisabledacrossthecountry.He looked at the Human rights of children, fought cases against schools and institutions. He also counseled children after the earthquakeatLatur,aftertheriotsatGujarat,afterthefloodsin Bombay and many other disasters including Afghanistan and Pakistan. 123. He further deposed that he has interacted the

children.Theinitialopinionaboutthemwasthattheywerevery scared,sad,theirsleephadgonedown,theirappetitehadgone downandtheycomplainedaboutsexualabuseintheirearlier home. This was physical and psychological observation. The girlswereverytraumatisedandtheyfeltimmediatelythatthey

requiredcounseling, psychotherapyandrehabilitation.They hadalotofmemoriesaboutmolestationandtherape.Theyhad lot of anger against those who had molested them and they spokeaboutveryvividlywithverbalandnonverbalgestures. 124. He further deposed that a physician conducts

examination with instruments like stethoscope, hammer, etc. similarly,theytakeadetailedhistorythroughdifferentmethods anddoamentalstatusexamination. Theyrepeatthismethod toverifytheconsistencyoftheinformation. Theycallitasa psychiatric examination and mental status examination. The other method they adopted were that they allowed them to sing,draw,playandotherprojectivetestswhichhelpedthemto get detailed understanding of the child. They sat with the childrenandestablishedrapportwiththemandlistenedtotheir conversationwithoutinterruptioninthefirststage.Thenthey madegeneralinquiriesandelucidateinformationwhichwere deeper.Astherapportwasbuiltgraduallywiththesemethods, they got a detailed history. They also provided them with simplereassurancethateverythingwillbeokay. Theyallowed thechildrentouseclayandcrayon.Theyalsoprovidedpictures ofmenandwomenandaskedthemtodescribewhattheyfeel aboutit.Alotofdarkcolourswereused.Alotofangerwas shownonthesexualpartsofthemenandtheyusedthepencils veryroughlyonthesexualorgansonthepicturesofthemen. With the clay they were angry. A lot of anger and fear was projected. A lot of names of the alleged molestators were coming.TheyusedalotofsexualidiomsinMarathiandHindi.

TheentireconversationwasinHindiandMarathi.Dr.Shetty furtherdeposedthatinthefieldofpsychiatry,theyaretrained to understand non verbal expressions. After examination, he gavehisreportof11childrenEx.97colly..ThereportsofDr. Shetty also corroborates the evidence of victims before the court.ThisistheadditionalreasonwhythevictimPW18,the mutewitnessshouldnotbebelieved. 125. Furthermore, the prosecution also examined the

medical officers PW15 and PW 20, who have examined the accusedpersonsandgavethereportsthattheyarecapableof performingsexualintercourse. 126. The prosecution also examined both the

investigationofficersPW14PIShri.ShuklaandPW21ACPMs. RashmiKarandikarandtheydeposedbeforethecourtaboutthe investigation they had done in this case. Their testimony is formalinnature. 127. Inadditiontotheabovethefollowingaretheother

additionalincriminatingcircumstancesbroughtonrecord. Medicalreport(Ex.101colly)abdomenaloperation (accesstouterus)ononeoftheinmates,Jyoti. InMenstrualCycleregister(Art.197)thenameof Jyotiisnotmentioned. Whichconfirmstothefact that hysterectomy operation was performed on Jyoti. As per Government Resolution, the hysterectomy

operation on the mentally challenged without permissionisprohibited. The open tares of the row house was covered to facilitatedoingthesedegradingacts. Theaccusedno.1and3usedtopourliquorforcibly inthemouthofinmatestofillthemgiddinessandto facilitatetherape. Some sedative substance used to be put on the sweetstofeeltheinmatesgiddinessandtofacilitate thecrime. The accused no. 1 was residing in the same premises. He had full opportunity to have easy accesstoalltheinmates. All most all the inmates, except Anamika, were mentallysubnormal,theycanbeeasilyexploited. TheproposedunderconstructionsiteatWakdiwas alsousedforthispurpose. Theinmates,physicallyandmentallydisabledwere usedtobetakenthereforlabourworkandaccused no. 1 alongwith his autowala friend used to consumeliquorthere andusedtosatisfytheirlust fromthesevulnerableandhelplessgirls. Allthegirlswereorphansandsolelydependenton theaccusedno.1forfood,shelterandclothingsand thereforecouldnotraisevoiceandbearingallsuch inhumanitysinceyearstogether. The girls were under constant duress and threats,

theywerenotdaringtoopentheirmouthandair theirplightbeforeanybody. Beingphysicallyandmentallydisabled,leftbytheir cruelparents,theywereunderthetotalcontroland mercyofA/1oftheSanstha. AllthegirlsweresentattheSansthaattheirtender ages. During the period of 34 years, five inmates were diedandtwoescaped.Thisshowhowaccusedno.1 was careless in maintaining these special kind of inmates.Whatwastherealcausefortheirdeathsis mysterious. Hugecorrespondenceseizedfromthespotshowhis modalitiestocollecthugedonationsfromnational and international institutions by gaining sympathy beingGodfatheroforphansdedicatedhislifeforthe causeoforphans. Accused no. 2, being the journalist of the leading newspaperandtheSecretaryofKalyaniSanshawas givinghugepublicityinthenewspapersaboutthe dedicationoflifebytheentireKaranjulefamilyfor thecauseofmentallychallengedorphangirls. Manycorrespondencewiththegovernmentofficials forsanctioninggrantswithoutobservingthenorms ands rules for establishment of the institution for children. Very intelligently accused no. 1 employed an

illiterateMavleAjji,anoldladyandonemuteand mentallysubnormalgirlManishaascaretakersfor theinmatessothathecouldconvenientlycarryhis illegal and immoral activities without any hindrance. PW18 took the names of only those girls, whose agesaspermedicalreportsareintherangeof16to 18 years in comparision with the other girls. This showsthataccusedno.1and3weredoingallthese immoralactivitieswithbiggirls.Thisisalsooneof theimportantcircumstancetorelyonthetestimony ofPW18. Not a single inmate was sent to the adults institutionafterattainingtheageof18yearsprima facie he had apprehension of his misdeeds being disclosed. Government officers visit register (art) shows during their visits in Jan 2005, twice the accused no.1was askedtoarrangeforsendingoneofthe inmatesSeetawhohascompletedherage18years tootherinstitutionortoarrangetogetheragelimit extended. NextyearSeetawasmurdered. Mayekar, the friend of accused no.1 undisputedly, usedtocometothepremises.Allthethreevictims identifiedhimasmolebelowhiseyeandtall.PW18 andPW19alsoidentifiedhimbythephotograph.

Accused no. 2, the nephew of accused no. 1 was residingintheneighborhood.HeusedtocallPW18 fordomesticworkinhishouse.Hiswifeisworking inpolicedepartment.Hehadchancetooutragethe modesty of PW18 in his house. Had PW18 been tutored, she would not have taken the name of accusedno.2for354only. Evenwhenaccusedno.1gavemoneytoPW18for notdisclosingtheincidenttoanybody,shedidnot keepitandgaveittomummy(A/9) PW18, being sane, avoid toeat sweet mixed with intoxicantusedtowatchthediabolicactsofaccused no.1pretendingtobesleepingetc. Allthegirlswereinthecustodyofaccused.Hewas inthelocoprenticeposition.Hewasundergreater responsibilitytotakecareofthegirls.

Surprisingly, during the period of 34 years, six

inmatesdiedattheorphanagewhiletwowentmissingofwhom one was later found dead. CWC who is the district parental authorityoftheChildinneedofcarewasneverinformedabout these deaths or missings deliberately so that no actions are initiatedagainsttheaccused.Periodicalmedicalcheckupofthe girls were not carried out. Register of MC were not properly maintained. The Government officeswere alsomanaged. The Probationofficerusedtogiveperiodicalvisit,butinacasual manner without any instinct to do the work for which he is appointed and getting salary. His report in the visit register

appears in a casual manner without verifying the facts and compliance with the earlier instructions. Just for the sake of name,Dr.AmitShingare(BAMS)wasshowntobeattachedto the orphanage. His name is also appearing on the board displayedintheentryasoneofthepatrons.Notonlythis,Dr. AmitShingarealsoallowedthenameofhisdoctordaughterto beusedasattachedtotheSantha.Veryintelligently,theaccused whoisinfactagovernmentservant,managedtotakecontrolof thisshelterhousefromtheerstwhileAnandSansthawithout formally registering the transfer of the inmates to the new Sanstha.Healsoflawedwithallthelawsandregulationsmeant tomanageanorphanage.Henotonlysexuallyabused,harassed andphysicallyassaultedthehelplessgirlsbutalsowentonto theextentofconcealingrecordsofthe7girlswhohaveeither diedordisappearedsincethestartingoftheSanstha.Accused no.1wasgainingsympathyofthepeoplebyposinghimselfas doing noble cause for the mentally challenged destitute. Aaccusedno.2hisnephew,thejournalistwasgivingpopularity inthenewspaperposingthattheKaranjulefamilyhasdedicated theirentirelifeforthecauseofmentallychallenged.Thegirls were illiterate. Since childhood they were in the custody of accusedno.1.Theyhadnotseentheoutsideworld.Theywere notinapositiontotalkeitherinHindiorinMarathilanguage properly. The court noticed, they were using mix language indicatingthattheydidntevenknowtheiroriginallanguage. Viz.Anamikamazibachapansesaheliaahe.Theywerealoof fromthesociety.Itisalsoobservedthatoneofinmateswhowas basically a mute (deaf and dumb) girl but with very normal

senseswasalsokeptamongstthementallychallengedinmates whereastherearespecialinstitutionstoeducateandupliftthese specialkindofpeople.

With this I have no hesitation to hold that the

prosecution could prove the charges of rapes, murder, gang rapes,sodomy,attempttomurder,physicaltortures,intoxicating liquor etc against accused no. 1, charges of gang rapes and intoxicatingliquoragainstaccusedno.3,chargeofrapeagainst accusedno.4,chargeofoutragingthemodestyagainstaccused no.2andchargesofabetmentofrapes,abetmentofgangrape, abetment of sodomy, physical tortures, against accused no.6 and10andchargeofattempttomurderagainstaccusedno.6 and charge of culpable homicide not amounting to murder againstaccusedno.10.

NowIpauseheretoheartheaccusedpersonsonthe pointofsentence. 130. IhaveheardtheLearnedSPPMs.RohiniSalianon

behalf of the State and learned all the defence counsels for accusednos.1,2,3,4,6and10andtheaccusedinpersons. 131. LearnedSPPpraysformaximumsentenceofdeath

penaltyforaccusedno.1.ShesubmitsthatKalyaniSansthawas the Horror house. Whom to blame ? Is it the mistake of childrenbornlikethat? Isitthemistakeofparents. Kalyani Home was the protection home for the mentally challenged.

Eventhe Parliament is taking cognizance and providing for deterrent punishment.Dayinanddayout,theincidentsofrapearebeing committed.Thereisnorespectforwomeninthesociety.Mind set needs to be changed. Deterrent punishment will send a messagetothepublicthatjudicialconscienceshallnotbetaken forgranted.Accusedno.1isnotentitledtoliveinthesociety. Itisaspecialcaseofitsowntype. He has not only exploited the vulnerable, defenceless physically disabled girls, but also exploited emotions of the donors. inthecustodyoftheaccused.Theywerenotallowedtomove around.The19girlsweredumpedinashoplikeenclosureof 250sftwhichhadnodoorsbutarollingshutter.Thegirlswere literally stuffed in the small room with no space to move around.Theinmateswerejustsurvivingandpullingtheirlives. TheyweredeprivedoftheverybasichumanrightslikeHealth, Educationetc.Neitherthestaffwastrainednortherewasany psychiatristforcounselingthementallychallengedinmates.The home was being run without any vision of upliftment or rehabilitating the inmates. The only objective behind running theorphanagewastosatisfythelustandtoearnmoney.The accusedno.1notonlyexploitedthegirlsforyearstogetherbut alsoallowedhisfriendstoexploitthegirls.Unfortunately,only threegirlsoutoftotalnineteencouldappearbeforethecourtto conveytheirplight.Thesehelplessgirlswerealwayskeptunder coercionandthreatsothattheyneverdivulgethebittertruth beforetheoutsideworld.Theproceedingsareuniqueandhave shownthevulnerabilityoftheorphans,especiallythephysically andmentallydisabledgirlsandtheneedfortheirprotection.It isrevealedtowhatextentpersonsprofessingtobegodfather couldscreenhistrueprofile.Butfortheexhaustinginspection bytheKonkanCommittee andtimelyactionoftheCWC,the wholeepisodewouldnothaveseenthelightoftheday..Allthe 19girlswereathisdisposalat24hours.Hewasdoingphysical intercourse by wearing condoms and he used to burn the condoms.Hysterectomyoperationwasalsoperformedonone oftheinmatesi.e.Jyotiwithouttakingpermissionandwithout showing emergency in doing so. One after another the girls

weredyingintheinstitution,buthehasnorepentance.Only the death of Seeta could come in the light. The victims are mentallysubnormalunabletosaytheirplight,eveniftheysay, duetotechnicality,thecourtisnotbelievingonthemasthey can not stand the questions put in cross examination. It was fortunate that Anamika was there and it was more fortunate thatherIQisnormal.

As regards the quantum of sentence, here it is

necessary to reproduce the relevant para in Dhananjoy Chatterjeevs.StateofW.B.(1994(2)SCC220). "15.Inouropinion,themeasureofpunishmentinagiven case must depend upon the atrocity of the crime; the conduct of the criminal and the defenceless and unprotectedstateofthevictim.Impositionofappropriate punishmentisthemannerinwhichthecourtsrespondto thesociety'scryforjusticeagainstthecriminals.Justice demandsthatcourtsshouldimposepunishmentfittingto thecrimesothatthecourtsreflectpublicabhorrenceof the crime. Intheinstantcase,multipleoffencespunishablefor

lifehavebeenprovedagainstaccusedno.1.Itisthecaseof custodial torture, custodial rape and the custodial murder. In D.K.Basuv.StateofW.B.thehonbleApexCourttooktheview thatcustodialtortureandconsequentialdeathincustodywas anoffencewhichfellinthecategoryoftherarestofrarecases. InIndia,mostofthechildrenincustodydiedofmalnutrition andtuberculosis.Nobodyistakingcognizanceofit.InIndia,the conceptofillegalomissionisnotdeveloped.Itisnotthatthe statuteisnotthere.Itisnecessarytochangethemindsetofthe people. Iwouldsay,suchkindofdeathsaremorediabolical thanthedeathsbyshootingandstabbing.Wehavetoimagine theconditionofthemute(deafanddumb)withseverementally challangedorphaninthecustodyofaccusedno.1,whoissevere anemicwith3.3hemoglobin,withmanycomplicationssince23 mothsandisdeterioratingdaybydayandisgivenbeatingand isnottakentothehospitaltillshereachesthedeathbed.Can wenotsayitasdiabolic.
