May 14, 2013VIA FIRST CLASS MAILFaith WaltersRe: COIB Case No. 2012-548Dear Ms. Walters:It has come to the attention of the New York City Conflicts of InterestBoard (“the Board”) that you violated the City of New York’s conflicts of interest law, contained in Chapter 68 of the New York City Charter (“Chapter 68”) and the Rules of the Board.You are employed by DOE as a Special Education Teacher. InFebruary 2011, you used a self-publishing company to release a book (herein,the “Book”). The Book contains the names of fifteen individuals identified asyour former students. You did not have permission from DOE, from thestudents’ parents or guardians, or from eligible students to publish their names. Pursuant to Chancellor’s Regulations No. A-820, the names of DOEstudents are confidential and not otherwise available to the public and mayonly be disclosed with prior written consent by the parent, guardian, or eligible student and then only in limited circumstances, none of which applyhere.The City’s conflicts of interest law prohibits public servants frommaking unauthorized disclosures of confidential information. Specifically,City Charter § 2604(b)(4) provides: “No public servant shall disclose anyconfidential information concerning the property, affairs or government of the city which is obtained as a result of the official duties of such publicservant and which is not otherwise available to the public, or use any suchinformation to advance any direct or indirect financial or other privateinterest of the public servant or of any other person or firm associated with
