4.1Generalprovisions
4.1.1Introduction
ThischapterprovidesinformationonthegeneralprovisionsandproceduresforimplementingtheUnitaryPlan. Itcontainsgeneralinformationon: activitiescontainedwithintheUnitaryPlanandhowtheyaremanaged theresourceconsentapplicationprocess decisionmakingonresourceconsents complianceandenforcementofresourceconsentsandUnitaryPlanprovisions. ImplementationoftheseprovisionsissubjecttotherequirementsoftheRMA,anyamendmentstotheRMA, andanyotherrelevantlegislation.

4.1.2Generaldutytocomply
CompliancewiththeUnitaryPlanandtheRMAdoesnotremovetheneedtocomplywithallotherrelevant acts,regulations,bylawsandrules.Itistheapplicant'sresponsibilitytoidentifyandunderstandall requirementstheyarerequiredtocomplywith. Wherecomplianceisrequiredunderanyotherlegislation,includingabylaw,itistheresponsibilityofthe applicanttocomplywiththatlegislation. Conversely,activitiesthathaveapprovalunderotherregulatoryrequirements,suchastheBuildingAct,may stillrequireresourceconsent. Everypersonhasadutytoavoid,remedy,ormitigateanyadverseeffectontheenvironmentarisingfroman activitycarriedonbyoronbehalfoftheperson,whetherornottheactivityiscarriedoninaccordancewith existinguserightsundertheRMA(s.10,10A,10B,and20A)oranationalenvironmentalstandard,arule,a resourceconsent,oradesignation.

4.1.3Interpretingtherules
1.Zones AlllandandcoastalwaterwithinAuckland,withtheexceptionofsomeroads,iszoned.Zonesareappliedto land/coastalwaterthathasasimilarsetoflandusesorcharacteristics,forexampleresidentialorindustrial areas.Zonescontainobjectives,policiesandrulesthatrelatetotheuseanddevelopmentofland/coastal water.AuseroftheUnitaryPlanshouldrefertothezoneprovisionsfirsttounderstandtherequirementsfora particularactivity. 2.Aucklandwideprovisions AucklandwideprovisionsapplytoactivitiesthatoccuracrossAucklandandacrossallofthezones.For example,theseincludecarparking,noise,landdisturbingactivitiesandsubdivision.TheUnitaryPlanuser shouldrefertotherelevantsectionsoftheAucklandwiderulesastheyrelatetotheproposedactivity. 3.Precincts Aprecinctisappliedtoanareawithinazonetoprovideforlocaldifferences.Precinctsvarytheactivitystatus

orthecontrolscontainedintheunderlyingzoneorAucklandwideprovisions.Theunderlyingzoneand Aucklandwideprovisionsapplyunlessvariedbytheprecinct. 4.Overlays Anoverlayisappliedacrosszones,precinctsandsomeoftheAucklandwideprovisionstorecognisethe particularvaluesassociatedwithanarea.Overlaysgenerallyapplymorerestrictivecontrolsthattheunderlying zone,precinctorAucklandwideprovisions,butinsomecasestheycanbemoreenabling. 5.Determiningactivitystatus Todeterminetheoverallactivitystatusofanactivity,theusermustreviewalltherelevantprovisionsthatapply tothesiteorproposeddevelopment,includingthezone,Aucklandwideprovisions,andanyrelevantprecincts oroverlays.Themoststringentactivitystatuswillapplyunlesstheprecinctoroverlayspecificallymakesthe sameactivitymoreenabling.

4.1.4Activities
Thetype,formandscaleofdifferentactivitiesarecontrolledbyrulesintheUnitaryPlan.Allruleswithinthe UnitaryPlanhavetheforceandeffectofastatutoryregulation.Oneofthecouncilsfunctionsistoimplement rules,andmattersonwhichrulesmaypertainto,areoutlinedins.30ands.31oftheRMA.Theyinclude someofthefollowingreasons: tomanagetheeffectsoflanduseanddevelopment toencouragetheefficientuseanddevelopmentofAucklandsnaturalandphysicalresources tomaintainandenhancethequalityoftheenvironment toensureappropriatedevelopmentonlandsubjecttonaturalhazards topreventandmitigateadverseeffectsassociatedwithhazardoussubstances tocontrolthesubdivisionofland tocontroltheemissionofnoiseandtomitigatetheeffectsofnoise tomaintainandenhanceamenityvalues. TheRMAclassifiesactivitiesintothefollowingtypes: permittedactivities controlledactivities restricteddiscretionaryactivities discretionaryactivities noncomplyingactivities prohibitedactivities. 4.1.4.1Permittedactivities ResourceconsentisnotrequiredforapermittedactivityifitcomplieswithalltherelevantrulesintheUnitary Plan.TheUnitaryPlanusesthisapproachtoprovideforactivitiestobecarriedoutasofright,providedcertain controlsaremet.Ifanactivitydoesnotcomplywithoneormoreoftherelevantcontrolsitisnotapermitted activity.Inthoseinstancestheactivitywillfallintooneoftheactivitycategoriesbelowandwillrequireresource consent. Existinguses TheRMApermitscertainexistinglanduses,whichwerelawfullyestablished,tocontinuedespitecontravening aruleintheUnitaryPlan.Theseactivitieshaveexistinguserights,butmustsatisfytheprovisionsoutlinedin s.10ands.20AoftheRMA. Itistheresponsibilityofthepersonclaimingexistinguserightstodemonstratetheycomplywith therelevantsectionsoftheRMA. CertificatesofCompliance(CoC) AnapplicationcanbemadetocounciltoobtainaCoCforapermittedactivity.ACoCcertifiesthatthe developmentisfullycomplying.Section139oftheRMAoutlinestheroleofconsentingauthoritiesand environmentalprotectionagenciesinissuingCoCs.ACoCistreatedasifitwasaresourceconsent. 4.1.4.2Controlledactivities Resourceconsentisrequiredforacontrolledactivityandconsentmustbegranted.TheUnitaryPlanprovides forcontrolledactivitieswheretheadverseeffectsofanactivitycanbemanagedthroughconsentconditions. Conditionscanbeimposedbutonlyforthosemattersoverwhichcontrolhasbeenreserved. 4.1.4.3Restricteddiscretionaryactivities Resourceconsentisrequiredforarestricteddiscretionaryactivity.Councilmayapproveordeclineaproposal forarestricteddiscretionaryactivity.TheUnitaryPlanspecifiesthemattersoverwhichcouncilhasrestricted itsdiscretion.Council'sconsiderationoftheproposal,andtheabilitytorefusetheapplicationandimpose conditions,isrestrictedtothesematters. TheUnitaryPlanusesthisapproachwhereitispossibletolimitdiscretiontospecificeffectsassociatedwith anactivityordevelopment,whichneedtobeassessed. 4.1.4.4Discretionaryactivities Resourceconsentisrequiredforadiscretionaryactivity.Councilmayapproveordeclineaproposalfora discretionaryactivity.Inassessingtheproposedactivity,councilcanconsiderallrelevantobjectivesand policieswithintheUnitaryPlan,allpotentialenvironmentaleffects,andanymattersoutlinedins.104ofthe RMAwithoutlimitationindecisionmaking. 4.1.4.5Noncomplyingactivities Resourceconsentisrequiredforanoncomplyingactivity.Councilmaygrantorrefusetheapplication.There areextratestsundertheRMA,whichcouncilmustconsiderwhenassessinganoncomplyingactivity. TherearetwotypesofnoncomplyingactivitiesintheUnitaryPlan: listedactivitiesthatarespecificallyidentifiedasnoncomplying activitieswhichdefaulttononcomplyingstatusbecausetheyarenotspecificallyprovidedforas permitted,controlled,restricteddiscretionaryordiscretionary. Rule:AnyactivitynotspecificallyidentifiedintheUnitaryPlanaspermitted,controlled,restricted discretionary,discretionaryorprohibitedisanoncomplyingactivity.

Proposalsfornoncomplyingactivitiesmustbeconsideredagainsts.104DoftheRMA.Thetwotestsofs. 104Dare: theadverseeffectsoftheproposeddevelopmentareminor,or theproposeddevelopmentisnotcontrarytotheobjectivesandpoliciesoftheUnitaryPlan. Iftheproposalmeetseitherofthetwotests,thentheabilitytograntorrefuseconsentunders.104hasbeen established. 4.1.4.6Prohibitedactivities CertainactivitiesareexpresslyprohibitedintheUnitaryPlan.Applicationcannotbemadeforaprohibited activityandcouncilcannotgrantresourceconsentforaprohibitedactivity.Prohibitedactivitiesareclearly identifiedthroughouttheUnitaryPlan. 4.1.4.7Overallactivitystatus Whereaproposalinvolvesmorethanoneactivitythesewillgenerallybebundledtogetherandassessedasa singleactivity.Generally,themostrestrictiveactivityclassificationwillapply.

4.1.5Designations
AdesignationisaprovisionintheUnitaryPlan(Part3)whichgiveseffecttoanoticeofrequirementforapublic workorprojectbyarequiringauthority.RequiringauthoritiesincludeaministeroftheCrown,localauthorityor approvednetworkoperator,andapublicworkorprojectcouldincludeaschool,policestation,road,park, transmissionslinesoraninfrastructuresystem. DesignationsintheUnitaryPlanincludeexistingdesignationsrolledoverfrompreviousdistrictplansintothe UnitaryPlaneither('withoutmodification'or'withmodification')andanynewnoticesofrequirementfora designationlodgedwithAucklandCouncil.Notethatnewnoticesofrequirementfordesignationsarenotshown inthedraftUnitaryPlan. Adesignationcan: 1.Enabletheuseoflandforapublicworkorinfrastructure 2.Restrictland,water,subsoil,orairspacewherethisisnecessaryforthesafeorefficientfunctioningor operationofapublicworkorinfrastructure 3.Requirewrittenapprovaloftherequiringauthorityresponsibleforthedesignationbeforeathirdpartycan undertakeandactivitywithinthedesignation. Furtherguidanceondesignations,requiringauthoritiesandthedesignationstheyareresponsibleforcanbe foundinthedesignationsectionoftheUnitaryPlan.

4.1.6ApplyingforResourceConsent
4.1.6.1Requirementforresourceconsent Resourceconsentisrequiredforanyuseofland,whichcontravenesaruleintheUnitaryPlanunless: resourceconsenthasalreadybeengrantedunders.9(1)(a)oftheRMA theusehasexistinguserightsunders.10ands.20AoftheRMA theuseisprovidedforbys.4(3)oftheRMA.Thissubsectionappliestotheworkandactivityofthe crownwithinareasoflandheldormanagedundertheConservationAct1987 theuseisapublicworkorprojectorworkundertakenbyarequiringauthorityunderadesignation.

4.1.6.3Makingaresourceconsentapplication Applicantsareadvisedtoconfirmwithcouncilstaffwhetherresourceconsentisrequiredforaproposedactivity andifso,whatspecificconsentsareneeded. Informationontheresourceconsentprocess,additionaltothatprovidedbelow,canbeobtainedfromcouncil andincludes: applyingforaconsent(includinginformationrequirementsandcouncilfees) notificationprocedures lodgingsubmissions conditionsofconsent changingorcancellingconditionsofconsent appealrights hearinganddecisionprocesses. Applicationsforresourceconsent,includingAssessmentsofEnvironmentalEffectsmustbemadeina prescribedmanner.Thisisoutlinedins.88oftheRMAandthefourthscheduleoftheRMA.Councilandthe publicusethisinformationtounderstandtheproposalanditspossibleeffects.Part4.1.17Information requirements,outlinesthegeneralinformationrequirementstobeprovidedwithallapplications,alongwith specificinformationrequirementsforcertaintypesofconsentapplications.Councilcanrejectanapplicationif thereinsufficientinformationprovided.

Anumberofstepsoccurbeforeadecisiononaresourceconsentapplicationismade.Theseinclude: preapplicationmeetingswithcouncil checkingtheadequacyoftheinformationsuppliedwithanapplicationforconsent reviewingtheassessmentsofeffectsontheenvironment decidingwhethertheapplicationshouldbenotifiedornot ifrequired,arrangingnotification,receivingsubmissions,andarrangingprehearingmeetingsand hearings. TheRMAsetstimelimitsforthevariousstepsandaclearstructureforeachsteponcetheresourceconsent applicationislodged. LodgementofApplications Section88oftheRMAgivescouncilfiveworkingdaystocheckanapplicationforcompletenessandthe adequacyofinformation,andtodeterminewhethertoacceptorrejecttheapplication.Iftheapplicationis rejected,thentheapplicationisreturnedtotheapplicantwithawrittenexplanationoftheinformationrequired whenrelodgingtheapplication. Furtherinformation Thecouncil,unders.92oftheRMA,mayrequestanapplicanttoprovidefurtherinformationshoulditfeelthis isneededtobetterunderstandthenatureoftheactivity,theeffectitmayhaveontheenvironment. Thecouncilmayalsocommissionareport,attheagreementandexpenseoftheapplicant,onanymatters raisedinrelationtotheapplicationorintheAssessmentofEffectsontheEnvironment.Areportmaybe commissionedwhere: theapplicationincludesnaturalhazards theapplicationincludesuseorstorageofhazardoussubstances theactivitybeingappliedformaycausesignificantadverseenvironmentaleffectswhicharenot adequatelyremediedormitigatedthroughtheproposal. Arequestforfurtherinformationwillresultintheapplicationbeingonholdandtheprocessingtimeframe stoppeduntiltheinformationisreceivedandassessedasbeingadequate. Consentapplicationsacrosssiteswithmultiplezones Wheresiteshavetwozonesapplyingtoit,eachpartofthedevelopmentmustcomplywiththerulesapplying tothezoneinwhichthatparticularpartofthedevelopmentislocated.Whereadevelopmentcontrolreferstoa percentageofthesite,thecontrolwillbelimitedtothatpartofthesitetowhichthezoneapplies.

4.1.7Landuseanddevelopmentcontrols
4.1.7.1Landusecontrols TheUnitaryPlansetslandusecontrolstomanagetheeffectsoflanduseactivitiesontheenvironment.Land usecontrolsareatypeofruleandsetstandardsfor: conservationandamenitymatterssuchasnoise,earthworksandvegetationclearance activitiessuchasvisitoraccommodationandcommunityfacilitieswheretherearecontrolsonthe numberofpeopleandhoursofoperation. 4.1.7.2Developmentcontrols TheUnitaryPlansetsdevelopmentcontrolstomanagetheeffectsofbuildingsanddevelopmentonthe

environment.Developmentcontrolsareatypeofruleandsetstandardsforsuchmattersas: theheightofbuildings thebulkandlocationofbuildings(distancefromtheboundary,buildingcoverage). Rule:Permitted,controlledandrestricteddiscretionaryactivitiesmustcomplywiththelanduseand developmentcontrolsapplyingtotheactivity. 4.1.7.3Infringements Controlsaregenerallyappropriateformostdevelopments.However,noteverydevelopmentcontrolwillbe appropriateforeverysiteandeveryproposal.Insomecircumstances,thecharacteristicsofasitemaymake strictcompliancewiththedevelopmentorlandusecontrolsinappropriateorunnecessary. Infringementstodevelopmentorlandusecontrolsareconsideredasapartoftheresourceconsentprocess. Thisapproachmeansthattheparticularcircumstancesofthesiteandtheproposalcanbeassessedonits merits. Rule:Apermitted,controlledorrestricteddiscretionaryactivitythatdoesnotcomplywithoneormoreland useordevelopmentcontrolsisarestricteddiscretionaryactivityunlessotherwisestatedintheUnitaryPlan. 4.1.7.4Assessmentcriteriasiteconstraints Inassessingdevelopmentcontrolinfringements,thecouncilwillconsiderthefollowingmattersinadditionto anymattersspecifiedfortheparticulardevelopmentcontrolinfringementinthezone,precinctoroverlay. Inconsideringaresourceconsentapplicationforadevelopmentcontrolinfringement,thecouncilwillassess whetherthesitehasanyunusualfeaturesorparticularcharacteristicsthatmakecompliancewiththe developmentcontrolunnecessary,suchas: unusualsize,shape,topography,substratum,soiltype,vegetationornaturalhazardsusceptibility adversetopographyortheunusualuseorparticularlocationofbuildingsonneighbouringsites thelocationofexistingbuildingsortheirinternallayoutandwhethertheproposalwillpreserveprivacy, enhanceprivateopenspaceoroutlookorprovidepublicfacilitiesorotherpublicbenefit extraordinaryvehicleorpedestrianmovement,includingwhetherabetterrelationshipbetweenthesite andthestreetintermsofamenityandsafetycanbeachievedthedevelopmentcontrolinfringement achievestheoutcomessoughtbythedevelopmentcontrolwhilemakingapositivecontributiontothe siteandneighbourhoodbyimprovinglivability,amenityorvisualappearance.

4.1.8Assessment
Proposalsareassessedtoensurerobustdecisionmakingonresourceconsentdecisions.Mattersfor assessmentarecontainedthroughoutrelevantsectionsoftheUnitaryPlan. Proposalsmaybeassessedagainstthefollowing: alignmenttorelevantobjectivesandpolicies assessmentcriteria. Assessmentcriteriaarespecifictoanactivity.Criteriamayaddresssomeorallofthefollowingmatters: effectsonthenaturalenvironment character/heritage/landscape sitelayoutandbuildingdesign carparking,loadingandaccess effectsonresidentialamenity siteconstraints.

Whenassessingadiscretionaryactivitytherestricteddiscretionaryassessmentmattersmaybeusedasa guidefordecisionmaking.

4.1.9Notification
Anotificationdecisionisrequiredonallresourceconsentapplications.Councilhasdiscretiontonotifya resourceconsentapplication.Theprocessandrequirementsfornotificationarecontainedins.95A95Gofthe RMA. Rule:Controlledandrestricteddiscretionaryactivitieswillbeconsideredwithoutpublicorlimitednotification, ortheneedtoobtainwrittenapprovalfromaffectedparties,unlessotherwisespecifiedintheUnitaryPlanor specialcircumstancesexistinaccordancewiths.95A(4)oftheRMAthatmakenotificationdesirable.

4.1.10Decisionmakingonresourceconsentapplications
Decisionsonresourceconsentapplicationswillgiveregardtothefollowing: actualandpotentialeffectsontheenvironment relevantprovisionswithintheUnitaryPlanandothernationalstandardsorregulations anyothermatterdeemedrelevantorreasonablynecessarytodeterminetheapplication. Thefullobligationsofcouncil,inconsideringanapplicationforresourceconsent,arecontainedins.104ofthe RMA.

4.1.11Conditions
Ingrantingresourceconsent,councilmayimposeconditions,restrictionsandprohibitions,includingbutnot limitedto: serviceorworktoremedyormitigateadverseeffectslikelytoarisefromtheactivity,suchasriparian management,naturalresourcemanagement,protectionorrestorationofnaturalenvironments bondsorcovenants,orboth,toensureperformanceorcompliancewithimposedconditions financialcontributionsintheformofmoneytomitigateanyadverseeffects conditionsrequiringtheconsentholdertocarryoutcertainmonitoringregardingtheeffectsoftheir activities amalgamationoftitles modificationsorremovalofexistingbuildings modificationstotheextentoftheactivityinitiallyappliedfor thereviewofconsentconditionsunders.128 anyotherconditionthatcouncilconsidersappropriate. Furtherinformationoncouncilsscopetoimposeconditionsonaresourceconsentiscontainedins.108of theRMA. 4.1.11.1Changestoconditionsorcancellation Onceresourceconsentisgranted,anapplicationmaybemadetocounciltochangeorcancelanycondition imposedonanactivityaspartoftheconsentunders.127oftheRMA.

4.1.12Hearings,objectionsandappeals
Hearingsmaybeheldwhensubmissionshavebeenreceivedonaresourceconsentapplication,planchange,

reviewoftheUnitaryPlanornoticeofrequirement.Duringahearingtheproposalandsubmissionsarereviewed andadecisionismadeontheproposal.Sections3942A,100103,169andthefirstscheduleoftheRMA outlinethehearingprocessandcouncilsobligationsrelatingtothatprocess. AnappealmaybemadetotheEnvironmentCourtagainstthewholeoranypartofacouncildecisionona resourceconsentapplication.Sections120,121andthefirstscheduleoftheRMAoutlinetheprocessfor appeals.

4.1.13Lapsingofaresourceconsent
Ifnolapsedateisspecifiedintheresourceconsentitwilllapse: afterfiveyearsiftheconsentdoesnotauthoriseaquacultureactivitiestobeundertakeninthecoastal marinearea afterthreeyearsiftheconsentdoesauthoriseaquacultureactivitiestobeundertakeninthecoastal marinearea. Theresourceconsentwillnotlapseif: theresourceconsenthasbeengiveneffectto,or anapplicationismadetothecounciltoextendtheperiodafterwhichtheconsentlapses,andthe consentauthoritygrantstheextension.

4.1.14Feesandcharges
Section36oftheRMAenablescouncilstochargeapplicantsforreceiving,processingandgranting(including declining)consentsandconsentholdersforadministering,monitoringandsupervisingconsents. Council'spolicyisthatapplicantspaythecostsofprocessingallconsentapplications.Thisisprovidedfor undertheRMA.Youwillpayadepositwhenyousubmitanapplication.Onceadecisionhasbeenmade,ifthe totalamountismorethanthedeposityouwillbeaskedtopaythebalanceofcostsinvolvedinprocessingyour application.Ifthecostsarelessthanthedeposit,youwillbegivenarefund. Thetotalamountwillvarydependingonmanyfactorsincludingtheaccuracyandamountofinformationyou provide,thenumberofdifferentexpertswhoneedtobecomeinvolvedandwhetherornotyourapplicationis notified. Theactualandreasonablecostsarethecostofcouncilstafftimeplustheactualcostofanydisbursements. Stafftimeiscalculatedaccordingtoascheduleofhourlyrates. Forascheduleoffeesandchargesassociatedwithresourceconsentapplicationpleasecontactcouncil. ResourceconsentapplicationsforactivitieslistedintheTreeProtectionoverlays,SignificantEcologicalAreas overlayandforthemaintenanceandmodificationofheritagebuildingswillnotbechargedanapplicationfee unlesstheactivityisassociatedwithproposednewdevelopment.

4.1.15Enforcement
CouncilisrequiredtomonitorcompliancewiththepoliciesandprovisionsoftheUnitaryPlanandcompliance withresourceconsentconditions.Monitoring,complianceandenforcementofficersareengagedforthis purpose.

4.1.15.1Infringementnotices Noncompliance,withaconditionofaresourceconsentoraprovisionintheUnitaryPlan,isconsideredan infringement.Ifapersonhascommittedanallegedinfringement,theymayeither: faceproceedingsundertheSummaryProceedingsAct1957 beservedwithaninfringementnotice.
