ENGROSSED HOUSEJOINTRESOLUTION NO. 1003By:Key, Reynolds, Peterson,Faught, Tibbs, Sanders,Moore and Kern of the HouseandBrogdon of the SenateA Joint Resolution claiming sovereignty under theTenth Amendment to the Constitution of the UnitedStates over certain powers; serving notice to thefederal government to cease and desist certainmandates; providing that certain federal legislationbe prohibited or repealed; and directing distribution.WHEREAS, the Tenth Amendment to the Constitution of the UnitedStates reads as follows:"The powers not delegated to the United States by theConstitution, nor prohibited by it to the States, are reserved tothe States respectively, or to the people."; andWHEREAS, the Tenth Amendment defines the total scope of federalpower as being that specifically granted by the Constitution of theUnited States and no more; andWHEREAS, the scope of power defined by the Tenth Amendment meansthat the federal government was created by the states specificallyto be an agent of the states; and

WHEREAS, today, in 2009, the states are demonstrably treated asagents of the federal government; andWHEREAS, many federal laws are directly in violation of theTenth Amendment to the Constitution of the United States; andWHEREAS, the Tenth Amendment assures that we, the people of theUnited States of America and each sovereign state in the Union ofStates, now have, and have always had, rights the federal governmentmay not usurp; andWHEREAS, Article IV, Section 4 says, “The United States shallguarantee to every State in this Union a Republican Form ofGovernment”, and the Ninth Amendment states that “The enumeration inthe Constitution, of certain rights, shall not be construed to denyor disparage others retained by the people”; andWHEREAS, the United States Supreme Court has ruled in New Yorkv. United States, 112 S. Ct. 2408 (1992), that Congress may notsimply commandeer the legislative and regulatory processes of thestates; andWHEREAS, a number of proposals from previous administrations andsome now pending from the present administration and from Congressmay further violate the Constitution of the United States.NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVESAND THE SENATE OF THE 1ST SESSION OF THE 52ND OKLAHOMA LEGISLATURE:THAT the State of Oklahoma hereby claims sovereignty under theTenth Amendment to the Constitution of the United States over allENGR.
