MANCHESTER COMMONS HOMEOWNERS ASSOCIATION, INC.Administrative Resolution No. 2008-01Parking Lot Rules and Regulations and RemediesWHEREAS
, Article II, Section 1(c) of the Declaration of Covenants, Conditions and Restrictions for ManchesterCommons Homeowners Association, Inc. (Association) authorizes the Board of Directors of Manchester CommonsHomeowners Association, Inc. (Board) to establish uniform rules and regulations pertaining to the use of thecommon area and facilities; and,
WHEREAS
, Article VII, Section 1(a) of the Bylaws for the Association also states that the Board shall have powerto adopt and publish rules and regulations governing the use of the common area and facilities; and,
WHEREAS
, Article VII, Section 1(g) of the Bylaws for the Association also states that the Board shall have powerto cause the removal of any vehicle that is improperly parked; and,
WHEREAS, the Virginia Property Owners’ Association Act requires the Board of Directors, § 55-513(A), toformally adopt and publish a written resolution to enact this power granted to community associations by theGeneral Assembly of Virginia; and,WHEREAS, the Property Owners’ Association Act of the Virginia Code, § 55-513(B), provides the Board of Directors with the power to assess monetary charges against members of the Association as a means of enforcement of the Declaration or Regulations of the Association; and,WHEREAS
, in order to assure equitable parking for owners, residents and guests as well ensure their safety, theBoard wishes to adopt a policy governing parking practices;
NOW, THEREFORE, BE IT RESOLVED
that the following Rules and Regulations and remedies are establishedfor the orderly use of parking in the common areas of the Association:
1. Parking Regulations.

Parking Lot Use.
The use of the Manchester Commons Parking Lot (Parking Lot) is restricted to ManchesterCommons Residents and their guests.b.
 
Reserved Parking Spaces.
Each Unit is assigned two reserved parking spaces. The Residents of each Unithave the right to have unauthorized vehicles towed from their assigned parking spaces. To have a vehicletowed from your assigned parking space, call the Manchester Commons Authorized Towing Agent. The callermust provide name, address, parking space number, and the description and license plate number of theunauthorized vehicle. When the tow truck arrives, the Resident must provide the driver with photoidentification and sign the towing slip.Although Residents have the right to have vehicles towed from their assigned parking spaces, Residents areencouraged to be neighborly and use towing as a last resort. The Board will not intervene in individualsituations regarding assigned parking spaces.c.
 
Extended Visitors.
Any visitor that consistently uses the Parking Lot for a period longer than two (2) weekswill be defined as a Resident for purposes of enforcement of any Parking & Vehicle Regulations specified in theAssociation’s governing documents. In other words, these vehicles will be treated the same as a Resident’svehicle, subject to the same Rules and Regulations.d.
 
Visitor Spaces.
There are only ten clearly marked visitor parking spaces in the Parking Lot. These spaces arefor the use of short-term guests and not for “overflow” vehicles (i.e. households with more than two vehicles).The Parking Lot cannot accommodate more than two Resident vehicles per Unit.
