SUMMARY

The Conservation SecurityProgram (CSP) is authorized by TitleXII, Chapter 2, Subchapter A, of theFood Security Act of 1985, as amended by the Farm Security and RuralInvestment Act of 2002. The NaturalResources Conservation Service (NRCS)published an advance notice of proposed rulemaking for CSP onFebruary 18, 2003, (68 FR 7720), with acomment period expiring March 20,2003. NRCS is hereby extending theperiod during which it will acceptpublic comment on the advance noticeof proposed rulemaking for CSP to April3, 2003. This extension is to give thepublic an additional opportunity tocomment on key issues that have beenraised regarding the implementation of the program.

, we are approvingthese local rules and rule recission in adirect final action without priorproposal because we believe these SIPrevisions are not controversial. If wereceive adverse comments, however, wewill publish a timely withdrawal of thedirect final rule and address thecomments in subsequent action basedon this proposed rule. Please note thatif we receive adverse comment on anamendment, paragraph, or section of this rule and if that provision may besevered from the remainder of the rule,we may adopt as final those provisionsof the rule that are not the subject of anadverse comment.We do not plan to open a secondcomment period, so anyone interestedin commenting should do so at thistime. If we do not receive adversecomments, no further activity isplanned. For further information, pleasesee the direct final action.

Notice of final decision to adopt the NorthAmerican Industry ClassificationSystem (NAICS) for the United States.NAICS is a new industry classificationsystem that will replace the StandardIndustrial Classification (SIC) systemthat has traditionally been used bygovernment agencies for collectingstatistical data and for otheradministrative and regulatory purposes.Under section 313 of the EmergencyPlanning and Community Right-to-Know Act of 1986 (EPCRA) and section6607 of the Pollution Prevention Act of 1990 (PPA), facilities that are classifiedin specified SIC codes are subject toToxics Release Inventory (TRI)reporting. In this notice, EPA isproposing to include in the regulationsthe NAICS codes that correspond to theSIC codes that are currently subject tothe TRI reporting requirements. EPA isalso proposing that faciliteis that aresubject to TRI reporting requirementsreport both SIC and NAICS codes onEPCRA section 313 reporting forms forthe first full reporting period after theeffective date of the final rule.Thereafter, facilities that are subject toTRI reporting requirements would berequired to report their NAICS codesonly. Finally, EPA is proposing toamend the regulations to extend theexemption provided therein to ownersof covered facilities who lease, with noother business interest, such facilities tooperators of establishments that areclassified in any SIC code or NAICScode that is subject to TRI requirements.EPA is soliciting comments on theseproposals and on a list of NAICS codesthat will correspond to the SIC codesthat are currently subject to TRIreporting requirements.

A. Does This Notice Apply to Me?

Entities that may be affected by thisaction are those facilities that have 10 ormore full time employees or theequivalent 20,000 hours per year, thatmanufacturer, process, or otherwise usecertain toxic chemicals listed on theToxics Release Inventory (TRI), andwhich are required under section 313 of the Emergency Planning andCommunity Right-to-Know Act of 1986(EPCRA) and section 6607 of thePollution Prevention Act (PPA) to reportannually to EPA and States theirenvironmental releases and other wastemanagement quantities of suchchemicals. Under Executive Order13148, revised April 26, 2000 (65 FR24599), all of federal facilities are tocomply with the provisions set forth inSection 313 of EPCRA and section 6607of the PPA. Federal facilities are tocomply with those provisions withoutregard to SIC or NAICS delineations.Potentially affected categories andentities may include, but are not limitedto:
