AFFIRMATION OF JURISDICTION
Applicants respectfully submit to this Honorable Court thatthey had brought this emergency application directly from a final judgmentwith

prejudice issued by the California Supreme Court. The United StatesSupreme Court is the final jurisdiction available to them. Applicantsrespectfully submits that this matter reflects an important public interestand involves a Constitutional issue of first impression as to the legalsignificance of the term "natural born citizen" as enumerated in Article 2,Section 1, Clause 5, of the Constitution of the United States.Furthermore, the Respondent's challenged failure to perform legallyprescribed constitutional duties is directly related to Article 6, Section 3,wherein she is required to swear an oath to uphold the United StatesConstitution.
PROCEDURAL HISTORY 
This emergency application is brought to this Honorable Court from afinal decision of the Honorable California Supreme Court, issued December 52008, dismissing Applicant's complaint. .
REQUEST THAT APPLICATION BE TREATED AS PETITION FOR WRIT OFCERTIORARI AND/OR MANDAMUS AND /OR PROHIBITION
Because the Electoral College is set to meet in 2 working days, Applicantsrespectfully submit there is no time for a more formal approach to theissues listed herein. In

531 U.S. 98 at 98 (2000), thisHonorable Court accepted an emergency stay application as a full petition:"Governor Bush and Richard Cheney, RepublicanCandidates for the Presidency and Vice Presidency,filed an emergency application for a stay of thismandate. On December 9, we granted theapplication, treated the application as a petition for awrit of certiorari, and granted certiorari."

Purcell v. Gonzales
, 127 S. Ct. 5 (2006), this Honorable Court construedan application for a stay as a Petition for a Writ of Certiorari, and thengrantedCertiorari in an election dispute - two weeks before election day - regardingalleged unconstitutional voter registration conditions. Applicant respectfullysubmits this application be treated the same.
STATEMENT OF FACTS
In August of 2008 attorney Philip J Berg has filed a legal action in the FederalCourt in Pennsylvania, presenting affidavits, that Senator Obama was born inKenya and not a "natural born Citizens" as required by Article 2. Attorney onthis case, Orly Taitz, esq. followed the suit and to her dismay discovered thatinstead of providing an original birth certificate with the name of the hospitaland the name and the signature of the doctor, that could be verified againstthe vital records, Mr. Obama and DNC have filed a motion to dismiss basedon Mr. Berg’s lack of standing as an ordinary voter, but refused to provideany independent, corroborating evidence, that Mr. Obama was indeed bornin Hawaii. Mr. Obama and DNC kept presentimg a
short
version Certificationof Live Birth, a computer generated printout obtained in 2007, that did notcontain the name of the hospital, nor the name of the doctor. As Ms Taitzcontinued to investigate the matter, she found out that Hawaii statue 338-178 allows Hawaiian residents to obtain Certification of Live Birth in Hawaiifor their children actually born abroad. This statue goes back to precursorstatues from 1911, from the times of Hawaiian Kingdom and could be
