FACTS
8.Firmenichistheassignee
of
the'007Patent,asevidencedbyassignment
documentsrecordedattheUSPTO.Theentireright,title,andinteresttothe
'007
Patent,includingtherighttosueandrecoverforpastinfringementthereof,isassignedtoandisownedbyFirmenich.Firmenichisthereforetherealpartyininterestinthiscase.
9.Under35U.S.C.§154(a)(2),asuccessfulpatentapplicantisentitledtoa20-year
patenttermbeginningonthedateitsapplicationwasfirstfiledwiththeUSPTO.Becausethis

period
starts
to
run
with
the
filing
ofthe
applicationratherthan
with
the
grant
of
the
patent,
any
administrative
delay
bythe
USPTO
inprocessing
of
anapplicationreducestheapplicant's
effectivepatentterm.

Topreventsuchadministrativedelays
from
causingunfairlossesofpatent
protection,35U.S.C.§154(b)requiresthattheDirector
of
theUSPTOgrantapatentterm
adjustment("PTA")inaccordancewiththeprovisions
of
section154(b).Specifically,35
U.S.C.
§154(b)(3)(D)statesthat"[t]heDirectorshallproceedtograntthepatentaftercompletion
of
the
Director'sdetermination
of
apatenttermadjustmentundertheproceduresestablishedunderthis
subsection,notwithstandinganyappealtakenbytheapplicant
of
suchdetermination."11.Accordingly,theUSPTOmustgrantsuccessfulapplicantsupwardadjustments
of
theirpatenttermstocompensateforthreecategories
of
processingdelaybytheUSPTO.Thosethreecategories,setforthin35U.S.C.§154(b)(1)(A),(B),and(C)areknownas"Adelays,""B
delays,"and"Cdelays,"respectively.OnlyBdelaysareatissueinthiscase.
12.BdelaysoccurwhentheUSPTOfailstoissueapatentwithin3years
of
thefiling
of
thepatentapplication,excludingcertainspecifiedperiods
of
delay.35U.S.C.§154(b)(1)(B).Thestatuteprovidesforaday-for-daypatenttermadjustmenttocompensateforanyBdelays:
"theterm
of
thepatentshallbeextendedbyIdayforeachdayaftertheend
of
that3-yearperiod
untilthepatentisissued."

13.Under35U.S.C.§132(b),anapplicantmaymakearequestforcontinuedexamination("RCE")aftertheprosecution
of
