having been first duly sworn testifies as follows:

MR. TORRENS: Today is Friday, April 13,
6
2012. It is approximately 5:17 p.m. I am
7
Sergeant Torrens, an internal affairs
8
investigator for the Miami-Dade Schools Police
9
Department. Lieutenant sir, if you could
10
please read the affidavit into record.

THE WITNESS: I, Lieutenant Randy Smith,
12
first duly sworn hereby state my name is Randy
13
Smith. I work with the Sanford Police
14
Department. My contact number 407-417-7887. I
15
am making the following statement to Sergeant
16
Edward Torrens who has identified himself as an
17
internal affairs investigator for the
18
Miami-Dade Schools Police Department, State of
19
Florida, in connection with the case number IA
20
number 12-001, 12-002, 12-003, 12-004, 12-005
21
and 12-006. I am of sound mind and I'm not
22
under the influence of any drugs or alcohol at
23
this time. I understand that giving false
24
information in this statement is in violation
25
of Florida statute.

MR. TORRENS: Okay sir, could you read the

statutes please sir into record?

THE WITNESS: Statute 837.05, false
4
reports to law enforcement authorities
5
punishable in the first degree, and 837.06,
6
making false official statements punishable as
7
a misdemeanor of the second degree. My
8
signature, and witness.

MR. TORRENS: And I witnessed it, is that
10
correct sir?

THE WITNESS: Yes.

MR. TORRENS: Okay thank you sir.

DIRECT EXAMINATION

Q (By Mr. Torrens) Okay LT, so the reason
15
why we're here is we had spoken prior, you had
16
explained you were doing the victimology on the
17
particular individual, T.M., and in the course of
18
doing that victimology how did you come into contact
19
I guess, with our agency. How did you come about
20
contact as far as you can recollect?
21
A I believe through the captain in the
22
Miami-Dade Police Department, he referred me to the
23
school board police.

Q Okay sir, did he refer you to anyone in
25
particular or just the agency in general?

A No, just the agency in general. He gave
2
me a phone number.

Q Okay sir and after that what occurred?
4
How did -- who did you contact?
5
A Yeah my contact is I believe Detective
6
Hadley is who I was corresponding with and he told
7
me that I had to send him a letter or request of
8
information I was looking for on the letterhead and
9
then he would put something together for me and send
10
it back to me if he found it.

Q Okay.

A He wasn't personally aware of anything.

Q Okay sir and I have here a copy of the --
14
of the letter that you sent me by e-mail dated
15
February 29, 2012 to Detective Hadley basically
16
requesting information for your victimology.
17
A Right.

Q Did he subsequently provide any
19
information, any reports, any documentation,
20
anything responding to your request?
21
A I would say yeah what I received from him
22
was a copy of the -- the report and a note that told
23
me to contact Officer Darryl Dunn. I was never able
24
to make contact with Dunn. He never answered his
25
phone or returned any of my messages. Hadley was
